People with reason can't be denied right to deposit old notes: SC to Centre


New Delhi, Jul 4 (PTI): The Supreme Court on Tuesday observed that citizens with valid reasons- such as imprisonment- could not be deprived of an opportunity to exchange old notes, giving the Centre and Reserve Bank of India (RBI) two weeks to come up with a solution.

It asked the government to consider creating a window for people with such legitimate reasons to deposit scrapped notes.

A bench comprising Chief Justice J S Khehar and Justice D Y Chandrachud asked Solicitor General Ranjit Kumar, representing the Centre, to take instructions on the issue.

"There can be a situation where a person has lost his/her money for no fault. Suppose a person was in jail during the period... We want to know as to why you chose to bar such persons," the bench said.

The solicitor general then sought time to seek instructions for granting an opportunity to persons to deposit their money on a case-by-case basis.

The bench was hearing a batch of petitions, including one filed by Sudha Mishra seeking a direction to authorities to allow her to deposit demonetised notes as she could not do so during the period specified by the Centre and the RBI.

The Central government had on November 8 last year announced that Rs 500 and Rs 1,000 notes would no longer be legal tender from November 9.

The government also assured the people that demonetised currency notes could be exchanged at banks, post offices and RBI branches till December 30, 2016. If people were unable to deposit them by that day, they could do so till March 31,
2017 at RBI branches after complying with certain formalities.

    Who are the people and what is the so called VALID reason ? Government has given enough time to everyone. SCOTT should not interfere and dilute the very purpose of demonitisation in the name of citizen right. Right is for those who respect duty also.

    The govt has already assured that if there is a valid reason, they could deposit. But t wont be a blanket move. It will case by case.

    The word 'valid' is an adjective. It is not quantitative.
    The reason might be valid for the person who puts forward but it might be invalid for the authorities.

    So every 'reason' should go to the courts for checking whether it is valid or not!!

    They should allow, there should be equal opportunity to all citizens. NRI's are deprived from this facility by saying before, NRS's can deposit old notes till 31/03/2017. Then it was told only in RBI branches that too limited. Even Residents may not deposited their notes should be allowed to do so with a valid reason.

    Flavian, Mangalore/Kuwait-Not necessarily all imprisoned are Criminals. Thousands of INNOCENTS also languishing in jail in India for so many years. Just take the example of Malegoan bomb blast. Many Muslim youth were declared INNOCENT after spending 8-10 years in jail.
