Chitradurga: Breaking promise of marriage, rape - accused gets life term

Chitradurga, May 9: A person who loved a lady from Basappana Malige in Hiriyur taluk, promised to marry her, raped her as a result of which she committed suicide, was handed down life term imprisonment and fine of Rs 90,000 by the sessions judge of the district and sessions court here, D Veeranna.

A person named Tippeswamy had made a girl believe in his promise of marriage and succeeded in taking her in his car on November 7, 2016 towards Vridhigere. He had parked the car by the roadside in a deserted stretch and raped her. He had dropped her off near Basappana Malige by promising to pick her up after carrying a friend to Chitradurga. As he did not come back to take her, the lady, who was frustrated, had committed suicide in an adjacent land belonging to Krishna Reddy. The then police circle inspector, H V Sudarshan, had filed a charge sheet in court.

Tippeswamy was awarded life imprisonment under Protection of Children from Sexual Offences Act and five different sections along with fine. Special public prosecutor, N Beeralingappa had appeared in the hearing on behalf of the prosecution.

    How old was the girl? If the person has been convicted under the POCSO Act, then the girl surely is a minor.

    I think the news article is misleading by giving the impression that the man has been convicted for rape because he did not keep his promise to marry her. The narrative may be actual fact of the case, but his conviction for rape is most definitely not on account of that.

    The girl is a minor and hence she is not capable of giving a legally valid consent. Hence the accused is definitely guilty of rape.
