Bengaluru: High Court dismisses PIL against BJP’s ‘Mangaluru Chalo’ rally

Bengaluru, Sep 7: The High Court (HC) of Karnataka on Wednesday September 7, dismissed a Public Interest Litigation (PIL) seeking directions to restrain BJP Yuva Morcha from holding the ‘Mangaluru Chalo’ bike rally in Mangaluru city or anywhere in Dakshina Kannada (DK) district.

A division bench comprising Chief Justice S K Mukherjee and Justice P S Dinesh Kumar said they cannot do anything about the PIL and dismissed it for being devoid of merit.

The bench said, “As maintaining law and order is the domain of the state government, the court cannot interfere,”

The petitioner’s advocate contended that due such gatherings and rallies, DK district had to suffer for nearly 85 days with schools, colleges and business activities coming to a standstill.

“It shows the complete failure of administration. But the court cannot transgress into the territory of the government and issue directions or prohibitory orders,” said the division bench.

The PIL was filed by Suhail Khan and others from Dakshina Kannada district who stated that they witnessed communal violence in the name of rallies held by various religious and political groups.

They sought directions to the Home department not to allow BJP Yuva Morcha to conduct a rally on vehicles, hold a gathering and use loud speakers within Mangaluru or other parts of DK district and to maintain peace.

    The protesters are doing something on public interest to alert the government against unto incidences in and around DK. Why should district administration prohibit their rights? District administration should have permitted to conduct the rally peacefully with strict vigilance on participants. In many cases during religious l rallies why the district administration allowed outside participants?

    In our State even an Organization’s members are involved in murder case is allowed to public gathering but not a National Party is allowed to hold rally??? That also for genuine cause to condemn the killings of Hindus by radicals??? This is the slap on State Govt and those PIL seekers for their biased attitude!!!

    Many a times court has interfered in some issues and given directions to the state Govt. to act accordingly. but why now this different version when the matter seems to be serious as narrated in the PIL.

    Do you think RSS/BJP are saints. They involved in lynchings, murders, making and planting bombs, anti-national activities and many more. I think you closed your one eye for looking at their infamous activities.
    State govt knows what is happening after hate speech rallies by anti-national party/groups.

    It is separation of constitutional power. Constitution has given power to State Administration to control and or to stop rally by using police or other legal methods to provide peace & security to Citizens of the state.
