Kolkata, Dec 6: Chandrima Bhattacharya, Law Minster for the state of West Bengal today revealed that Chief Minister Mamata Banerjee has written to President Pranab Mukherjee requesting the eviction of Retired Judge Ashok Kumar Ganguly from his post as Chairman of the West Bengal Human Rights Commission (WBHRC). CM Mamta Banerjee had sent her first letter to the President on Thursday as per her statement on her Facebook page.
Today she said that she has reiterated the urgency of her request for the deportation of Shri Ganguly from the WBHRC in a second letter to the President. Her request entails the fact that the three judge panel appointed by the Supreme Court found evidence that pointed at Judge's Ganguly's unwelcome sexual conduct towards a law intern in December last year.
The tribunal had professed that, since both the intern and the Judge were not under the wing of the Supreme Court at the time of the incident, it need not take any further action. However BJP leader Arun Jaitley demanded that the court be involved in meting out of justice regardless of what the panel had said just as it had done in the 2G scam. He felt that the Court could not wash its hands off the affair merely because the Judge was no more on its payroll and that such as action announces the court's lack of conscience.
He went on to add that the Court was bound to take action in its judicial capacity. He expects the court to treat the retired judge just as it would any other ordinary citizen. With the whole nation watching, he opined that the court should take action against anyone holding a high position just like any other citizen for everyone is equal under the law. Law minister Kapil Sibal too seemed to share the sentiment as he said that the matter could not be ignored by the highest court in the country simply because the judge was no longer in office.
Justice A K Ganguly had charges of sexual misconduct levelled against him when a female law intern revealed in a blog that he had called her to his hotel room at the Le Meridien, in Delhi under false pretexts of work and proceeded to sexually assault her on December 24, 2012. The Supreme court had immediately appointed a three judge panel to look into the truth of the charges and the panel had recently revealed that they had indeed found evidence that pointed to the wrongful behaviour of the former Supreme Court Judge.
