Mangalore: Forceful Eviction - KIADB Takes Over Patrao’s 6.9 Acres Land for MRPL

Mangalore, Apr 29: After the state High Court dismissed a long-pending case filed by a local resident against the acquisition of his lands, the officials of Karnataka Industrial Area Development Board (KIADB) took into possession 6.9 acres of land located near Kalavar village under Bala gram panchayat from the concerned on Wednesday April 28, with police escort. Gregory Patrao had fought a dogged court battle against the KIADB’s initiative to acquire land belonging to him for the Mangalore Refinery and Petrochemicals Ltd (MRPL), all these years.

The KIADB will now entrust the land to MRPL for its second phase of refinery expansion plan.  The KIADB officials armed with the court order and accompanied by a police contingent, men and machines, arrived on the spot on Wednesday. After a notification for the land acquisition was issued in 1992, owner of the land, Gregory Patrao, had filed a case in the High Court, refusing to hand over his agricultural property to KIADB. Reportedly, the family members of Patrao requested for some time to shift their belongings including stock of areca nut, rice, livestock and other household goods. The house and other structures standing on the said land were demolished on Wednesday with the help of a backhoe.












Tahsildar of Mangalore taluk, Manjunath, said that KIADB had deposited Rs 1.56 crore being the compensation for the land acquired, in the civil court here, in December 2009.  He added that the High Court had dismissed the case filed by Patrao on March 19, 2010 and that the family refused to accept the offer for alternative arrangement for relocating them at Permude village. He added that the efforts to convince the family in the morning to vacate the place did not yield any positive results and that the officials had no other option but to execute the court orders. Land acquisition officer of KIADB, Krishnamurty, told the reporters at the spot that out of 14 acres proposed to be acquired, the court has decided only about 6.9 acres of land and that the hearing in respect of the balance land is in the final stages.

Gregory Patrao, supported by NGO activist Vidya Dinakar and secretary of Agricultural Land Protection Committee, Lawrence D’Souza, demanded to rehabilitate him in Kalavar village itself. He also said that he is yet to receive a copy of the High Court order and that the demolition team had arrived without serving him any advance notice.

Panambur deputy superintendent of police, Girish, inspector, Valentine D’Souza, Suratkal station house officer, K U Belliappa, sub-inspectors, Ramesh, Anantapadmanabha, Pramod Kumar, revenue inspectors, Pushparaj Shetty, Diwakar Rai, Bala gram panchayat president, Lokesh Shetty etc., were present.

    Dear Mr. Raul Mehra, Your name itself suggests that you are from the north and have not faced the brunt of losing your land. We had a farmhand and his family staying in Bala village. Their place and small property was acquired on the understanding they will be given a job in MRPL. The alternative land given was on a God Foresaken hilly area with dearth of electricity & Water. The elder son got a job as a helper as his education level was 8th that too under subcontract and not direct MRPL employee. The other educated sons one BA and the other B.Com graduates had to seek livelihood outside India leaving their Aged parents to fend themselves. This you call justics. How much did you pay to get your job in MRPL? This is worth probing into.

    I must draw your attention to something that really broke my heart recently. the demolition of a house and aquiring of agricultural land by KIADB. i know you are focused on development. but development at the cost of Humanity is going to kill us all and lead to more people taking arms like Naxals. In view of humanity, can i ask you as My Government to visit them and ensure justice is being made. While i have never admired your Party nor your chief minister.     How many crores some top IPL cricketer are paid for just 45 days. 1.56 crore for such a fertile ancestoral land is very less. It should be minimum 100 crores.Besides the losing farmer should gieven subbstitute fertile land for agriculture. WHAT FARMERS GROWS ONLY WE CAN EAT.

    The people has been given 1.56 crores for 7.8 acres. And they can expect another 1.56 for the rest of the land. This case has been going for 20 years. People like these are the main cause that the highway project has been delayed too. Buy a good house for 50 lacs, put 2.5 crores in bank and they have a good income for the rest of their lives. You can easily buy 10 acres for less than 50 lacs elsewhere. I work in MRPL and they hire lot of people.

