Court Begins Hearing on Rebel MLAs' Petitions

Bangalore, Oct 20 (PTI): A new single bench of the Karnataka High Court is on Wednesday October 20 hearing the petitions filed by 11 rebel BJP MLAs challenging their disqualification from the state Assembly.

The case has come up before Justice V G Sabhahith after the court delivered a split verdict two days ago on the petitions.

Chief Justice J S Khehar and Justice N Kumar had differed on the provisions of Para 2 (1) (a) of the 10th Schedule of the Constitution that deals with disqualification of members of a Legislature, after which they referred the matter to a "third judge".

Justice Khehar upheld Speaker K G Bopaiah's order disqualifying the MLAs but Justice Kumar set it aside in their 166-page order.

    One cannot say the judgement wrong or Right .The Higher courts judgements have to be referred to say that This is wrong .There is a Supreme court Judgement that says that writing a Letter to Governer withdrawing support can amount to desqualification and hence what Chief Justice of karnataka has said is theh correct Judgement

    EVEN THOUGH IF HIGH COURT'S VERDICT WILL COME IN FAVOR OF BJP.....BUT THE EXISTING BJP GOVT CAN NOT SURVIVE FOR A LONG TIME. JAI HO.

    It is very sad situation in Karnataka politics that anyone can buy and sell the elected MLAs. May be someone should create a stockmarket for MLAs

    It is the Chief Justice who ruled the disqualifications were in order while the other judge quashed the action taken by the Speaker. CJ is the head of High Court, & it was he who named the third judge, Justice V G Sabhahit. It is logial to presume & wonder whether Justice Sabhahit can go against the judgement given by the CJ. Though it is quite possible & cannot be completely ruled out, I personally don't think Justice Sabhahit will be bold enough to go against the ruling by his immediate boss!

    I hope Justice V G Sabhahith will make justice with people of Katnataka. I am not happy with Justice Khehar's way of thinking. I hope they will give final judgement tody itself.
