Bengaluru, Jul 31: "Families which have reaped the benefit of reservation should allow the facility to be utilized by families which have been deprived of social justice. Otherwise, the concept of doing justice to the downtrodden, which is the aspiration of the constitution, gets defeated," felt retired Karnataka Lokayukta, Justice N Santosh Hegde.

He was speaking after releasing the work, 'Balitha Dalithara Thulitha, Nanna Jana Anaatha', authored by social campaigner, Dr Chi Na Ramu, at a function organized at Bharatiya Vidyabhavan here on Monday July 30.

"The concept of reservation was implemented through the constitution with the aim of providing social, educational, and economic facilities to people who were deprived since hundreds of years. But the families which have availed of reservation facility once should give up the facility for other families. But availing of these facilities repeatedly by the same families go against the intention of the constitution," he stated.

"When Ambedkar placed the proposal for extending reservation facility, he had said that it would be enough if this facility is given for ten years. He felt that within the first ten years, all the Dalit families would be able to avail the facilities. But if we examine this against the current situation, a question as to whether the reservation facility is created to benefit those who are financially sound," he added.

Justice Hegde said that it has been 67 years since the republic system came into being but benefit of social justice continues to be elusive for lacs of Dalit families. "This supports the notion that the very purpose of reservation has been lost. The inequalities can be removed only when every family gets benefit of the reservation facility," he felt.

Speaking on the occasion, Dr Chi Na Ramu, noted that Congress leader, Mallikarjun Kharge, has become MLA nine times, and MP twice by availing of benefit of reservation. "He represented reserved constituency for 50 years and again made his son an MLA by using the same facility. Do you think Kharge, who is financially well off, is in need of reservation?" he quipped. At the same time, he said that when the question of Dalit chief minister comes, party leaders seek this post on the basis of seniority, and felt that the Dalits who have become strong in all aspects, have become stumbling blocks for the proper implementation of reservation facility.

Retired Supreme Court judge, Justice V Gopal Gowda, retired judge, K Sridhar Rao, former union minister, Sanjay Paswan, Neerakallu Shivakumar, and others were present.

    Yes .... there are families from generation to generation and all the family members I husband.. wife .. children. Grand choldren geat grand children's...are having government jobs... . I have seen it.. looks very bad...... that system should be removed..

    There are thought of instances where subordinate become boss due to reservation in promotions.it is a biggest demotivater in India.
    Probably, because of reservation India is still a developing country and will remain so for ever till the menace of reservation continues.

    Good opinion by justice Hegde, our people need education about democracy system.people should not vote for short term benefits, people should not take bribe to vote,then only good leaders will enter to politics. Good leadership will make difference to build our nation.

    Why only education?
    There are many parameters in every sphere of our life where we come across "Reservations"

    Do away with it. If there is a will ,then parliament can enact a law by taking all parties into confidence.

    The big question? is will that happen in Indian Parliament and Judicial system.

    I guess the Britisher's rule was better off than our independent democratic India today.

    It's a mere shame for all of us(educated Indians) in 21st century where a merit holder cannot be recognised or withstand....be it in any spheres of life.

    Hegde Sir, your educational institutions speak in volumes for the service to the mankind in D.K

    Reservation to gain greater access to education and add opportunities to compete. Now a days, teachers are appointed on reservation basis. What type of education can we expect in India. Some of these teachers who simply don't know to teach are being paid Rs.50,000/month. Does this policy improve education standard in India. It is ridiculous and absolutely foolish to employ teachers on reservation policy.

    Exactly ! Some families have got education for free out of reservation, have reached top posts in Government Dept., yet educate their children out of reservation quota and are lining up for quota jobs.

    What a shame ! Please put a stop to this so that common people who are more poor than these lower caste, can avail services of education and jobs.

    ..100% agree..atleast some one who was from higher judiciary spoke about it(forget about so called intellects)...every one including SC/ST community suffered from this since if one got job, he will make sure his son daughter gets job..this chain system prevents others from same community getting job..read history..Ambedkar didnt believed in reservation system..he reluctantly agreed for reservation in belief that it will be discontinued 10 years after adaptation of constitution..but where this reservation reached..Patels Maratas also in street, thats what Ambedkar saw coming..

    His views and thoughts are perfectly correct.
    Is there a need if a family gets reservation once in lifetime and what is the need to be repeatedly continuing for the next generations whosoever it may be.
    In the name of reservations we are making people lazy and the quality suffers be it in education, jobs or anything else.

    Why will one put efforts or hardship to come up in life if government is providing guaranteed reservations for generations!!!

    This is injustice to mankind to attain quality or merit and social inequality for the downtrodden.

    Three cheers to Justice Hegde for being bold enough to speak something that is unpalatable to vote hungry politicians. I totally endorse his statement. It appears that the reservation guaranteed by the Constitution for ten years has not benefited all members of the Dalit community, and even if it is extended to another five hundred years, there will not be economic, cultural and racial equality. The dalits who have received the benefits for ten years are taking undue advantage of the same even after they get the reserved positions, in terms of seniority, etc., and passing their rights to other members of their family in perpetuity.
    I hav spoken many times against the perpetuation of reservation and on the 70th anniversary of the reservation, when a new government is elected - whether it is saffron or green or blue - Parliament should completely abolish it and the only criterion should thereafter be economic backwardness. Otherwise, there is no hope in hell for other citizens.
