Civil society activists flay PMO's 'silence' on attacks on free speech


New Delhi, Jun 7 (PTI): Prominent citizens and civil society activists today questioned the "silence" of the Prime Minister's office on recent "blatant" attacks on free speech of writers and academicians and demanded that these constitututional rights be protected.

The citizens in a joint statement said that in the last fortnight there had been a "resurgence" of attacks to curb the right to free speech and expression of those who did not "share the euphoria, hope and enthusiasm associated with recent election results".

 The statement said the brutal lynching of an innocent young professional in Pune, following the arson and rioting in reaction to a Facebook post, is evidence of a "continuing atmosphere of intolerance and fear that threatens our democracy and must be stopped immediately".

It said such attempts to curtail the right to free speech and expression have been recurring over the past two decades, irrespective of the political party in power.

Giving examples of such incidents, the statement said that last month, Kannada writer, U.R. Ananthamurthy was sent a one-way ticket to Karachi as well as threatened with phones calls for saying 'I would not like to live in a country ruled by Modi'. 

The statement said a youth, Syed Vaqas, along with four friends from Bhatkal, Karnataka were arrested for sending a message (when the election results were announced) caricaturing the BJP government’s election slogan 'aabki bar antimsanskar (modisarkar).'

 The signatories to the statement include Aruna Roy, Romila Thapar, Baba Adhav, Vivan Sundaram, Mrinal Pande, Jean Dreze, Jayati Ghosh, Anand Pathwardhan and Mallika Sarabhai.

The citizens also lodged their protest against the "continuing intolerant legislative attempts at criminalizing dissenting opinion" and those who take law into their hands to disrupt peaceful discussions and dialogue and said they opposed the use of the "draconic" Section 66A of the IT Act against them.

"In the two recent cases in Karnataka and Goa, the representatives of police in Goa and Bangalore have stated in the newspapers that these cases do not warrant arrests.

 But the PMO has remained silent on this blatant attack on curbing citizens’ free speech and expression," the press statement signed by more than 200 citizens said.

"We urge the Prime Minister, and the Government of India and all state governments to respect the right of citizens' to express their thoughts and views, guaranteed by the Constitution of India, without fear of retribution," the statement said.

"The curbing of expression with threat and through terror, increasingly more menacing, should be condemned and stopped, if our country is to become a mature democracy.

 Indeed, the expression of varied and differing opinions strengthen the political discourse and empowers people to make informed choices, the statement said. The citizens said voicing of dissent, expression of concern, constructive criticism and adversarial dialogue are an integral part of deliberative democracy.

"The ongoing attempts to quell political dissent or dialogue among citizens through draconian laws for ulterior motives poses a grave danger to Indian democracy," the statement said.

"We fully support the right of all citizens to freely express their views, dissenting or otherwise. We demand the concerned authorities follow due process and drop the exaggerated criminal charges against all these individuals, the statement said.

Opposing section 66A of the IT Act, the statement said the Act has been worded "deliberately" to give "unbridled" powers to the state to clamp down on free speech.

"The recent incidents signify abuse under this provision that gives freedom to those in power to violate the fundamental rights guaranteed by our Constitution," it charged.

Condemning the use of "social policing, boycott and other means of state coercion to silence citizens, legitimized through regressive legislations such as the IT Act, the activists demanded that section 66A of the IT Act should be deleted.

"We the undersigned demand that the Government of India and all state governments respect and protect all constitutional rights to free speech and expression, and personal liberty as guaranteed by Article 19 (1) (a), and Article 21 of the Constitution of India," the citizens said.

    Freedom of speech is fundamental right essential for smooth functioning of democracy.
    However, adequate restraint is also necessary.
    No one has the right to misuse his right in the name of freedom.
    Se see some people make character assassination of a person or malign his or her name with a ulterior motive.
    There has to be a basis for accusation or sharp criticism.
    But nowadays, lot of mischief is played, even ones Facebook or social site account is hacked to post messages from his or her account.
    Therefore to take legal action also, matter should be thoroughly scrutinized.

    maharastra in ruled by congress majority government and the governor is also congress appointee.who are stopping them to take strict action against the culprits?does these so called intellectuals dont know that law and order is a state subject?when attacks on minority places took place during bjp govt in karnataka they should have blamed central govt and not state govt as per thier logic which they didnt. they should blame the govt of maharastra to maintain law and order.central govt has already asked report from maharastra govt and governor.these so called intellectuals blaming central govt which is not even 15 days old for every ills of the country even if it is from congress ruled state smacks of some ulterior motive.

    ..Jacinta...you will be called 'intellectual' or 'Buddijeevi' if you write against your own religion,your own tradition/culture like Salman rushdi,Taslima,Murthy,Karnad so on..Yes we have constitutional right of free speech, but it is in the interest of the society to limit ourselves while expressing..there must be some laxman rekha,which we should not cross..you just cant go on defaming people & if people retaliate just cant Govt be held responsible..what a PM OR CM can do?..thankfully PM MODI didnt banged Congress CM (if it is BJP state & Congress in center things would have totally different) ..as a citizen dont we have responsibility towards society & nation..do we follow that?..even so called champion of civil liberty ' USA' is chasing Mr. snowden & compelling him to take refuge in Russia!!..we have several incident of FB protest in several states including karnataka, dont single out one incident..crime is crime..in some TV channel debates are going relating this incident to BJP coming to power but they have conveniently forgetting that in the last 10 years of Congress rule SIMI,IM & other groups did bomb attacks,murdered many leaders by targeting only people from majority community!!..Did MMS,SONIA,SHINDE raised any voice saying minorities doing atrocities to majority..if we stop & urge the sickular parties to stop equating everything with minority/majority then only victims may get justice..

    Civic Society people need to understand what is freedom of speach. This may end up people doing bad comments on Shivaji or Mohammed or Virgin Mary.

    Free speech- yes, overly free speech -no. Constitution guarantees free speech but the constitution does not prescribe what kind of speech and therefore it leaves the government to use legislation.
    Media plays an important role but it also plays a destructive role in the name of free speech. Yes, government should be criticized as a whole but personal attacks and any form of destructive propaganda must be controlled.
    India is a overly democratic country at the same time this democracy ,open- ended democracy has created inefficiencies in the development and prosperity among the poorest of the poor.
    India does not not need draconian laws, but india needs action on the governing laws.
    Any government that thrashes free speech, albeit, just free speech is a concern and that government must be questioned. Media like Face Book is an open ended free speech and must be controlled if it creates undue in-discipline in the society and a nation as a whole..

    Lot of congis have become jobless post May 16th. That's why they are terming Hate messages as Freedom of Speech.

    By not mentioning attack on Master Hiranaih's function and vandalizing the event and by rejecting his apology there & forcing the 80 plus year old theater artist to CM's house to beg forgiveness, itself proves that vested pro congress interest behind this move. This is not a attack on freedom of expression according to them because it was against congress.
