Non-bailable warrant issued against Vijay Mallya in cheating case


Hyderabad, Mar 13 (IANS): A city court here has issued non-bailable warrants against now defunct Kingfisher Airlines chairman Vijay Mallya and chief financial officer A.Raghunath in an alleged cheating case.

The 14th Additional Chief Metropolitan Magistrate G.S. Ramesh Kumar directed police to produce Mallya in court by April 13.

The liquor baron is currently in Britain.

The court issued the NBW on a petition filed by GMR Hyderabad International Airport Ltd. seeking prosecution of Mallya for defaulting on payments and cheating the company by issuing cheques that bounced.

The airport officials had filed 11 cases against Kingfisher for non-payment of dues to the tune of Rs.8 crore.

Cheques issued for Rs.50 lakh had bounced and a case in this connection was filed against him under provisions of the Negotiable Instruments Act.

The court had issued warrants against Mallya, the CFO and the company's authorised signatory, asking them to appear before it on March 10. However, none of them appeared.

When the matter came up for hearing on Saturday, Mallya's lawyer pleaded for exemption from appearence for some more time.

The GMR lawyer opposed the plea on the ground that it is not a routine case.

The lawyer also brought to notice of the court that there are indications that Mallya had left the country despite a lookout notice being issued. He cited a statement made by the attorney general in the Supreme Court a day earlier about Mallya's flight from the country.

Business tycoon Vijay Mallya said in comments published on Sunday that he was not on the run but was also in no hurry to return to India.

Mallya told the Sunday Guardian in an email interview that he had done no wrong and that he was being victimised.

Asked whether his departure from India on March 2 was related to his failure to pay back loans, he said he left on a personal visit along with a friend.

"It wasn’t a business visit. Lots of people have written that I was carrying seven luggage bags... For two people, I don’t think that’s too much. I pack heavy. That’s how I travel."

He said it was wrong to say he “escaped”.

"Why am I being portrayed as a criminal? Loan defaults are a business matter. When the banks give out loans, they know the risk involved. They decide, we don’t.

"Our own business was flourishing, but plummeted suddenly. Don’t make me the villain. I have the best intentions. I’m quiet because I fear my words will be twisted like of others."

Mallya said it was "a matter of interpretation" why he left India just before the banks who had given him loans moved court.

"It’s not the first time I’ve flown out from the country. I’ve not done anything wrong. I don’t need anyone to tip me off about anything."

The Rajya Sabha member said he did want to return to India.

"But I'm not sure I'll get a fair chance to present my side. I've already been branded a criminal. I do not feel the time is right.

"I feel passions are high. People need to think rationally. They need to understand that business, whether large or small, has risks involved.

"I've seen the highest to the lowest points in this matter. But I hope that I return one day. India has given me everything. It made me Vijay Mallya."

Accusing the media of spreading "lies" about him, he said: "It’s a big agenda that some people are pushing against me. I am being victimised. And if people are doubting the integrity of bank employees, then why point the finger at me?

"I’ve never hidden any aspect about my life. I’m one of the most open people. I’m forced to go into hiding, and that makes me sick."

Mallya was asked where he was living now.

"I do not think it is wise for me to reveal my whereabouts. I’m no hardened criminal who the authorities need to hunt. For now, I want to feel safe."

    What does that mean?
    How come the Magistrate is not aware that Mallya has already landed in UK?
    Some people blame each other and some complete the formalities (legal point of view) for name sake to be on safer side.

    I understand that Mr. Vijay Mallya left India on 2nd March using a 'diplomat's passport' as a Rajya sabha member, Now ,since Govt. of India has cancelled his passport he has no option but to return to India to face ED on 18 March.

    India does not have extradition agreement with England, He is a resident of England & other western countries. He has strong family & business ties to Europe & North America. Developed countries Business Loan is civil case and not a criminal case and the lawyers will make Indian Banks are in fault in granting loan without verified security. Mallya will qualify for travel documents from many countries in the world. Personally Mallya is a good, generous Gentleman. Good Luck to India

    Mallaya's doctorate is from Southern California University for Professional Studies, US of A (may be you can confirm this). The other two from Mangalore university. All three unlike Kahnaiya Kumar (when/if he completes), are honorary doctorates.
