Bengaluru: HC stays enforcement of law on rural service for medicos


Bengaluru, Oct 7 (DHNS): The High Court on Tuesday stayed the enforcement of the Karnataka Compulsory Service Training by Candidates Completed Medical Courses Act, 2012, that came into effect on July 24, 2015.

In an interim order on a writ petition by students of M S Ramaiah Medical College and Hospital, Justice Ravi Malimath ordered the State government to issue degree and registration certificates to medicos who had challenged the retrospective enforcement of the said law. But the degree and registration certificates would be subject to the result of the writ petition.

The court also directed the students who approached it to submit an affidavit stating that if their petition was dismissed, they would comply with the Act.

Bushra Abdul Aleem and other students, including some foreign nationals, have challenged the retrospective enforcement of the said Act which mandates that all medical students serve for a year in government hospitals and primary health centres in rural areas to be eligible to get their degree and registration certificates. The rule applies to all those studying MBBS, diploma and postgraduate medical courses in government colleges or on government seats in private colleges.

The government has argued that the law was enforced to address the shortage of doctors in rural areas by obtaining the services of medical students who graduate in large numbers from a host of colleges in Karnataka every year. The students countered by saying that the government’s “failure” to appoint doctors in rural areas cannot be overcome by bringing in an “arbitrary” law and enforcing it strictly.

    Compulsory rural service has both its supporters and non supporters!!

    This apart do you know that they have found that the quality of medical grads and post grads, off late, are of very poor quality hence there is a pending proposal of an 'exit exam' to all medical students before they start active practice!!

    Also, due to problem of deteriorating quality of product, there is a proposal in advanced countries to 'not to take students who have got entry into med colleges by virtue of capitation fees'!! Jai Manglur! Jai Hind!!

    Karnataka Govt recently recruited doctors based on marks secured in MBBS! Marks for RGUHS rank hover around 75% wherein most candidates from deemed universities score 90%. Those graduated from China/Russia are more blessed and competency of those need not be elaborated at the expanse of space. Rural people are hub of our agrarian economy to deserve better and Govt should not treat them as second class citizens. Whatever happening in Health Dept is nothing but drama where script/direction is exclusively by Mr. Khader as in case of rural service scheme. Karnataka is an overtaxed state and still its coffers are empty. Tax collected is just enough to meet TA/telephone expenses of CM/Ministers/MLAs. CM has spent few crores to refurbish his official residence and lakhs for purchase of bath towels. Mr. Khader himself has claimed a whopping sum as TA/Telephone expenses recently. But, they do not have funds to increase stipend of interns who are made to work more than 15 hours a day.

    Primarily, defective medical education policy is the root cause here. 60% of medical seats in the state goes to elite class on payment basis. Those who pay crores together to secure a seat and spending lakhs to clear the examination through bluetooth technology is in no mood to serve the rural poor where their financial will not break even. Merit students are now a severely punished lot. Many of them, especially girls, may not have opted MBBS if additional burden of one year is disclosed in the beginning itself. Government should not change the rule of game in the middle and shall not meet its obligation to people at the sole expenses of medical graduates. They can recruit exclusive rural medical officers. Many of the freshers, especially those from poor/rural background will readily opt with passion and commitment. Indian democracy is a Tamasha. People are powerful only while heading to polling booth. Our options are limited in a party based democracy. Whatever you opt, destiny is same!..

    I think many more students will come forward to contest against the rural service in the court.

    Another reason students joined in 2012 and thereafter have not signed any undertaking that they would do one year rural service.

    Yet, this rule is finally implemented, Karnataka will loose foreign and NRI students who opt seat paying foreign currencies. These funds will flow to other states.

    Last but not least, does the Finance Dept. of Karnataka State have enough budget to pay these thousands of MBBS, MD/MS and super specialty students passing out year after year? In all probabilities, this new rule is a big flop.

    That(Ullal Police Station) is his second home...Siddu could not find a physician to make health minister from his party?

    Thank God he did not made DKS as health minister like Yeddy made R Ashoka over VS Acharya...
