New Delhi, Nov 23 (IANS): All the 14 individuals accused in the second generation (2G) spectrum scam Wednesday challenged in the Delhi High Court the CBI special court order to shift the trial to the Tihar jail court complex.
The counsel of all the 14 accused appeared before a division bench of Justice S.K. Kaul and Justice Rajiv Shakdher saying the trial court order regarding shifting of the place of trial was not properly examined and the CBI judge had not taken their consent either.
A special Central Bureau of Investigation (CBI) court had Tuesday shifted the trial to Tihar Jail following a Delhi High Court order. The next hearing is to be held in a courtroom in the prison premises Thursday.
"The exercise of shifting trial to the Tihar court complex is illegal. There is no security threat, so the court may allow us to continue the trial at the Patiala House court complex by allotting some other space in this court premises," defence lawyer Majid Memon said.
To this, the division bench said: "It is an administrative matter and it has been decided by the acting chief justice, so we will cross-check with him at lunch time."
"After checking with the acting chief justice, we will be able to take up the matter," Justice Kaul said.
