Bengaluru, Feb 13: “There is no question of leaving the party. I will remain in Congress. I will not resign,” said Congress MLA Umesh Jadhav on Wednesday, February 13.

Jadhav’s clarification comes after his brother Ramachandra Jadhav held a press conference on Tuesday stating Dr Umesh Jadhav will resign from Congress primary membership and also from his position of MLA and contest in upcoming Lok Sabha elections.

“I was not able to attend CLC meeting due to personal reasons. I will clarify on that to party leaders. If they find loopholes in my clarifications, they are free to take action against me. But there is no question of leaving the party,” said Umesh Jadhav who added that he is in Bengaluru due to the elections. The statement by the Congress leader comes in complete contrast from his brother’s stand earlier.

When questioned on his attempts to topple the government, Jadhav said that he has not tried to weaken the government. “My supporters had urged me to obtain minister’s post. But I am not an aspirant for the post. I have not visited anybody to topple the government. I have not gone to Mumbai. I have friends in BJP. Can I not communicate with them? Can it be termed as attempts to topple the government?” he asked.

    Congress MLA Umesh G. Jadav is Doctor by profession. A Doctor can't live elusive when the patients in need. So the rules apply for democracy as well.
    His clarification only came after Cracking the whip, which sought disqualification of four rebel lawmakers under the Anti-Defection law after they repeatedly remained defiant, skipping the assembly session and legislature party meetings.
    Added to the Constitution as the tenth schedule by the 52nd amendment during Rajiv Gandhi’s tenure as the Prime Minister in 1985, the anti-defection law aimed to check the ‘Aya Ram, Gaya Ram’ (frequent defection by legislators) phenomenon in Indian politics.
    The Statement of Objects and Reasons of the Fifty-second Constitution Amendment Bill, 1985 read: “The evil of political defections has been a matter of national concern. If it is not combated, it is likely to undermine the very foundations of our democracy and the principles which sustain it.”
    According to the 10th Schedule of the Constitution, a member can be disqualified in two circumstances.
    First, if he/she “voluntarily gives up membership of a party” (paragraph 2(1)(a)). Second, a member also incurs disqualification when he/she votes (or abstains from voting) contrary to the directive issued by the party (paragraph 2(1)(b)).
    Under the anti-defection law, even an expelled legislator is required to follow the whip issued by the party on whose ticket he was elected to the House and vote for his/her original party during a floor test.
    Any defection of an elected member is against the "Voters mandate". India should reform its defection law immediately and the vote cast by a defector to topple a government should be treated as invalid. Any defected member and his immediate family members should be barred for lifetime contesting elections.

    When attempts don't yeild desired results, remain in the party.
    But after having elected on the party ticket, desert it when it needs you!
    To some, personal interest matters over principles, they're are unfit everywhere.
