Cheque bounce - court issues non-bailable warrant against Sriramulu

Daijiworld Media Network - Bengaluru (SP)

Bengaluru, Mar 5: In connection with a cheque bounce case, the 13th additional chief metropolitan magistrate's court here has issued non-bailable arrest warrant against Ballari MP, Sriramulu.

Hearing of the cheque bounce case had been scheduled for Friday March 4. Presiding officer of the court, C J Vishalakshi, observing that Sriramulu had absented from hearing without advance notice, conducted the hearing and ordered the police to present the accused personally in the court on March 22.

A person named L Somashekhar from Mysuru had filed this case. He had alleged that Sriramulu had collected Rs 2.96 crore from him, duly promising to field him as a BJP candidate from either Ballari or Raichur constituency in the Lok Sabha election held in 2014.

He saccused Sriramulu of neither paying back his money nor getting him party ticket. "When I insisted on repayment of money he issued cheques. But on presentation, these cheques were returned for want of funds," Somashekhar has alleged, when approaching the court on June 19 last year with his complaint.

Your question is - How a person gets your cheques without your knowledge?

Answer is, anything is possible in India, it has happened to several people in DK.

Don't get us wrong, we are not defending Mr. Sriramulu here, but there are such cases, and we fully agree with Dr S Kamath's comment.

Cheque Bounce case comes under Criminal act through the section 138 of negotiable instrument act .Previously once the cheque has bounced ,notice issued to the party ,Party doesn't respond within 15 days ,then grace period of another 15 days if still he doesn't respond then case is filed .Summons issued to the party who has given the cheque .Now if summons also not received by the party then No arrest warrant could be issued by the Hon Court .
But the worst thing that was done by UPA govt is that Arrest warrant can be issued even without Summons not received by the Party .I think this clause might be ok for other criminal offenses but for Cheque bounce case this should not be the case .
For a person like Sri Ramalu Rs 2.96 Crore may not be a big amount and hence I feel there is something cooking here .On the other hand why this complainant gave that much money for a ticket ?Any way Law Shall take its own course

Keep your thoughts to yourself and never try to defend criminals. Its the intent to pay is important rather than the amount. We should be ashamed of such MPS.

How a person gets your cheques without your knowledge?. You seems to be confused doctor. Court will not issue warrant at first default of your absence and Ranulu is not aam aadmi, but an MP.
