Vijay Mallya loses appeal against extradition order to India

London, Apr 20: Fugitive tycoon Vijay Mallya on Monday lost his appeal in an UK court against an extradition order to India on charges of fraud and money laundering to the tune of Rs 9,000 crore.

The High Court in London upheld a 2018 ruling to send him back to India on grounds that Mallya made a number of misrepresentations leading to the 2012 collapse of his company, Kingfisher Airlines. 

At a hearing in February this year, the former 64-year-old Kingfisher Airlines boss had made an appeal to the high court against his extradition. Mallya had escaped the country after charges were put on him, is wanted in India for fraud and money laundering charges. He had challenged in the UK high court his extradition from the country.

Lord Justice Stephen Irwin and Justice Elisabeth Laing at the Royal Courts of Justice in London dismissed the appeal in a judgment handed down remotely due to the current coronavirus lockdown.

"We consider that while the scope of the prima facie case found by the SDJ [Senior District Judge] is in some respects wider than that alleged by the Respondent in India [Central Bureau of Investigation (CBI) and Enforcement Directorate (ED)], there is a prima facie case which, in seven important respects, coincides with the allegations in India," the judges ruled.

Mallya is wanted in India on alleged fraud of the banks and money laundering charges amounting to an estimated Rs 9,000 crore.

    Dear Readers just I want to clarify something here. First of all I have special respect for Mr Malya . He helped lots poor people in Bangalore also please do not forget that he has brought Tipu Sultan& rsquos sword, which he had purchased for about Rs 1.5 crore at an auction.

    I have a suggestion to Mr. Mallya-
    1. Start Kingfisher Surfliner instead of Kingfisher airlines.
    2. Give a proposal to invest the due loan amount & start Kingfisher Surfliner using Train 20 from Kanya Kumari to Kashmir via west coast, east coast & central.
    3. On the west coast Kingfisher Surfliner takes the route of Kerala, Karnataka, Goa, Maharashtra, Gujrat, Rajastan, Punjab, J&K
    4. With the political base built using Ice cream federation & Milk co-operative society, to doubling & electrification of remaining section of Konkan railway so that it becomes competitive as compared to airlines.

    There are two types of fugitives... (1) Indians who have siphoned off, tons of wealth n are holed up in nations, who offer them permanent residents status.... These filthy animals are well versed with laws n are almost impossible to extradite them, back to India !! (2) Fugitives with immense political clout, who are the moneybags of netas, are also impossible to snare, they liveout a prosperous life, with impunity !!!!!

    He need not sing against anybody (yeah, to get protection, singing against singh & co is sufficient - we've seen how cases against scindia are revoked) - Mallya himself offered that he'll pay back what he owes. I don't know why the government isn't accepting it. Compared to our own Padma awardee, Mallya's debt is peanuts.

    Who is filing the case against extradition orders from India???. Mallya wants to return back to India and pay back all loan, dues, penalties, fines etc etc. Why would he file a case against his extradition???. Now since UK HC has given verdict against extradition appeal since 2018 why is the delay in his extradition???......

    Mallya is willing to return to India and pay back everything. UK HC has dismissed plea against extradition and wants him to be deported. Now it all depends on PM Modi to officially honour CBI and ED extradition order to India and give permission for his trip back home. UK will not deport anyone unless the destination country officially accepts that person.

    Don't ever dream of any money. Money has already been swallowed hence the hurdle on his return. Mallya may have to file a counter case against the govt to recover his money, assets and wealth after paying back all his dues which will expose the govt.
