New Delhi, Nov 9 (IANS): In a historic judgement in the sensitive Ayodhya land dispute case, the Supreme Court on Saturday directed the Centre to form within three months a trust which will build a temple at the disputed site.

The Sunni Waqf Board, which was a party to the 7-decade-old title suit, should be given an alternate five-acre land at some other suitable place for construction of a mosque, a 5-member bench headed by Chief Justice Ranjan Gogoi, said in a unanimous judgement.

The Centre shall make suitable provisions by handing over the land to the trust, said the bench, which also comprised Chief Justice-designate Justice Sharad Arvind Bobde, Justice Ashok Bhushan, Justice S. Abdul Nazeer and Justice D.Y. Chandrachud.

The court said the title of the land can be decided only on legal advice.

The top court ruled that the Allahabad High Court verdict of 2010, giving land to the Sunni Waqf Board and Nirmohi Akhara, was wrong.

It rejected the claim of Nirmohi Akhara of being a 'shebait' (a devotee who serves the deity).

The Supreme Court, however, said that in the board of trustees, appropriate representation should be accorded to Nirmohi Akhara, even though its suit was dismissed.

The bench upheld the report of Archaeological Survey of India (ASI), which concluded that a temple existed at the disputed site.

There is clear evidence the Hindus believed Ram was born at the disputed site, it said.

There is evidence that 'Ram Chabutra' and 'Sita Rasoi' were worshipped by Hindus before the British came, the judgement said.

The court said travelogue and gazetteers cannot be the basis of adjudication of the title and that the nature of worship offered by Hindus over the years proves that they had always believed that Lord Ram was at the site.

Documents of 1856-57 show that Hindus were not obstructed from worshipping there, it said. Outer courtyard has been under exclusive possession of Hindus over the years, the court said.

The bench said Hindus consider the disputed site as the birthplace of Lord Ram and this belief is beyond judicial scrutiny.

New Delhi, Nov 9: The Supreme Court is all set to deliver its final verdict on the Ayodhya land dispute on Saturday, November 9. The verdict is likely to be announced at 10.30 am.

Outgoing Chief Justice Ranjan Gogoi is expected to deliver the momentous ruling before he retires on November 17.

It may be recalled, the dispute which picked up steam in the late 1980s led to the rise of the Bharatiya Janata Party, after it included building a grand temple for Ram as one of its election promises in the 1989 Lok Sabha elections. Then party president LK Advani soon embarked on a Somnath to Ayodhya Rath yatra, in 1990, and kar sewaks demolished the Babri Masjid on December 6, 1992. The trial in the demolition case is still at trial stage in a district court.

No single issue has impacted the national and state politics in the last 35 years as the Ayodhya dispute, which, though a litigation over the title deed of a piece of land, revolves around the contention that a mosque was built after demolition of an ancient temple which stood exactly at the birth place of Ram.

    Even Retired Supreme Court judge Asok Kumar Ganguly on Saturday raised questions about the Supreme Court’s verdict on the politically-sensitive Ayodhya title suit and said he was disturbed by the judgment. World community also felt something went wrong while delivering the judgement. Majoritarians also knew from the back of their mind that the verdict is unfair.

    The favorable outcome of this verdict is that this case has finally come to an end after all these prolonged (70) years of political drama/selfishness and loss of lives just or the sake of votes.
    Other satisfactory thing is that Muslims did not loose the Masjid as well. (Even though it will be relocated).
    But I firmly believe that the verdict is not satisfactory while considering the observations of the Court; and delivered with the sole intention to maintain peace in the society. I any title dispute case, It never happens that both the parties are awarded with something or the other. This shows how much pressure was there on the judges of the Supreme Court. There is also a regret that the people who erased the disputed Masjid at that time are not yet brought to justice. There is also a regret that decisions are made on land disputes on the basis of faith.

    We promised to abide by SC verdict, and we have moral obligation to respect the verdict. Gods do not come to decide our issues but we trust in the wisdom of human beings.
    Now the focus needs to be on building the Nation and leave the task of building temples, churches mosques and gudis to the respective followers of each faith.
    We can fool fool people by playing with religious sentiments for a while but not fool for for long.
    If an earthquake flattens our houses and places where we worship, we will worry more about our survival repairing our residence rather focus on building house to accommodate gods.
    We are children of one god and truth and service to humanity is worship.

    Indeed impressive to see that a lot of Islamic organizations in India have come out with press releases requesting the Muslim community to maintain peace over the verdict of the Ayodhya case by Supreme Court and abide by laws of the land.

    On the other hand I wish that we Muslims were more concerned about praying the 5 times prayer inside our local mosques just like how we are concerned for a mosque that we might never visit.

    This whole scenario also makes me ponder over the beauty of Islam, that is we worship Allah who does not have a birth place or a birth date and rather He was always there and will always be there. It's the beauty of Islam that Allah can be worshipped from anywhere and we do not worship him via anything from his creations and instead worship him directly.

    Well Mr. Arif, a rose in any other name would not loose it's beauty. There is an old adage that says 'beauty is in the eye of the beholder' .. so each one to his own and there is no need to justify why one is more beautiful than the other when conceptually the almighty or what ever name she/he/it has is no different. Exclusivity means nothing .. something to ponder ...
    I believe that we all should work toward better integrity and avoid conflicts as much as we can and build a successful nation.

    This is the single most important judgement coming out of the Supreme Court, and it should be congratulated for arriving at an unanimous verdict that satisfies both the warring litigants. It is one better than King Solomon's judgement - by not dividing the disputed land, it satisfied the Hindu claimants, and by requiring the government to provide alternative site to the Muslim parties to build their mosque it has satisfied their claim as well.It is the lasting legacy of the outgoing chief justice who has been able to unify the court on this most vexatious dispute. The Chief Justice deserves the country's highest recognition.
