Nun rape case: Bishop moves Kerala HC for anticipatory bail


Kochi, Sep 18 (IANS): The Kerala High Court on Tuesday agreed to hear an anticipatory bail plea from Bishop Franco Mulakkal, accused of raping a nun, and posted the matter for hearing on September 25.

The court also asked the state government to file an affidavit.

The bishop of the Roman Catholic Diocese in Jalandhar filed the petition earlier on Tuesday before Justice V. Raja Vijayaraghavan.

The bail plea came ahead of Mulakkal's appearance before a Kerala Police probe team on Wednesday.

Mulakkal has asked the court to see that he was not arrested till the anticipatory bail plea was disposed. He reiterated that the complaint against him was false, concocted and meant to harass him.

A Kerala nun has accused Mulakkal of repeatedly sexually abusing her between 2014 and 2016.

An FIR was registered against the bishop and a 114-page detailed statement was taken from the nun and other inmates of the convent.

Mulakkal was questioned by the police in August at his Jalandhar office.

Meanwhile, an indefinite protest against the bishop entered its 11th day on Tuesday.

"We have faith in the judiciary. Tomorrow the bishop has to appear before the police. We will wait for what happens," said one of the five porotesting nuns.

    For those who do not know what Superior General means:

    It is the CEO/Managing Director of the entire congregation, spread over multiple states. That is the highest rank.

    Now imagine, after being a CEO for six years, a junior is elected as the new CEO/Managing Director and the previous one - as a common nun - as to obey the new one!

    That is not all that bad for older congregations, as there are several individuals who have moved up and down the ranks.

    But this is a brand new congregation, and the nun was the Superior General for the first six years (i.e. two terms). And she wanted to be the Superior General for a third term as well.

    And the poor bishop, called in to mediate between the two warring factions, had to take a side!

    He followed the rules, and sided with the then Superior General. As per the rules, the others have to OBEY whoever is their Superior General. Otherwise, the system breaks down entirely.

    The bishop, to put the congregation back to some semblance of normalcy, ordered the nun in question to be transferred.

    There is no need to politicize this. Let the investigation take place. It is wrong for a man (more so a priest), to misuse his position, as much as it is wrong to falsely accuse and spoil ones reputation. Let the truth prevail.

    Why so much sympathy on the nun, who had determined for two years not to disclose the matter. All should understand that one hand cannot clap.
    It clearly shows that the nun too was a partner in crime. She is not that innocent or ignorant of the matter.

    In an interview given by the bishop to Republic World, the bishop states that she was the Superior General of the congregation.

    Initially appointed to be the Mother General for 3 years as the congration was new.
    After those 3 years, an election was held for the very first time. And the same nun was elected - to continue as the Superior General for the subsequent three years.

    In the second election, although she was a candidate, she lost the election.

    With the loss of election, according to the bishop, that nun and her supporters formed a group to oppose the newly elected Superior General.

    And then there was the case of the nun's cousin complaining about the nun's illicit relationship with her husband to the new (opposite camp) Superior General. The "power struggle" between the two camps spilled over, and the bishop's help was sought.

    So, there is much more to the story than what is pushed by the media.

    Let us see how the police and courts deal with the complex matter.

    Whatever you are saying is slander and heresay. You should not denigrate a person when the matter is in the court.

    Rember Mary Magdalene on the new testament. How did Jesus treat her ?
    In front of the law we are equals - no one is morally higher( bishop) or lower(nun).

    Justice system - needs to be respected . So do not engage in slander. Respect both the parties. Let them get Justice.
    As the sermon on the mount by Jesus : " blessed are those who face persecution" let the bishop endure the trial and if he is innocent be a true witness to Christ.

    If he has not raped the nun, all the time he has been saying, why is he seeking anticipatory bail? This itself says "Daal mein kaala". It is time put these such religious scoundrels behind bars.
