'PM has hands on nuclear button, yet can't be trusted to appoint judges?'


New Delhi, May 29 (IANS): Union Law Minister Ravi Shankar Prasad, making an observation on the Supreme Court Collegium system, said the Prime Minister has his finger on the nuclear button, "but the Prime Minister assisted by the Law Minister cannot be trusted to appoint a fair and objective judge? That is too sweeping a comment about which I have my serious reservations."

Prasad was speaking at the Akhil Bhartiya Adhivakta Parishad edition of Prof NR Madhava Menon memorial lecture series on legal and digital challenges for India post-Covid-19. He added everybody works in democratic form of the government. Prasad said the Prime Minister is the head of the government, who appoints all the ministers and all report to the PM.

He added the Prime Minister also plays a significant role in the appointment of judges of the Supreme Court. "The Prime Minister has a nuclear button in his hand, the Prime Minister can be trusted for so many things in the country, but the PM assisted by the law minister cannot be trusted to appoint a fair and objective judge?" asked Prasad.

He said Menon held the view that the Collegium system (appointment and transfer of judges) is not relevant and it should be replaced, as it has outlived its utility. "We came with the National Judicial Commission (appointment and transfer of judges) in the first term of the Modi government. It was unanimously passed by the two Houses of the Parliament, and also unanimously passed by more than 50 percent Vidhan Sabhas of the states, yet the Supreme Court quashed it. Any judgment of the Supreme Court, we respect", he added.

Prasad said "The law minister of India and the law ministry is not a post office. We are a stakeholder and we shall continue to exercise our role as a stakeholder."

He added that the Supreme Court has held that in the judicial commission, the law minister is also a member; therefore, the appointees from that process may not be fair and objective, when the litigation comes against the government. "Then I have serious reservations as a student of law", said Prasad.

He insisted that people trust the Prime Minister for sanctity and integrity and security of India. "We have to see that the PM also plays a major role in the appointment of the President, Vice President", he added.

    Nuclear trigger is a war time responsibility of a PM or the highest political authority of a country. It is to be judiciously used against a enemy country. Judges are for the betterment of the people of a country. Unless R.S. Prasad consider people as enemies. This gives rise to using the judges against the political enemies.

    In Modis govt. people have become enemies of the govt.

    Why this guy is glorifying the PM's position. President of India has the ultimate power to order nuclear attack and not PM. President can even dissolve the parliament in which case PM has to go back to his original business. We need president's signature to pass any laws. President can send the bill back to parliament with recommendations to review and change it. This minister should go back to school and take political science class.

    Union Law Minister Ravi Shankar Prasad has finally accepted that under PM Modi's leadership only autocratic government exist and no more democracy prevails.
    By considering the statement since all the judgement delivered by the Supreme Court and the High court in favor government has final say of Modi rather than the judge headed by the bench.
    If PM has hands on nuclear button then definitely "Pulwama attack" may be also planned when he was deliberate shooting in Assam for NAT GEO wildlife channel.

    He is not the PM, he is a dictator within a democracy. Parliament is there just to take home a salary that NaMo raised 200% upon taking up power in 2014, so that they don't utter one work when he takes decisions solely, autocratically. Whether it is DeMo, abrogation of Art. 370, change of RBI/CBI heads, and now you are talking about Judiciary ?

    Why leave that out ? Let the King take his call !

    Yes Mr. Prasad, you and your BJP governments cannot be trusted to be fair and impartial in your appointments to the supreme court. You have made your intentions very clear by transferring or denying promotion to honest, upright & deserving junior judges. You have also made your intentions very clear by rewarding the ex CJI (who gave you some favorable decisions) a RS seat so soon after his retirement. So no we cannot trust you and your PM to be honest & impartial in appointing judges to the highest court of the land, which is the last impediment towards your march to an authoritarian government.

    Sir, judges should not be appointed by political criminals. Can you address about the the high percentage of criminals in our political leadership? They should have a say in appointing judges too?
    Democracy is a system where minority have their say and the majority have their way. So, majority decides what type of judges we want?
    Sorry, sir. As a law minister he would have enlightened Indians, diverse as we are, on the danger of politicians entering into the judiciary. Rather we have a minister speaking jungle mentality.

    Doesn't' make sense what rubbishing he is talking about. Whatever decision govt makes it should come out of the parliament. Not unanimous over night decisions. We have a democratic system, so let all the people's representative (Ruling and opposition) come to an agreement.
