Mangaluru: Vedike creates awareness on Mulageni rights, urges tenants to apply

Mangaluru, Jan 9: Mulageni Okkalu Rakshana Vedike, which has been fighting for the abolition of Mulageni tenancy system in the coastal districts of Dakshina Kannada and Udupi, on Sunday January 8 stressed that according to the Mulageni act, a tenant is entitled to enjoy the property he resides in, permanently, and right to the property is inheritable. Applications are invited for granting ownership right to tenants, via a competent authority. This was conveyed at the sixth annual general body meeting of the Vedike, at Don Bosco Hall here.

At the meeting, Vedike legal advisor, Gowrishankar said, "The long-standing demands to confer ownership to tenants under Mulageni or Volamulageni Tenants Act, 2012, has come into force. The coastal districts have wanted the right of the landlord to be invested in the tenants to enjoy the ownership of the property. The state legislature of Karnataka has accepted the requests of the Moolageni tenants, and conferred ownership through the Moolageni Tenanats Act 2012 that was unamimously passed in 2012."

"The guidelines and gazette notification were supposed to be formed, nothing has been done yet. There was much opposition from the landlords as they challenged the validity of this act, and filed a writ petition before the state high court where the matter still stands pending. Though the landlords filed a petition before the high court for granting a stay order, the high court did not pass any order for stay. The act came into force on November 7, 2016," he said.

"The Mulageni tenants are filing applications before the competent authority under the Act for granting ownership right to them. They are willing to pay the compensation as laid down in the act, which is 1000 times the annual geni. The process of filing the applications and holding inquiry on such applications must continue," said Gowrishankar, emphasising there was no 'stay' granted by the state high court.

He expressed gratitude towards revenue minister Kagodu Thimmappa for taking the initiative to enforce the act that was pending for three years. He was also grateful to MLC Ivan D'Souza for showing concern towards tenants and for raising his voice in the assembly, regarding the same, which helped towards enforcing rules for Permanent Mulageni Act.

"The Vedike will appoint a member to guide tenants to file the application as per the procedure of the Act," he added.

President, Mulageni Okkalu Rakshana Vedike, Maxim D'Souza, office-bearers of Mulageni Okkalu Rakshana Vedike, S S Kamath, Dasappa Kamath, Lilly D'Souza and others were present.

    Hi there, What is the latest on Mulgeni ? What if the Mulgars are no more there and the Mulgeni own the land.. How can this Mulgeni be revoked from this land. I am sure there is a way in this modern day and age dont tell me the Govt is so ignorant.. Thanks

    Jamindar or owner of the piece of land. Jamin is productive piece of land. Dar signifies ownership. Mula signifies Root or the First
    and Muladar is the Root owner or the First owner. This Muladar is mentioned as the Khatadar in the books of land revenue at
    present. Khata is the name of the document containing the details of the land and building for revenue purposes and maintained by
    the local authorities such as the Municipal authorities. Mulageni is a compound of Mula and Geni. We know already that Mula
    signifies First. Geni is the term used for rent payable by the tenant to the owner. This rent has been in either cash or kind.

    Gathering of mulgeni tenants itself shows that to get rid of the problem as early as possible to get their right, Govt. has to give firm stand to the high court and allow mulgeni tenants to forward the application.

    The Awareness meeting held on 8th Jan., 2017 at Don Bosco Hall, Mangalore by Mulgeni Vokkalu Rakshana Vedike was a grand success. The attendance to this meeting by Mulgeni members itself has shown their inclination to regularise the property. The efforts by committee members is in the right direction.

    A mulgeni is a system that was introduced during the British Rule. This mulgeni system is only in South Kanara. During British Rule, the britishers authorised few individuals/the churches/temples etc to collect land tax on behalf of the government and they were know as Mulgars. One who pays tax is called as Mulgeni and one who collects tax is called Mulgar. When Britishers left india the rule continued and Mulgars considered themself as landlords of the land which in fact they are not but in reality they are tax collectors. Hence we have approached the govt stating that the mulgar's have no right over the property which they (Mulgar's) are claiming 1/3rd of market price or registered price to regularise and make it freehold. The govt has specified what rate they are entitled but they are not happy and the real fight is not right on 1/3rd but the real fight of mulgar's is money.

    1. How does one know the property has Mulgeni encumbrance ?
    2. If it exists what can be done ?
    3. Is there any judgement awaited ?
