High Court Puts off Hearing Against 'Disqualification' to Oct 12

Bangalore, Oct 11: The Division Bench of High Court, which took up the writ petition filed by the 16 'disqualified' MLAs, comprising 11 from BJP and 5 Independents, has put off the hearing on the petition till Tuesday, October 12.
               
The 16 MLAs had challenged the decision of speaker K G Bopaiah to disqualify them without following the due process of law allegedly for anti-party activities, when they had not done anything against the party but had only expressed their lack of confidence in chief minister B S Yeddyurappa especially after a series of misdeeds committed by him to favour his sons.

The dissident MLAs had moved separate writ petitions before the chief justice of High Court Justice Kehar Singh at the latter’s residence in view of the Dasara holidays declared by the High Court.
               
The High Court chief justice, who heard the lawyers representing the petitioners, directed them to move the vacation Division Bench of the High Court.
              
The writ petitions separately moved by the 11 'disqualified' BJP MLAs and 5 Independents were placed before a Division Bench comprising High Court chief justice, Justice Kehar Singh and Justice Anand.
               
The state government had specially brought in former Attorney General of India Soli Sorabjee, who had also served as the Union law minister, to argue on its behalf. The 'disqualified' MLAs had engaged the services of senior advocates P P Rao and Raghavan.
               
The lawyers representing the petitioners had referred to the decisions of Guwahati and Mumbai High Courts in past incidents of disqualification of MLAs by the speakers of the respective High Courts and the issuance of stay orders, which had been upheld even by the Supreme Court.

    It’s sad that Police did not allow the media n opposition leader to enter the house. Its speakers fault that he gave written permission to Shanker Bidari to enter the house on a piece of paper instead of letter head. Lots of mistakes from the speaker yesterday, he did not give opportunity to opposition for fair trust vote. His main intention was to save BJP govt. that's what he did. He should have allowed BSY and the opposition leader to speak on trust vote.
    Mistakes from Speaker:
    1) He disqualified rebel MLAs before defying party whip.
    2) He disqualified Independents who are not members of any party.
    3) Not allowed Media to enter the house & police misbehaved with them.
    4) Not allowed BSY n Siddarmayya to speak.
    5) Not allowed rebel n Independent to enter the house.
    6) Bought police force inside the house with written permission on a plain paper.
    7) Trust vote process was not done in fair manner. Finished it in 5minutes, no voting no head count.
    8) He adjourned n left the house in hurry to hide his mistakes.
    9) Showed disobedience to Guv by not accepting his dicission.
    10) Hence no confidence motion was passed on speaker by the oposition, deputy speaker should have been in his place.
    Conclusion:He should be sacked immediately.

    You are right Mr. Roshan, really these people are monkeys. People should think before voting them next time. We should appriciate media was showing their act live. They ave court, theycan ask for the justice their. Whether Mr. BSY did right or wron they can apeal to the court. Instead of that, what opposition leaders and rebels did yesterday is unpardonable. JDS should be voted out from the state. They are the main people behind all undemocratic approaches. This was evident inthis drama. Votes should understand this fact and next time they should think before voting them. About congress, central leadership should think about replacing some good leaders in the state congress. So that we will not be ashamed next time.

    Yesterday's house bussiness is null and void as it appears to be.There is no dispute that BJP has 105 MLAs.But the arbitary and partisan decision coupled with Police manhandling opposition party leader and MLAs unprecedented and never heard of in the history of Indian politics that also INSIDE ASSEMBLY HALL.The darkest side of the episode is Men in Kaaki preventing law makers of opposition party entrance to assembly is a grave mistake by Yeddy's govt and Court might take cogniznance of the laps of police force inside with weapon and other matters in deciding the disqualifiacation and house proceedings leagal or illeagal.

    Somebody has commented how Siddaramiaha is behaving with Shankar Bidari.He being a opposition leader can question the police cop to allow him to enter the Assembly hall when he is blocked by the Police cop. Shankar Bidari may be the city police chief but according to the constitutional rights police are not allowed to enter Vidhana Soudha since Vidhana Souda has its own Police men inside the Assembly Hall.Never in the history of Karnataka has the Police entered the assembly hall.It is all because of Govt.supported Speaker and shameful CM for the fear of shortage of MLAs to prove the majority.Today Democracy has died in Karnataka.Best thing is to impose the President Rule in Karnataka.

    Mr. Speaker how can you come to a conclusion on basis of "Voice vote" that Yeddi has won the Trust Vote.There was so much chaos and mess inside the house.

    Conventional practice in Parliament and Assemblies suggest that this is done through Voting Machine and NOT THROUGH voice vote.
    This clearly shows that Speaker Bopiah is biased and after all this farce he ran away.

    Let us wait till 12th to hear from High court. I hope to have justice from court else in future BSY will go on disqualifying MLAs as he wish and at the end only he will be left alone in the assembly.
