Relief for Modi as court upholds SIT closure report


Ahmedabad, Dec 26 (IANS): In a major relief for Gujarat Chief Minister Narendra Modi, a local court Thursday dismissed a petition by a killed Congress leader's widow, challenging the SIT's closure report giving a clean chit to him and 58 others in a case relating to the 2002 communal riots.

Expressing disappointment over the ruling by Metropolitan Magistrate B.J. Ganatra, Zakia Jafri and her supporters, including activist Teesta Setalvad, said they would challenge it before a higher court.

The petition challenging the Supreme Court-appointed Special Investigation Team's closure report, was filed by Jafri, the widow of slain former Congress MP Ehsan Jafri who was among the 69 people killed in the Gulbarg Society massacre here Feb 28, 2002 during the bloody riots in the wake of the Godhra train incident.

In her petition, Jafri had alleged that the SIT had shielded Modi and others by discarding the statements of police officers and other available evidence.

She further accused the SIT of having done incomplete and frivolous investigations and playing the role of a court by adjudging the truth about the available evidence.

Before closing the matter, the SIT had said there was not sufficient evidence to prosecute Modi and the incident alleged (the Gulbarg massacre) was beyond the ambit of its probe.

The investigating agency further said that it could not find any prosecutable evidence against the accused regarding their involvement in the alleged larger riots conspiracy.

The SIT declined to consider Indian Police Service officers R.B. Sreekumar, Sanjiv Bhatt and Rahul Sharma as witnesses or treat their statements as evidence on grounds that these were "hearsay evidence".

In 2006, Jafri had sought to lodge a complaint about the alleged larger conspiratorial role of Modi and 62 others during the 2002 riots.

After the Gujarat Police failed to register her complaint, she petitioned the Gujarat High Court which directed her to a magisterial court. However, she decided to move the Supreme Court.

The apex court had directed the SIT to look into the issue and later directed it to file its report before the concerned magistrate court.

In February last year, the SIT filed its closure report virtually exonerating all the accused, including Modi and others, which was challenged by Jafri through her lawyer Mihir Desai.

    I fully agree with the comment of Purifytheheart.Mangalore.Such a great and massive tragedy and look strange that the Judiciary and the SIT is not in a position to nail the culprit because of lack of clues.It is really a mockery to those who lost their life in this tragedy.Hope the truth cannot hide for a long and it will come out on the right time to expose the mastermind of this incident.Thanq.

    People who have faith in Indian judiciary will respect the court's decision and shut their mouth at least now. There are some believe in the judiciary system of Pakisthan but stay in India will keep barking till 2014.

    Many a criminal has got away simply because of the cleverness of his/her lawyer. This case is no exception.

    Modi, as chief minister should have resigned taking responsibility for the holocaust just as a railway minister offers to resign when there is a train accident. But
    no. Instead he clutches to the SIT report and s he is innocent. If this man becomes the Prime Minister of India we will have someone who shirks moral responsibility - indeed something that does not augur well for the country.

    When the court itself is saying that Modi has nothing to do with the riots and that there is no evidence against him. It is not a district sessions court that has given him a clean chit. It is from the Supreme court appointed SIT. I don't know why people would not believe the Supreme court of India and yet believe the words of some corrupt ministers and NGO's.
    Regarding moral responsibility the same can be applied to Manmohan Singh for the 2G case, Sheila for CWG case, Chouhan for Adarsh Scam, Anthony for Westland scam etc. The first person who should resign is Sonia as she should take moral responsibility for her party for getting into such scams.
    You have said that because of a efficient lawyer Modi got a clean chit. I completely disagree.
    Modi was fighting against the whole central government, CBI, NGO's Media who all wanted to nail him.Yet he emerged victorious.Then all I can say is that if there was ample proof and yet Modi got away then the Congress Government, CBI, Media and NGO's are all very incompetent, but that is not the case.There is no case in the first place. Modi did all he can contain the violence, called Army within a day, called for police help from nearby states ( Congress states did not send their police force), his first instruction was to see that a group of Hajjis that were returning from Mecca after the holy pilgrimage were safely escorted to their homes.

    The Indian supreme court is respected all over the world as one of the finest courts in the world for fair judgments. The same supreme court has been taking action against the central government in cases like 2G scam etc, do you think it will spare Modi if he was indeed a culprit. NO

    I was merely pointing out to the moral responsibility which has nothing to do with the court judgement. Whoever is at the helm of affairs takes the responsibility but in this case it did not happen.And as for the Indian law, there are countless cases where
    the innocent have gone to the gallows and vice versa.

    One can claim maybe 1-2 investigations or agencies probing Modi were sabotaged. But one cannot claim that ALL of them were. No politician has had much scrutiny as Modi. Almost a dozen agencies have investigated him and no one has been able to find any evidence against him after 12 years. He keeps getting a clean chit after clean chit. The only logical conclusion is that he was indeed innocent of any complicity in the riots.

They went to the extent of playing with Zaria Jafris emotions by making her stand in election also against Modi even though they knew she would be defeated. This is how congress plays around with Muslims. They are not interested in their welfare, they only want to use them against BJP to play politics.
