Mangaluru, May 13: The first additional district and sessions court here has acquitted a person of the charge of murder he was facing, after identifying him as having been suffering from mental derangement. The accused, Jawaharlal Bog (29), had been accused of committing a murder within the limits of Moodbidri police station in 2014. As per the instructions of the court, the district legal services authority has found out the family of the accused with the support of police. Arrangements are being made to hand him over to the family.
Sanjeeva Poojary (71), residing at Nooyi Parottu in Padukonaje near Modbidri had been killed by hitting his head with a curdgel on April 30, 2014 in a forest area near his home. Accused, Jawaharlal Bog, had been arrested the next day. During investigation, it transpired that Jawarhall used to work with three others to dig borewell in Padumarnadu village. He has sought some drinking water from Sanjeeva Poojary. As Poojary did not provide any water to drink, Jawaharlal got angry and hit Poojary in the head, killing him instantly.
The court, which observed the behaviour of the accused during the hearing, ordered for checking of his mental health. Doctors of NIMHANS hospital at Bengaluru, who checked him, reported him to be suffering from mental disorder. The court summoned the doctors to the court and obtained their statements. As the accused was found to be mentlaly unstable, the court quashed the case against him on February 22 and ordered for his release from judicial custody. It ordered the legal services authority to keephim in a proper rehabilitation centre, find out members of his family and arrange to hand him back to the family. The police arranged to keep him in Seone Ashram, Beltangady.
The legal services authority, with help from Moobdbidri police, went to Chattisgarh, and with the help of legal services authority of that state, found out the family of Bog. Arrangements have been made to bring his elder brother, Nohar Bog, to the city and hand Jawarhalal to his custody. The court has ordered to hand over Bog to his family on next Tuesday.
This information was provided by senior civil judge, Mallana Gowda, who also happens to be the member secretary of Dakshina Kannada district legal services authority, at a press conference held in the court premises on Friday evening. Public prosecutor, Raju Poojary Bannadi, had presented the case on behalf of the prosecution. It is learnt that the family of Bog believed him to have died long back.
