Bangalore, Oct 20: Following in a spate of public interest litigations and writ petitions which smack of political one-upmanship, a writ petition was submitted to the state High Court on Wednesday October 19, seeking cancellation of former state Chief Minister (CM), H D Kumaraswamy’s Lok Sabha membership. The writ says Kumaraswamy has become ineligible for being a parliamentarian because of his plural marriage.
An advocate named Shashidhar Belagumba, who has filed the writ petition, says that Kumaraswamy had accepted sandalwood star, Radhika, as his second wife, an act which violates provisions of The Hindu Marriage Act. He has sought action against the erring parliamentarian under sections 494 and 495 of Indian Penal Code, besides directions to the secretary of parliamentary affairs department of the union government to invalidate the Lok Sabha membership of the former CM.
“A people’s representative should always lead an ideal life, and be a guide and mentor for the commoners. He should never do anything that misleads the general public. Under The Hindu Marriage Act, entering into second marriage even when the first wife is alive and not divorced is a criminal offence. Kumaraswamy lives with his wife, Anita, and a son. Still, he has accepted Radhika as his second wife,” the petitioner avers.
He has pointed out that in the affidavit furnished by him while contesting parliamentary election from Bangalore rural constituency in 2009, Kumaraswamy had sworn that he had only one wife, although he had married Radhika before 2008. “He had furnished misleading information to the Election Commission. The former CM, who tries to get publicity mileage in the media by claiming to bare corruption scams, has forgotten his own folly. As such, it looks as if a thief has filed complaint of theft with the police. Kumaraswamy’s Lok Sabha membership should be invalidated, and he should be subjected to legal action,” the advocate has said.
The writ petition will come before the single bench of the state High Court chaired by Justice B S Patil, on Thursday October 20.