    This is exactly what happens when "Few" person with enough political clout and financial backing takes over the country, Why are we supporting the Ambanis and the like so that they can become more richer by the day,and continue with this kind of atrocities, When I wrote about the "City Centre" coming up in mangalore what is effect of that and what they ruined "Daiji" you never printed my comments because it was more of a negative one as every one was thanking the builder and promoters,and this is exactly that is going to happen for each one of us in some way/form or the other when few persons in this Democratic country with capitalist view comes to power,

    Please realise this,always support the poor and the middle class section of the population ( Which by the makes more than 905 of the population) and raise their standard , these section of the population is driving the economy and when all what they had/have is taken away finally you have section of people who will revolt against the system as they think "They do not have any thing more to loose" and in turn cause mayhem to other innocent persons, This is a chain reaction and will cascade in different form.     I feel sad for Mr. Patrao. His house is pulled down. No time to shift. Some one here commented "he has not received the notice, but the action is taken based on the statement". There is a law called "Service of Notice". If a person is "not traceable" = he is not living on that address. Even if living, can "avoid" taking notice. But if "refused", it amounts to "knowledge of the contents of the notice". Then, the serving man makes an affidavit to this effect by which "delivery of notice is complete". So, notice not received in hand can not be his defence.

    Do you think, Mr. Patrao who pitched a tuff long lasting legal battle with authorities does not know all these things?. Who knows? That's how Police Force came. They can not come illegally. Even the News Papers, some times do not give full picture - not to hurt the poor people because their report should not be used against him. They also have sympathy for poor. In 1985 or so , I had, for 2 full days (surveyed) the entire 1,500 Acres land from which only 850 was to be acquired initially for MRPL. Refinery licence was granted to Indian Rayon(
    Aditya Birla - my employer) and H.P. No doubt, Mr. Patrao's land area is fertile one. The Govt. offered rate then was Rs.30,000/- per Acre. People wanted Rs. 3,00,000/- from Birla. Subsequently Govt. acquired land for MRPL. For Mr. Patrao Rs.21.74 Lakhs per Acre is offered. He has not accepted this compensation. Now he is bound to accept and obey Court Order.

    I wonder if KIADB officials, the highcourt judges and all govt and MRPL machinery, knows how long and how much sweat is required to make a yielding farm. Only those who have dirtied their hands in mud, would know how the Patraos and many other farmers felt. 1.56 crores is peanuts for what they have taken away. I am sure MRPL will supply fodder for cattle and feed for humans from their factory, as they have taken away food of so many people through this land acquisition.

    Am really so sad to see this forceful eviction, look at this family how much they loving their gold growing land. Sure, nothing can compare any compensation money or job against their land. Look at that picture of old lady’s face, this place is for her heaven. Her dynasty grown from this place, her birth, childhood life, marriage, given birth to her children, everything collapsing in front of her eyes. Her eyes miserably witness that from so many years of her attachment of this empire vanishing.

    Praveen Shetty, if you lose the fertile land of generation, will you speak about the law and court order? When it happens to others easy to advise since no emtions involved. Development is needed but not without adequate compensation. Govt should take courage to provide alternative fertile land to the satisfaction of the land loser. Govt should provide bigger land with ample water as a compensation to the grown up plantations.

    It is a pitiable sight to see the plight of the Patrao family and the ordeal that the family has gone through is well framed on the face of the matriarch of this family which one cannot easily forget. All the same, life has to go on, no matter what one has to face in life, life has to go on. I would rather, Mr. Patrao pick that offer by the Government and look ahead keeping his head high , though it is easier said than done. Perhaps he should take heart from the wise words of a good writer when he says:

    “If you can make one heap of all your winnings
    And risk it on one turn of all pitch and toss,
    And lose, and start again at your beginnings,
    And never breathe a word about your loss
    ……….you’ll be a man, my son!

    This is a very cruel way of dealing with the farmers/citizens. In the pretext of development our fertile mangalorian rainybelt has been taken over by these projects. Why don't these people go to the dry regions like Gulbarga, Bidar etc. These selfish elements think of their benifits and not our development.

    Patrao family's pain can be understood.The land is the symbol of their existence. Even God will not forgive these corrupt forces.DEMOCRATIC MODERN INDIA but helpless farmers/ citizes.WHAT A IRONY? Ha Ha.

