Kerala nun rape case: Relief for Bishop Mulakkal


Kochi, Sep 13 (IANS): Bishop Franco Mulakkal, who has been named in a sexual abuse case by a nun, got a breather from the Kerala High Court on Thursday as it said "arrest is not the issue".

Expressing satisfaction in the ongoing probe, the court observed that since it was an old case, the probe and the investigation will take time and "not the arrest but final punishment of the accused is more important".

Apart from hearing two petitions on the case, it also heard a third petition seeking a Central Bureau Investigation (CBI) probe into it, and said that at present that would not be granted and posted the matter for next hearing on September 24.

Bishop Franco Mulakkal of the Roman Catholic Diocese in Jalandhar has been served a notice to appear before the probe team on September 19.

The nuns supporting the victim expressed their disappointment with the court's observation.

"We now feel that the probe might be swept under the carpet. Even the court is also denying us justice," said a nun after hearing the court's observations on Thursday.

A Division Bench headed by the Chief Justice Hrishikesh Roy after going through the affidavit of the Kerala Police probe team said that it was not proper to put pressure on the police as it could create hindrance to a free probe.

A Kerala nun has accused Mulakkal of repeatedly sexually abusing her between 2014 and 2016. There are five other nuns of the same congregation who has supported her claim.

On Thursday, Kottayam Superintendent of Police Harishankar who is leading the probe told the media that variations and contradictions have been found in the statements that have been taken from several people connected with the case.

"I would not say that this has been done on purpose. However, taking into account that the case is four years old, it might be difficult to recall things correctly.

"There are discrepancies in documents and facts that have now come up and hence we have expanded the probe team," said Harishankar.

An FIR was registered against the bishop and a 114-page detailed statement was taken from the nun and other inmates of the convent.

However, Mulakkal has denied any wrongdoing and termed it a conspiracy hatched against him.

    Either Bishop or the Nun is lying ...!!!!? If the rape is true, how it can happen for 2 years..???? and why complaint is so late...???? Repeated sex (unless locked in a room) is not rape, but consensual sex. Religious leaders shall not do this kind of drama.

    Nun supporters, stop accusing anyone including the Court. First check with the nun what is she upto. Any rape case is immediately lodged in the police station. What this nun was doing all this time and woke up when she was transferred. Remember, we are not supporting anyone. Allow the court to investigate in this matter including the nun.

    I am not justifying Nun
    But law allows the victim to file complaint any time after the rape not necessary that immediately complaint should be made
    Criminal jurisprudence doesn't have the time limit
    Crime is a crime
    Let courts decide we shall not be judgemental

    Now that the High Court after examining the status of investigations quite clearly was of the considered view that" Arrest is not the Issue" while the purpose of the trial by the media initiated by the four nuns was to have the Bishop arrested an any cost. These nuns have been disowned by their congregation i.e Missionaries of Christ. If the Bishop harboured any sense of guilt, he would have applied for anticipatory Bail which he has still not done in spite of the media and the four Nuns craving for his arrest.

    Alleging Rape after four years and expecting our Judicial system to pronounce a Guilt verdict is unthinkable may be in Kangaroo Courts and not is our Courts and certainly not by the Kerala Police with Kerala having 100 % litracey. The nun could have filed the case in UP or Bihar and could have got the Bishop arrested by their Police.

    This whole case smacks of a deep rooted conspiracy to undermine the Church in Kerala. The petition in the court for a CBI inquiry for a four year old case alleging Rape is a clear indication of using the caged parrot to settle scores with Kerala and also its Church .

    A a reader above has suggested a Lie Detector test for the Nun will solve the case and unearth this deep rooted conspiracy

    As I have said before...

    What is really needed in this case is subjecting the nun to a lie detector test.

    Other than that, it is a huge waste of taxpayers' money and resources. All because the nun did not want the transfer ordered by the bishop.
