Bangalore, Apr 1: In a breakthrough verdict, the High Court (HC) here ruled that watching obscene films privately is not an offence.
According to Indian Pinal Code (IPC) 292, producing obscene movies and selling them is an offence. But watching them privately will not amount to offence, clarified Justice K Bhaktavatsala on Monday, March 31.
The judgement comes after city cops had arrested three students when they were watching porn films privately. However, the court has dismissed the case and delivered its verdict.
Deepankar Chowdhury, Subajith Roy and Preethan Das, students of Acharya Polytechnic Engineering College were arrested by Peenya police on November 30, 2005, on the ground that they were watching blue films on a computer belonging to Deepankar Chowdhury. Police had seized the computer and 3 CDs of blue films booked them under IPC Code 292. Later they were produced before the 7th additional chief metropolitan magistrate court.
The students moved HC challenging the ACMM court’s judgement. The HC dismissed the case awarding the judgement in their favour.
