First look out notice against Vijay Mallya needed correction, says CBI


New Delhi, Sep 18(PTI): The CBI said on Tuesday that the first look out circular against embattled businessman Vijay Mallya for his detention at airport was not sustainable in law and needed correction as there was no warrant against him at that time.

The agency reiterated its position that there were no grounds to arrest Mallya on November 24, 2015 when he returned from London on the basis of the look out circular (LOC) issued on October 16, 2015 calling for his detention, agency sources said.

The first circular needed modification as Mallya had been cooperating with the agency, the evidence were still being collected, he was a sitting MP and there was no warrant against him, the sources said.

Realising the need for correction in the notice, the agency wrote to immigration authorities to change it from seeking Mallya’s detention to informing the CBI whenever he was travelling abroad.

The corrected look out circular was issued on November 24, 2015 and even after the issuance of the notice, Mallya continued to provide documents and answer questions of the investigating team, they said.

He appeared for questioning thrice and made foreign trips four times after the new LOC was issued, they said.

Sixty-two-year-old Mallya, facing charges of fraud and money laundering amounting to around Rs 9,000 crore, left the country on March 2, 2016 and is fighting litigation against his extradition to India.

    CBI falls under the Department of Personnel and Training which directly reports to the PM. Therefore, collaboration of the Modi government at the highest level stands exposed in this case. PM cannot absolve himself from his responsibility in Mallya escape-gate.

    The role of the then CBI director Anil Sinha, Joint Director AP Sharma and IPS officer Harshita Attaluri also be probed for their “complicity” in Mallya’s escape, “why has the CBI changed its stance and why are Modi’s favourite officers from Gujarat AP Sharma and IPS officer Attaluri who downgraded the lookout notice are mum on the issue?
    The consortium of 17 public sectors banks, especially the management of the State Bank of India, alleging that senior lawyer Dushyant Dave had advised the consortium to file a petition against Mallya at the highest court of the country demanding seizure of Mallya’s passport, but the consortium allegedly did not pay heed and as a result, Mallya fled the country, leaving public sector banks with outstanding dues of ₹9,000 crore.

    Somehow, I feel that this Mallya issue has been propped up to divert people's attention from the real and more important issues like Falling Rupee, rising fuel prices, Rafale deal, lack of jobs for the youth, etc etc.
    After a few days this issue will be out of focus and then some other issue will be artificially propped up and given undue publicity to divert attention.

    CBI on damage control mode and damage was done by Subramanian Swamy by questioning who instructed CBI to dilute the lookout notice and that question still remains unanswered. These are mere feeble endeavors probably instructed by the big boss himself.
