Name whistleblower in CBI chief case: SC to Prashant Bhushan


New Delhi, Sep 15 (PTI): The Supreme Court today directed advocate Prashant Bhushan, who has levelled allegations against CBI Director Ranjit Sinha of protecting accused in the 2G case, to reveal the name of the whistleblower from whom he got CBI documents and guest list at the top cop's residence.

A bench headed by Justice H L Dattu asked Bhushan to name the whistleblower in the sealed envelope on the next date of hearing and said that it will go into the merits of allegations after knowing the source of information, as it may have ramification on the reputation of the director and also affect the ongoing trial in the 2G scam.

It said that the affidavit filed by Bhushan is not in consonance with the Supreme Court rules and asked him to reveal the source from whom he got all the documents.

The director questioned the very existence of the diary before the apex court and said that 90 per cent of the entries were fudged though some entries may be genuine. Advocate Vikash Singh, appearing for the top cop, submitted that somebody else is controlling the proceedings in the case and raised questions on how a media group published a story in advance that Bhushan will be depositing the original guest list before the apex court.

He alleged that a corporate house is working behind all these controversies and it is intended to benefit the accused in the 2G scam. The bench also wanted to know the stand of CBI in the controversy but the senior advocate K K Venugopal, appearing for the agency, refused to get into it, saying that it is a matter between advocate Prashant Bhushan and the director.

It then directed its registry to keep all documents and affidavits filed by the CBI director in a sealed cover and deposit them with the Secretary General for safe custody. The apex court posted the matter for further hearing on September 22.

    If a Whistleblower got that much courage to furnish the dairy copy to SC Lawyer Prashant Bhushan then he must have courage to face the consequences too….. No doubt his/her safety at risk….but they must have thought so regarding the risky job they are doing….I believe this particular Whistleblower came forward with different agenda rather than National Interest….. Anyhow as long as SC keeps their identity as top secret, Whistleblower’s safety is not at risk but what is the guarantee that SC documents will not be leaked to any Media one day!!!!

    while on one side, SC says, Motive/person/agenda is not important, it asks to name the whistleblower, so as to risk him and no one comes out in future!

    what about whistle-blower protection? if the whistle-blower is named he can be threatened by the powerful CBI and the political masters. this could have an impact on future whistle-blowers as well. i don't agree with the SC on this. what is important is the disclosure made and not who makes it. it is now on the CBI boss to prove his innocence, but unitl then he should vacate his post. Prashant Bhushan of the AAP is doing a great serive to the nation

    SC asked Adv. Prashant Bhushan to name the whistle blower. It is the NGO .It is not a secret. It is unethical to name the person who gave him the diary because he was a source & divulge the name of the source would endanger his life & no one would come forward to save his life not even the temple of justice the S.C.

    Indian Judiciary has a track record of not protecting any whistle blower. They should be interested in the message not the messenger. Is the Supreme Court wanting to protect someone?

    What sort of directive is this from the Supreme Court? I totally disagree with the SC on this. So many scams have come to light due to the efforts of whistle-blowers. Equally, so many of them have lost their lives. How can one trust the powerful CBI, the bureaucrats or their political masters (not to mention corporate houses) to allow justice to prevail? Will anyone come forward with vital information if the SC gives such directives? Firstly, look at the message and don't shoot the messenger. Secondly, don't kill the goose which lays golden eggs. We need whistle-blowers in the future too.
