Bengaluru, Jul 18: It is known now that the state government which was pressurised to handover the Ganapati suicide case to Central Bureau of Investigation (CBI) has ordered formation of a single-judge commission of inquiry headed by retired high court judge, Justice K N Keshavanarayana on Saturday, July 16. The government has repeatedly said that no ways the case will be handed over to CBI as there are already 8 state cases that are being handled by the agency presently. Chief Minister Siddaramaiah too on Sunday again said that he did not feel that there was any need to call in CBI for this case.
It is remembered that much before the Justice Keshavanarayana commission was pointed, criminal investigation department (CID) was doing the probe. At no point, the government has said that CID probe will be stopped. Hence now there are questions in the minds of people on whether the CID and Commission both will probe the same case. The CID officials themselves are confused about this fact and are expected to approach the government to seek clarification.
A first information report (FIR) was registered at the local police station under CRPC 174 immediately after the suicide of DySP Ganapati. As it is a criminal offense, the police will investigate the matter and submit the report to the magistrate. If there is any accused in the case, trial will be held against that person.
The police and CID will follow the same rules of investigation with the questions like why did Ganapati commit suicide. Who are responsible for that?- All these questions will have to get answers in the investigation.
But the commission report is different in some ways. The commission may not come to know who the accused is, as it does not probe from that angle though it will try to find answers for most of the questions asked in the case. The commission does not submit the report to magistrate but will instead submit to the government. The government can accept or decline to accept the commission report. If the commission wants any action against any people, the police will have to take action.
Most of the cases submitted to the government in the past, have not served the intended purpose, legal experts say.
In the case of police or CID investigation, the investigators will go to the places or the people are called to the police station. But in case of commission inquiry, the people are called to the office of the judge by sending them notices.
Some people opine that there is no conflict if both investigations are done simultaneously. But if two investigations are done, the same people are subjected to interrogation twice. Ultimately what matters is, will the questions asked, be answered by the investigations.
