Governor Sanctions Yeddyurappa's Prosecution

Bangalore, Jan 21 (PTI): Raising the pitch for a major showdown, Karnataka Governor H R Bhardwaj today accorded sanction to prosecute Chief Minister B S Yeddyurappa on corruption charges in a critical turn in their ongoing battle.

The governor's sanction for prosecuting Yeddyurappa in an appropriate court of law for various "grave" allegations of corruption and criminal misconduct came on a day when both went on an intensified offensive each other.

A Raj Bhavan communique said the sanction was accorded under Section 19 (1) of the Prevention of Corruption Act, 1988 and Section 197 of the Criminal Procedure Code, 1973.

However, the communique did not mention about the petition filed by Lawyers Forum, which had also sought permission to prosecute Home Minister R Ashoka, alleging involvement in land denotification scam.

Amid escalated war of words between him and the government, Bhardwaj advanced his decision by a day on the petition. The governor had said yesterday he would decide in two days.

Yeddyurappa thus became the first chief minister in Karnataka to face prosecution over allegations of corruption and land scams in the state history.

An unfazed Bhardwaj stood his ground brushing aside all accusations hurled at him, including of being an agent of Congress and rejected a state cabinet resolution to "drop" prosecution proceedings.

Angered over the governor's latest outbursts, the BJP also went into a combative mode with Yeddyurappa demanding an unconditional apology from Bhardwaj for making certain remarks against his government.

Hours before giving the prosecution sanction, Bhardwaj sent a hard hitting letter to Yeddyurappa, telling him bluntly that he cannot "put a lid" on serious allegations of corruption and dismissed as "unwarranted" the January 19 cabinet resolution.

"The sum and substance of the Cabinet decision is it simply requires me to put a lid on the serious allegations of corruption against you (chief minister),"  Bhardwaj said.

Amid the brewing political storm, BJP announced state-wide anti-governor protests tomorrow and "Raj Bhavan chalo" on January 25, besides deciding to meet President Pratibha Patil in New Delhi on January 24 to seek the governor's recall.

The cabinet resolution had asked the governor to drop the proceedings to prosecute Yeddyurappa and Ashoka, saying such a move was nothing short of "farce and colourable" exercise on his part.

The governor's characterisation of the cabinet resolution as a "case of a thief admonishing a policeman" further infuriated Yeddyurappa who sought an "unconditional apology" from Bhardwaj, saying he has insulted the people of the state.

"For his remarks, he (Bhardwaj) should tender an unconditional apology. He has insulted the people of the state," Yeddyurappa said.

Soon after the governor made known his decision, the state BJP leaders went into a huddle to plan the next course of action.

BJP earlier unleashed a blistering attack on the governor whom it accused of "behaving like a petty politician" and having "desecrated" the office.

Yeddyurappa shelved plans to hold an emergent Cabinet meeting tomorrow, with a view to adopting a resolution demanding immediate recall of the governor, reportedly on the advice of party central leaders not to precipitate matters.

Expressing his resolve to act, Bhardwaj in his today's letter told Yeddyurappa in clear terms that "the governor is entitled to and required to take an independent decision on the basis of the material available".

 

Governor within his rights to grant sanction: Hegde

Karnataka Lokayukta (anti-corruption watchdog) Santosh Hegde today said Governor H R Bhardwaj was within his rights to grant sanction to prosecute Chief Minister B S Yeddyurappa on corruption charges.

"Legally speaking, the Governor has the power to grant or refuse sanction despite the cabinet's resolution. He is empowered to do so", he told PTI.

"Though the Governor has to go by the advice of the cabinet, there are exceptions where he can act independently and should act independently", he said, citing earlier rulings.

He said the advocates would now have to file a private complaint before a magistrate, mentioning it had received the required permission for sanction and ask the case to be investigated.

    Well Done Governor. You have obeyed Sonia Gandhi's order once again (you have obeyed her order in defrozing Qutrocchi's swis bank account). But you have done it again Mr. Governor. "Our dog at home does not obey my Order even after eating my food". Congress has corrupted all the Institutions now (Governor, CVC, Election Commision, CBI). Its not giving respect to the instition like CAG.

