Udupi Apr 8: Eighty-three-year old retired school teacher Stella D’Souza has finally succeeded in regaining her property under the maintenance and welfare of parents act.

Stella is a spinster and now resides in Vamanjoor, Mangaluru. Along with her sister Pauline Marveline D’Souza, she had jointly purchased five cents of immovable property in Tiruvail village in 1996. Pauline passed away in 2008. Juliana D’Souza, the wife of their deceased brother used to visit Stella on the pretext of ascertaining her welfare. Stella trusted her and led her to agree to keep the documents safe in the sub-registrar’s office. Later, the petitioner came to know that Juliana had tricked her and executed a sale deed of her property for Rs 3 lac and found Juliana’s name in her RTC.



Stella then lodged a complaint with JMFC, 3rd Court Mangalore, on 2013. Being a senior citizen, she sought protection under the Maintenance and Welfare of Parents and Senior Citizens Act 2007. After six long months of court hearings, the verdict was given that Stella is the real property owner and her sister-in-law should return all the original documents.

I will forgive her mistakes

Stella said, “If she comes to me, I will compromise with my sister-in-law and withdraw my complaint from court soon. Since she also comes from a poor background, I will forgive her mistakes. I got what I wanted and I don’t anything more than that.”

Ravindranath Shanbagh, president, Human Rights Foundation, Udupi, said, “There are 392 cases registered throughout the state. Of these, 12 have been settled and cases from Bengaluru (2), Tumkur, Chikmagaluru, Mangaluru, and Udupi are related to domestic violence, cheating, sale deed, throwing out parents, property conflicts, and so on. There is no special provision for punishment in such cases,"

"According to the legal order, a case should be settled within 90 days, but in some cases the assistant commissioner failed to keep a regular hearing or investigation process. There is no special provision for interim orders in emergency cases. Rules can be changed because the central government has complete power to making law as per the Constitution. The poor people will suffer due to the lack of publicity about the Acts and Provisions.” Ravindranath Shanbagh added.

He urged the enforcement of strict laws and quick response from the concerned department.

    A catholic lady... Church goer... church which has multiple association...womans wing, catholic sabha, ICYM, SVDP society... But th end she got help from Human Rights Foundation, Udupi Kudos to Mr Ravindranath Shanbagh,for your selfless work to the needy woman...

    If we look at the church.. what is the use of having 18 commissions, why is this catholic sabha, why is these sthree sanghatans... just to show of themselves not working for betterment of the people...

    If they have supported that must be to that woman who cheated this poor lady...
    Pls stop these kind of nonsense in the churches..

    Catholic church or 18 commissions you refer to manage church and spiritual aspect not the legal aspect.

    It is the lawyer's job. church can't run political and legal issues and church has it's own limitations when it comes to law.

    Church can't get into private affairs of property issue of private person. It does not affect his spiritual life.

    Do you think church should hire priests or lawyers, courts and dispute settlement ?

    It is with any religion regardless, religion can not interfere your personal affairs.

    Also note Warefare of parents act is community service of different kind and legally involved with social order. Hope you understand !

    This is an example of how new (this case dealt through a 2007 enactment), well thought out laws are effective and can benefit the right people. In most areas, our criminal laws are ancient, ambivalent, full of loopholes and can easily be circumvented by every Tom, Dick and Harry. Government needs to urgently look into our archaic laws (some more than 100 years old), bring them upto date and incorporate latest safeguards so they can be dispensed faster and serve as an effective deterrent.     Really i wonder that, still justice is alive. I dont know why peoples are running to snatch other property or money, like we are staying in earth forever. We came to earth only for few years, then we dont know about our property or money. Be hapy by sharing ourselves in others happy. Specially respect elder peoples, because now a days, no one/rare touch the age 55-60. Better we all should understand the mission of human life. If we like to know about real life, we have visit Orphanage or old age home. In that homes, really we will realize that, money/property all are just paper. I'm requesting to all that, kindly bare with all & walk with gods fear & eldres blessing.
