Mangalore: Restriction on Wearing Scarf is Unhealthy - Human Rights

Mangalore, Aug 24: Justice S R Nayak, chairperson, State Human Rights Commission, opined that the issue of wearing scarves in colleges is a matter of religion and it has to be debated on a wide spectrum with scholars expressing their views.

Speaking to media persons, Justice Nayak said that the issue of wearing scarf or ‘burkha’ is a matter of religion as it is a religious practice. “Religious freedom has been guaranteed by the Indian constitution where it not only addresses merely matters of doctrine and beliefs pertaining to religion but also its practices”, he said.

Referring to the disturbances of communal harmony in the coastal districts, Justice Nayak said that the restriction on wearing scarf and ‘burkha’ in Sri Venkatarama Swamy College in Bantwal and government college in Uppinangady are unhealthy and not conducive to development. “If it is repeated it will lead to the tearing of the secular fabric of our society and create disharmony in the lives of the people of various faiths and religious denominations”, he added.   



    

He said that he has ordered the additional chief secretary of the home department, principal secretary of collegiate education, inspector general of police (western range) and deputy commissioner of the district, through the commission, to submit their reports within six weeks describing the steps and measures to promote social harmony among all religious groups.

Justice Nayak is in the city on an official programme including receiving grievances from the public on violations of human rights.

      With due respect to the statement issued by Justice S R Nayak, chairperson, State Human Rights Commission here my question is any dress which is decent and acceptable should be worn. Burqa dress gives safety to women as it covers the body completely. But is it segregate the women from other folks or is it bring together all students and community is the question mark.

      In the middle East countries like Bahrain, Kuwait, United Arab Emirates the girls are wearing western dress covering their bodies with decency so as in India many women wearing the same dress code. When religious leaders stop interfering, then most of the issues will not arise and the society will be more healthy, strong. Giving too much importance to the religious leaders might be the root cause for many unwanted issues.

      Respected Justice S R Nayak chairperson State Human Rights Commission. Sir, First of all I would like to thank you for your convincing comment on the above matter which should be accepted by all. But sir, I would like to know why did you not answer when there was only one college (SVS) did this and after a couple days another college banned Scarf (Burqa), It could''ve been more effective and less destructive as it has become now.

      But from true heart, Myself and my friends, would like to wish you all the very best for anything HUMANE you do. May God Bless You in that. Aameen.... A small request for anti social elements , please don''t even try to create any problems in the EDUCATIONAL STRUCTURE atleast. Thank You and learn something from Mr. S R Nayak.

      Indian constitution guarantees certain fundamental rights to its citizens and these guarantees are not even dreamed of in Western countries constitution. Indian constitution by far the most rightworthy. In recent years these rights have been denied in western countires to its Muslim women and girls. Here Mr Nayak has again reitrated these rights.

      Muslim women have the fundamental rights to wear burka or head scarf. I personally prefer this pracice and it is most honourable and I appreciate Muslim women to uphold this tradition for the good of society. Jai ho and be allah bless you all.

      Hon. Justice S R Nayak reminds us one of the constitutional rights of a citizen which is right to follow and practice a religion. Here the college management captured the right of a citizen by restriction on head scarf. So authorities should  take legal action against college management on its violation of constitutional right.
