Will there be a third floor test probably next week?

Bangalore, Oct 14:  As the countdown for Karnataka Chief Minister B S Yeddyurappa’s second floor test within three days in the State Legislative Assembly has started and both the beleaguered Chief Minister and the Assembly are set to create a record of sorts in the entire country, speculation is ripe in political circles on whether there will be a third floor test – probably next week – after the High Court pronounces its verdict.

As of now, when the Assembly meets for the second time on Thursday at 11 am after Yeddyurappa managed pass the floor test by voice vote after the disqualification of as many as 16 dissident MLAs on Monday, the ruling party is assured of clearing the second trust vote hurdle with flying colours. The ruling BJP already has a strength of 107 members, including the support extended by Kolar Independent MLA Varthur Prakash and the Speaker, in the 224-member House, whose strength has been reduced to  208 following disqualification of the 16 MLAs.

However, the decision of the Division Bench of Karnataka High Court comprising Chief Justice K S Kehar and Mr Justice N Kumar in not granting a stay or passing interim order against the disqualification of 5 Independent MLAs by Assembly  Speaker K G Bopaiah but holding that the outcome of the trust vote in the House on Thursday would be subject to its final verdict, has given room for the possibility of a third floor test in the event of the disqualification is termed not valid.

The High Court is also expected to give its verdict on the disqualification of the 11 disqualified BJP MLAs, probably next week, after resuming the hearing on the writ petitions on October 18 at 2.30 pm.

Meanwhile, the opposition Congress and JD(S) legislators, had reportedly decided to boycott the proceedings on the ground that the Yeddyurappa regime had lost the majority of the House and the Governor had recommended dismissal of the Yeddyurappa ministry and imposition of President’s Rule in the State.

However, the Congress leaders are believed to be toying with the proposal of asking the Speaker to hold the trust vote after the High Court verdict and abstaining from the session on Thursday as the second trust vote is ``irregular and unconstitutional.” The JD(S) leaders are also believed to be toeing the Congress line.  According to informed sources, MLAs belonging to both parties might attend the session but keep off during the floor test.

Accdg to a Prominent news paper there will be a massive operation kamal shortly. Why cant somebody put a stop to this dongy stupid which is the root cause of everything today.where is the time for the government if everyday they indulge into these operatiuons. If BJP indulges into these operations obviously opposition will also do the same and try to pull their MLAS back . On top of this speaker office has become BJPs stronghold and all decisions are taken on bias. Governer changes his mind everyday . A elaborate discussions required before another test.Any future flor test will not give justice as there is a fear in various mlas minds and they are all demoralised and worried about their future and they may vote forcibly whom they do not like.I feel only next election time we can exercise our right and not before. Who knows how many mlas will be victims of kamal operation before election.

It is Starnge that people pass coments here without any knowledge .Similar Incidents have occured in the Past in Various Govternemnts and the Hon Supreme Court has given Judgements the same way What Bopaiah has done in Karnataka .Please read the following
In 2004, the SC had barred four independent MLAs disqualified by Haryana Speaker for switching support to Congress from the Indian National Lok Dal from casting their vote in Rajya Sabha election.
In 2007, in Rajendra Singh Rana vs. Swami Prasad Maurya and Others, the SC held that the act of giving a letter requesting the governor to call on the leader of the other side to form a government would amount to an act of voluntarily giving up membership of the previous party. The case related to 13 BSP MLAs, who supported Mulayam Singh's claim to form a government in UP in 2003

Louis d souza, there is a clear evidence that 11 BJP MLA is against the party the reason they are called rebels and the reason why Speaker disqualified them using the law. Now you guys intention is just to BJP out and put kumara and siddu on ride. what i dont understand from u guys is what are u gona gain doing this? The fundamental problem here is u think BJP is just a religious party, which is a wrong assumption when it comes to ruling the state. you got to clear ur perception and understand what u gain and loose doing so. siting in kuwait with a tax free salary u wont face problem but we do.

The results clearly show that the Yeddyurappa government is a minority government. The 11 BJP MLAs and 5 independents have been disqualified and not allowed to vote by the BJP speaker Bopaiah. If they had been allowed to vote, it is very clear that the BJP government would have been down and out ... Anyway, as Siddaramaiah said this is only the semi-final, the final will be played once the high court verdict is out, and probably an appeal in the Supreme court.

Definitely yes, there will be one more floor test after court verdict. Not only that,as long as Yedyurappa is the CM this will be a regular feature from time to time.BJP high command should think of replacing Yedyurappa with able non corrupt leader.

With 5 independents Oposition will have 206 but BJP already have 207 (Including Verthur)out of 213 excluding rebels. So if the court disqualifys 10 rebels means. BSY will have majority. Any way the truth shall win. "Sathya meva jayathe" I hope court will not disqualify any rebel or independent because there is no evidence that they have gone against party whip.

There will not be any third floor test because for the following reaons
    1. No doubt 11 rebel BJP MLAs will be disqualified by the court too.
    2. Even 5 indipendant MLAs get court verdict in thier favour, total strength will be 224-11=213. To prove majority BJP needs 107 which they already have.

So its BJP for another 2 yrs. For 11 assembly by election, its BJP will get all the seats & for majority it needs only 6 seats.

Jai ho BJP.....HDS & Congress prepare for ANTIMAYATRE.
