Mangalore: Indian Oil Private Outlet Near KPT Circle Evicted

Mangalore, Mar 31: Mangalore Service Centre, an Indian Oil outlet, located near KPT Circle here was evicted as per the Court order issued by District Magistrate on Thursday March 31.

The service centre was under the jointly ownership of Dulsine D’Souza and Covete D’Souza and functioning since past 30 years. The eviction order was executed by additional commissioner, Prabhulinga Kavalakatti.

However, the owners of the centre allege that the present deputy commissioner Subodh Yadav has passed an order to demolish the centre without any prior notice for the land was taken on lease from the district administration and the renewal of lease can be carried out anytime before  November 27, 2011.

According to Kavalakatti, the owners have taken only 10 cents of land for lease, while were using 42 cents government land in addition with out any permission. The land in excess of 10 cents has been encroached and hence can renew the lease for 10 cents but not the excess land where the pumping equipments are being fitted. The owners' appeal to the high court too stands rejected, he said and added that DC court issued the order for final eviction on Wednesday March 30.

    RR, Mangalore, Supreme Court has given ruling to remove all illegal structures or encroachments coming under public property. HOWEVER RULE OF THE LAW IS THE ENCROACHER SHOULD BE SERVED NOTICE TO REMOVE THE ILLEGAL STRUCTURE OR ENCROACHER TO VACATE WITHIN A STIPULATED TIME OR PERIOD. IF THE NOTICE IS NOT SEVERED AND DEMOLISHING WITHOUT INTIMATION AND THAT IS A JUNGLE LAW. For whomever it may be notice must be served to vacate before forcible demolishing.

    Good work by DC who needs to be congratulated for the bold measures initiated for making Mangalore beautiful and comfotable for Mangaloreans.All encrochers are to be vacated how influential they may be.Issuing or not isssuing a notice for eviction does not matters much as it a illigal action.On the otehr hand they should be made to pay rent to the government for the space they occupied for commercial activity since last thirty years.

    I SUGGEST THE OTHER PETROL PUMP INCLUDING THE OTHER HOTELS NEAR KPT CIRCLE SHOULD ALSO BE EVICTED AND A FLYOVER SHOULD BE CONSTRUCTED AT THAT PLACE LOOKING INTO THE FUTURE SINCE ITS GOING TO BE A MAJOR JUNCTION NH17 CONNECTING WITH THE AIRPORT ROAD.

    In India the law is applicable only to people who do not have clout in political or bureaucratic circles. There are umpteen examples within Mangalore city limits where encroachment is flourishing.
    Probably the people who owned this petrol station did not have clout or might not have paid for the BJP party fund!

    When a person is doing illegal activities must aware the conscious of the effect. Some time it may look good and no one will bother unless it is question or others too follow the same pattern. So if one can break the law and live happily why others can not? Who ever break the law must be punished may be he is an officer, CM, Citizen, or beggar.

    No more mercy for this people,they encroached govt land and they were looting govt property for personal purpose.punish them at the same time look the other side too ,Green park restaurent and Mandara restaurent too encroched government land remove them and make a big circle , bigger than mahaveera cirle that all 4 ways traffic should be easy for vehicles

    The district administration should issue notice to the encroacher to vacate so as to carry out other arrangements to shift within a stipulated period/time (be it a public or private). If not the government is held responsible or the encroacher is responsible for lapse of adhering to notice.

    very good move by the DC. We really aprreciate this work of his... we are with u sir,,, please go and demolish all the temples and road side goodies of gods which have come uo in the recent years on the airport road... these structures are been built on govt land and used without any permission... even god may not like this type of structures ... hope the DC does this job without any problem

    without influential people cannot acquire any governmental property..how did Indian Oil given licence to run petrol pump without looking any documents?..what happened to people who are working in service centre for long?..we really feel bad for them..there future shattered..owner can survive in one or another way....most of establishment/residence are standing by illegal means..that's why corruption is in higher slot..

    christle , Mangalore you are right. under policians against 10 cents leased land 45 cents can be used for 30 years without any permission.

    I suggest government should collect fine from him for using land for last 30 years for excess 35 cents land.

    Very good move by the D.C. people think that govt land anyone can do any thing, govt should charge him for the extra land used for 30 years with a penalty. I think it is more than 30 year's for I remember that pump while i was doing my ITI.