    Governor’s decision is admirable. He has done is best to defend BSY but had no other way but to sanction. Over confident BSY is digging his own grave. His popularity has gone down recent elections are the best example. High command must find someone to replace him. Hats off to Bharadwaj, he has great guts he is not a puppet like other governors’. He should have sacked this govt. long before but still he has a soft corner for yeddy.

    Bhardwaj must think now how common man thinks about these proceedings,as everyone knows & are well aware that he is working on congress directions & helping both congress & JDS in dislodging the government to bring new elections,His motive & the intentions were clear from day one in each & every of his actions.Let the proceedings be over,BJP can also do enough to adjourn the proceedings for years to delay the proceedings,since the matter cannot go to the supreme court unless heard at the state Highcourt.Ultimately common mans tax money is spent on these ego bashes by the central & state governements ,instead of developments.

Mr. Yeddy there is no doubt you have really cheated our 6 cros of Karnataka people.BJP is only looking for making money and grab the asset of our poor peoples land. Really I do not understand why the educated people are still not understand that BJP's MLA/MP's are totally corrupted.     I feel the time has come for BJP central leadership to find a way to change both Yeddyurappa and Bhardwaj inorder to stop the scams and Blackmails. At any cost Bhardwaj should be Kickedout from Karnataka. (But I also would like to add that only Yeddyurappa could able to confront the goondagiri of JD(S) and Blackmail of Bhardwaj).

    level and educated. The CM has
    caused greater damage to himself,
    the party and the State. When
    anybody is too over confident to
    survive for ever, that is a total
    miscalculation. The CM is in that
    state at present.

    When the military leaders of
    Germany advised Hitlar repeatedly
    not to open a new front in
    attacking Russia, he didn't listen
    due to his overconfience and that
    was the beginning of his downfall.
    The CM's overconfidence misled him
    and brought him to this no-return

    The majority of Karnataka have affirmed their support to BJP overwhelmingly in the current/previous elections. The CM yeddy may be corrupt but the BJP party has served the interests of majority unlike the congress party.

    First of all Mr. Yaddyaruppa has degraded women of Karnataka by murdering his own wife. Starting from this accusation probe must be conducted then bribe, election fraud, distributing money in the temples for vote, Land for relatives, throwing tax payers money as per his own whims and fancies all must be probed. I accept Honorable Governors decision to go ahead for prosecution of Mr. Yeddyurappa. Arrest him and put him in Jail without bail. Well done dear Governor.

    I am a BJP supporter. BSY has proved to be corrupt and is embarrassing the party. He may enjoy his time under the sun now, but with the legacy he will leave behind, the BJP will find it impossible to defend him in the next election.
    Advani wanted to boot him out long back, however due to CASTE Politics he managed to retain his seat.
    Infosys is switching it's head quarters from Bangalore to Pune due to Governments Lethargic Attitude.
    Mr.Mohandas Pai, blamed it on "Karnataka’s political indifference and bureaucratic laxity in land allotment and registration.”

    By mere according sanction to proseccute the CM,one should not be under the impression that every thing is over for him.The action of the Governor is full of prejudices like his earlier recommendation to the President where he has to act against his own views cutting a sorry figure.Gov is a know biased action on political lines with Karnataka government from the begining.This time also his action will boomrang on him and his advisors and will be slap on his face.

    It is very simple. If the Raj Bhavan says"the sanction was accorded under Section 19 (1) of the Prevention of Corruption Act, 1988 and Section 197 of the Criminal Procedure Code, 1973" then BJP should cite a Code or make a law to take action against the Governor. Simply threatening with "Raj Bhavan chalo" and other useless marches won't convince the educated public about the "guilt free" image and imagination of the Government. Uneducated and the ordinary people will support BJP or Congress even thousands of accusations are mounted against the party. I am sure Nayak Maaam would agree with this.
