Bantwal, Jan 17: A habeas corpus petition that had been filed in the high court relating to lovers from Kanyana village in the taluk belonging to different communities who had eloped all of a sudden, was dismissed by it on Monday January 16, to the relief of the girl's family and relatives.
Ganyashree (21), a college student, who was daughter of the late Pilinguili Sridhar Shetty from Kanyana village, had gone missing all of a sudden. Her mother, Shashiprabha, had filed a police complaint in Vittal station relating to her disappearance. A special police team formed for the purpose had succeeded in finding the girl in the company of a youth from a religion that is different from her own, from Nayammaramoole in Kasargod, within two days.
The youth with whom the girl was found happened to be Sameer (27) from Shirankallu in Kanyana village. The police had taken both the lovers into possession and released Sameer after issuing a warning and getting a bond executed by him. The girl was referred to the counselling centre at Mangaluru.
In the meanwhile, a person named Muhammed Basheer filed habeas corpus petition in the HC. The HC, after going through the petition and hearing both the parties, noted that Ganyashree is yet to complete her degree education. It noted that she lives with her mother, which cannot be treated as some kind of illegal confinement. Therefore, it observed that Basheer does not have the locus standi to file this petition. The court also advised the girl to study well towards getting a good employment and bright future, and sent her with her mother.
Hindu Jagran Vedike, Brjrang Dal and Vishwa Hindu Parishad had evinced interest in ensuring that this case reaches a satisfactory conclusion. Advocate, Arun Shyam, had represented the student and her mother in the high court.
