Mangalore: Narco Test – Lokayukta Unhappy with SC Verdict

Mangalore, May 6: Karnataka Lokayukta, Justice N Santosh Hegde, has expressed his unhappiness at the verdict given by the Supreme Court, which has ruled that conducting narco tests on a person without his consent is unconstitutional and illegal. He commented about this judgment that has the potential to rock the investigation processes and the justice delivery system alike, as several investigations have relied heavily on the outcome of such tests.

Justice Hegde, who was in the city to take part in a programme in Suratkal, was met by the media men at his residence on Wednesday may 5. “I do not feel that the verdict of the Supreme Court is right. Under the present circumstances, during investigations in some cases, investigators need to use modern methods to extract information from the culprits. It would be wrong to compel the policemen to use the same old methods for investigations. Both in the eyes of law and court hearings, the accused have more chances of proving their innocence. Hence, there was no need to take another stand that is tilted in favour of the accused,” he opined.

He noted that Ajmal Kasab was subjected to narco tests without his permission and questioned as to whether it could be termed as wrong.  He reiterated that narco tests are among the modern methods that help the investigators to get important leads in their investigations, and hence felt that they need to be permitted.

    It is true that Narco Test is modern method used to investigate and get authentic information from the culprit about a case. I am of the opinion that SC should not have given this verdict. This could hamper the job of investigators to a large extent and then crude methods have to be used to reach to the roots of the cases. Authorities should try and understand that we have to move on with latest technologies/ with certain restrictions and carry on, rather than prevent them.

    My apprehensions are also about the culprits going scot free if old methods are going to be continued, which always has been the case in most cases. SC should re-consider this verdict with further consulation at all levels and permit Investigators to continue narco tests when and where required.

    Narco test should be compulsorily conducted upon all public servants ( specially officers of high order / judges/ ministers) once in every 5 years to get an idea of mishappenings, indulgence in corruption activities if any, quantum of black money etc. This test should replace the routine annual assets (acquisition / disposal) declaration being submitted by the individual officers to their employers. This should be a part of the periodical health check up package scheme extended to all utives/ officers these days. This exercise alone is bound to push up the growth rate of India beyond that of China or Japan. It will improve transparency in Governance. Only those who accept this condition may be allowed to continue in Govt Job. Persons not submitting to this may be kicked out. This should apply to all streams of govt i.e. utive, judiciary and legislatures. Corruption in these forums are in fact responsibile for spread of naxalism, terrorism and petty crimes like murder, rape, poor performance in olympics or growth of swamis like nityanand of banglore. This would be in compliance to the soul of our constitution to maintain integrity of highest order in public life / governance.
