CJI's claim on need of 40,000 judges not based on scientific research-DVS


New Delhi, May 25 (PTI) : The government today said the report cited by the Chief Justice of India to claim that the country needed 40,000 judges was not based on any scientific research but maintained it has hastened efforts to fill up vacancies in Supreme Court and the high courts.

Addressing a press conference to mark two years of the Narendra Modi government, Gowda said the adequacy of bench strength in a country is determined on the basis of workload on the courts and not judge-population ratio.

Virtually breaking down in the presence of the Prime Minister here on April 24, CJI T S Thakur had lamented the government's "inaction" in increasing the number of judges from the present 21,000 to 40,000 to handle the "avalanche" of litigations, saying, "you cannot shift the entire burden on the judiciary".

"Nothing has moved" since 1987 when the Law Commission had recommended increase in the number of judges from then 10 judges per 10 lakh people to 50, an unusually emotional Thakur had said.

Responding to a question on whether the government will ever be able to reach the target of 40,000 judges (judges in the lower courts as well as judges of the Supreme Court and the 24 High Courts), Gowda said the Law Commission report given in 1987 was based on the opinion of some experts and the public.

"In the report itself they said that this has to be calculated on the basis of scientific data. But no scientific data was available.

"Even recently in the Imtiaz Ahmed case, the Supreme Court itself has asked the Law Commission to once again look into the matter. They once again said that this may not be possible unless we get the scientific data," Gowda said.

    "Scientific Research"...really Mr. Gowda? Do you know what that means? Sorry for you, but the judge used simple math to arrive at the figure? Why don't you ask our premier scientist and Bharatha Ratna CNR Rao to conduct a scientific research to arrive at the number?
    Mr. Gowda's criticism is because Courts intervene when politicians and babus use the power for their benefit. That is the grouse, I am sure that is responsible for need of scientific research.

    2 years passed in finding scientific research Mr. Gowda. Our PM visited more than 33 countries as part of this research.Will your research complete in next 30 years ???
    CUTTING SHORT OF COURT LEAVE AND INCREASING FUNCTION TIMINGS CAN SOLVE PENDING CASE ISSUES.ALL THE COURTS MUST WORK FROM 8 AM TO 8 PM EVERYDAY INCLUDING SUNDAY.LET IT BE DOUBLE SHIFT OR TRIPLE.

    No research needed to implement this,,,, just need some common-sense. I believe you have that enough.

    Let the Government make Scientific study and appoint judges accordingly.In Gulf countries judgement is delivered in 3 months.Justice delayed is justice denied.

    Dear DVS, U talk of scientific basis. As a minister of concerned Dept is it not ur duty to provide one? When parliamentarians increase their emoluments & benefits, kindly let us know which scientific basis was followed?

    Does Mr. Gowda know what he is talking about. Scientific research is based on principles which is very close to reality. Who made him the law minister. Of course probably in this post there is no hafta. What development he has done after changing his profile from Railway minister to law minister. You need brains to think..... guys.

    The report may not be accurate but the Minister need to confess that there are vacancies for judges and he has to promise to do the real postings soon before judiciary go out of control

    I think the justice minister does not need to worry about statistics and scientists. He just needs to see the ground reality : Millions of cases pending forever and how to quickly solve the problem whatever the "scientific" solution is since he thinks CJI is stupid and does not know what he is talking about.

    We need to look in to this two angles - first fill pending vacancies and later appointing more judges on availability scientific data. it appears, since 1987 nothing is moved. At-least please take quick action to clear the pending cases. " Justice delayed is denied " which is not good for any one. I am expecting S.C., H.C. and district court vacancies can be filled on emergency basis.

    Most of the cases are of corrupt officials or against MP/MLA's.
    And all governments (Congi or BJP) want to save their chelas.

    Government can increase the court fees for each cases filed and generate more funds to pay salary of the judges.

    And is there any scientific data on how a case on salman khan was thrown to dust bin by a higher court while lower court spent nearly 10 years to hear argue give verdict. Why SC didn't surprised by the higher court act. Can any one believe these courts.

    Judges should work more hours in a day like in other countries...currently they work 11 AM-5PM, total six hours a day...They should have only 2 weeks holiday's per year, currently they have 4-6 Weeks...

    Judiciary must have a web site, which gives details...how many cases they heard...how many postponements were granted...how many judgement they delivered...so people can evaluate their performance with their peers...

    Just asking for 100,000 judges is a joke...who is going to pay for it? Tax payer?? Why???

    20-40-60-90-180-375-750 thousand judges more,,, what difference it makes?

    We don't need any more additional judges at all...all vacancies must be filled...and judges should work hard...that's it.

    Also there should be just one appeal...not dozens like we currently have...

    Are you a 'Gumasta' of any of these hardly working judge???

    Also, quality judges have to be selected. The present process of ion has lot of weakness and the result is quality people are not getting selected. Some Judges struggle to write judgement or will end up writing judgement which consists of issues/uncertainties. Because of this lot of appeals come up.
