Kundapur: Fake documents used to sell land, avail loan from bank

Kundapur, Jan 10: In a case reported from Mudoor village within Jadkal gram panchayat in the taluk, land belonging to a person was sold by preparing fraudulent documents. The person who purchased this land, has since mortgaged this land to a bank as security for a loan. As a result, several lacs of rupees of the bank are at stake and the genuine owner of the land is fighting to get his land bank, and in the process, is made to move from pillar to post to set the records straight.

The person who is at the receiving end of this fraud is N M Majeed, a native of Kerala. Perpetrators of fraud have been identified as locals, Ranjith, K K Mathew, and Sijo Thomas. Ranjith's wife, Kavita, has availed loan by mortgaging this land to a bank. N M Abdul Majeed, who has approached Kollur police station for justice, has said in his complaint that an advocate named Uday Kumar Shetty has facilitated this fraud by certifying fake documents as genuine.

N M Majeed owns a 110 acre rubber estate in Mudoor named 'Hidayath Estate', and had appointed a person named M P Vincent to look after the property. For taking measurements of the property, Vincent had contacted a person named Ranjith, who works as broker. Ranjith claimed that Majeed's mother's photo is required to complete the formalities, and obtained the same. In November 2013, Ranjith, in connivance with two others, K K Mathew and Sijo Thomas, got a fake power attorney prepared and executed, duly affixing the photograph of Majeed's mother to it. By using services of Sijo Thomas in the capacity of an agent, this fake power of attorney was got notarized and certified by advocate, Uday Kumar Shetty. By using this forged power of attorney, 4.15 acres of land standing under survey No. 26/74 was sold on December 2, 2013 to Sijio Thomas, Majeed has claimed in his complaint. The registration of sale was registered in Shankaranarayana sub-registrar's office the same day for Rs 28 lac, he added.

Majeed further said that by mortgaging this land, a loan of Rs 25 lac was availed from Karnataka Bank Ltd Kundapur branch. The police have registered the complaint and set the investigation process rolling.

    As already stated by Mr. Hegde, no bank will give a loan of more than 50% of the value given by the bank valuer!!

    Secondly such types of frauds can be eliminated by digitizing and connecting all the land registry offices connected online so that instant check can be done on the authenticity of the documents, this has been implemented in Maharastra due to increasing no. of frauds!!

    There have been cases where even dubious builders have sold one flat to three different customers by making fake documents and even some people mortgaging a single flat to two different banks!!

    But, overall, all involved in this have a part to play or otherwise such frauds are not possible!!

    So many recent cases have come up where sr. banking personnel especially of PSU banks themselves directly involved in such nefarious activities, and later escape by passing on the buck to some innocent low rung employee or make the loan an NPA, hence our PSU banks have burgeoning NPAs as apposed to pvt. banks where very strict procedures and checks are in place!!

    NPAs means it is a big loss to the tax payers money which otherwise could have been used for the betterment of the pubic!!

    Hope with a new Govt. in place strict checks are put in place and such nefarious activities are put to an end!! Jai Hind!!

    110 acre land owned by a single person? This is the reasons every wher started flat and apartment sistem.becouse for others ther is no place.

    There is more to it than meets the eye. No bank gives 25 lakh loan on 28 lakh worth property that too agricultural property. A COD probe is required if all and everyone is involved in this racket.

    Such nature of fraudulent things happens in 21 th century is very strange.In the process Registry office,revenue personnel and Bank personnel's role should be investigated.There are too many rigid requirements before awarding loan to particular properties by Bank but how all these tests are passed?