    It is very very hard to digest that at this age the elder lady of the house, who lived all her life there, is getting displaced. But if all of us start protecting her land against the development the over all progress will not take place. It is very painful but we have to co-operate with the Govt in acquiring land for rail, road, industries etc. because the Govt has the constitutional right to vacate in such occasions. Hence, even the court is helpless. My deep sympathy for the family but they have to oblige for the betterment of our Generation Next. May God give them the strength to overcome their grief.

    This is very sad to see the scene something like this, also under the rule of current state government? This could be anybody.. today is Mr.Patrao's house, tomorrow mighty be it is Shetty's house, or Akbar's house or Nance D'souza's house or Mr.Singh's or Banumati Buddha's house or Narendra Jain's house? I mean to say..it could be anybody.. what you would do? This called CRIME AGAINST HUMANITY, this is happened many times under current rule for everyone directly or in-directly. No doubt Law is Law,but Law is to protect itz citizens rather than distroy them in-human way.Why there are so many police force in this honest living house, why there are no politicians to help them to come out from Trauma?This called Indian politics have many colors and faces.

    Shame on all of those here who speak of development at the cost of Humanity.. Its easy for you to say that " its an acceptable loss to ensure there is development". Put yourself in Patrao`s shoes and think again.. Forcefull eviction from your home that you were born and lived all your life, where not only you but your parents and family lived all their life.. Its not a good scene to see..

    My prayers and sympathies with the Patrao family. God is great and Just. Trust in God.

    I never knew that 6.9 acres of land was valued only 1.56 crores in Mangalore. If this is the way development is done without compensating farmers adequately, its a disgrace on the name of development. This situation would never happen if some politician had owned this property.

    I fully agree with Prof. J. Lancy D'Souza, Anjelore. I was a good example of what he is telling. I being a Chemical Engr with similar experience applied in MRPL in the year 1995 with 9 years of experience. All the top bosses are Tamils. HR is handled by Mallus.( Gr8 Combo!!)I am not against that, but the first preference should go to locals.They did offer me a job, but imagine that of an Operator??They did not consider my qulaification & experience. I was working in Reliance Industries Bombay during that time.
    Now when the land is required they grab from poor people. This is the law of the land.We as common citizens can not do anything. Just pray & ask the good Lord " ......deliver us from evil.Amen"

    High court notice is reached the Patrao family. No proof of court order acknowledged by this family. Only statements.
    Today it is for Patrao and tomorrow it might be your turn. Development for whom. Is it for the rich or for the oppressed class.
    No time given to shift the household goods including agriculture. Corrupt Govt. official who are under the payroll of rich, when similar incidents happens to them or their own family members others will have similar laugh.
    Oppressed family tears will enough even for the downfall of strong, powerful oppressors. Only time will be the witness. Shame on them who praise this act in the name of development. What one desires for others will be the same to them too.

    This is not something new that MRPL has done which it has not done before. Inspite of providing employment to Mangaloreans and residents of Mangalore, the MRPL employees are full of Tamilians, Keralites, Andhra Pradesh and Maharastrians. Hardly 5 - 10% of Mangaloreans work in MRPL Mangalore. Even there is no proper system to apply for jobs. People who go to try for a job are blindly returned by the gatekeeper's. That is the pathetic employment system followed by MRPL. Shame on MRPL being in Mangalore City. What is the benefit of big Companies being operating in Mangalore City where the job opportunities are given to outsiders? at the cost of poor Mangalorean Farmers???

    I am really so sad to see this forceful eviction, look at this family how much they loving their gold growing land. Sure, nothing can compare any compensation money or job against their land. Look at that picture of old lady’s face, this place is for her heaven. Her dynasty grown from this place, her birth, childhood life, marriage, given birth to her children, everything collapsing in front of her eyes. Her eyes miserably witness that from so many years of her attachment of this empire vanishing.

    I salute Mr Patrao for his brave battle. Here he didnt lose the battle, but his battle was benefitted by scores of others who had similar situations. Anyway development has to take place and land needed to be acquired. But the procedures and process involved here has been learnt by others too. Govt should adequaltely compensate the affected people and do everything to rehabilitate them else where, a place to be agreed by both the government and affected one.

    Pathetic scene with old woman and other family members. There are claims and counter claims, we don't know who is right and who isn't.

    Nevertheless, could similar measure be taken for Nantoor Bridge project too ? Surely not because the project is under central govt. But, the people not handing over the land were locals ? Why discrimination then ?
