Udupi, Mar 18: Udupi turned into a city municipality from being a town municipality in 1995. In 1997, Udupi became a district. People working elsewhere including abroad, with the hope of finding a house to settle down in the city after retirement, acquired sites around the city. Their number is approximately 20,000. Now, because of legal hurdles, they are neither able to build the houses nor sell these sites. They have slipped from being well-to-do families to below poverty line. Many of them have become senior citizens now and are battered by the financial downslide inflicted by dwindling value of money.

These people had bought land that was converted for non-agricultural purposes from developers. They felt that Udupi, without problems of law and order, and with an abundance of water and electricity, is an ideal place to make their nest. They were legally registered. But because of the law governing Udupi Urban Development Authority, they are not getting permission to build houses in these sites. They blame the district administration for not coordinating the registration at the time of registration.

Till 2012, the government did not enforce law governing unauthorised layout rules strictly. As the law was enforced at once thereafter, those who wanted to build houses are facing legal hurdles. The authority has 7,000 applications pending before it. The state as a whole has about 17 lac such applications. Even though the same was decided in the high court, the case is now before the Supreme Court. The government has to find a way out.

K Raghavendra Kini, chairman of the authority, admits that people are suffering for the mistakes committed by someone else. He said that unless the Supreme Court decides the case, there is no other way out. He said that the state government has provided necessary documents to the court and taken steps for early settlement of dispute. He hoped that the case will be decided soon and the problems of the affected people including senior citizens will be solved soon.

    The victims of the scam might have exhausted their life's savings and might have hoped that this investment as a future security, but see their fate now! Even if SC clears this case nobody will buy it because of the past problems! Many people (NRIs) have been cheated by brokers who went to their places and enticed them to buy property giving rosy promises, which later on were found to be frauds! The days of getting appreciation in realty are over with the current economic scenario and the amount of unsold flats and plots for sale, many as distress sale but no customers; the MKT value is down by 30-40% after demo/GST/Corona with very few buyers but no investors!!

    There is same problem everywhere in the district. If you want to build a house, for approval itself it may take one year, due to unnessary paperwork. If you go through agent, there is different story.

    The wheels of our Govt.gaadi is moving very slowly.Nothing works in offices properly.One never find files in offices of your property.This has happened in my case.It is frustrating when you see how they work.Someone buys your property,without your knowledge and build a house and sell to someone else in your absence.

    Every such case is happened with the big blessings of Sellers, DC, MLA, MP, CM, PM and President of that country. That is why courts are taking decades to judge these cases. Court is waiting for all those involved to die. Once court gets confirmation that all the CHORS are no more the judgment (Mostly unfavorable) will be delivered.

    Recently we went with an application for conversion of land to construct one small house.... For our mere surprise, the land mentioned in the RTC shows 18 cents and in fact when surveyor came for measuring the land.... it has only 12 cents..... and one house constructed on the opposite side of the road shown next to our land. We went up to Karkal Taluk Office but Officer says we need to approach Udupi Dist to correct the RTC first And now the question is..... do we have to correct the Govt documents by ourselves... but Officer says.... yes you need to apply again by informing the mistakes committed by Village Surveyor decade ago and they will receive an order from Bangalore to correct the documents and Dist or Taluk Office through Village Panchayat will do the needful Till then keep quite without any success!!!

    The land was converted from non-agricultural purposes then Udupi Urban Development Authority should allowed to build houses. These are legally registered sites, If people cannot build houses then why legally registered ? Government authority should held accountable.

    Through one person in Aramco, Saudi Arabia, many Mangaloreans working there, purchased land of 10 and 20 cents in Bangalore, paying lakhs of rupees which was properly registered. After some years, when they left/retired from Aramco, they went to the site to build the bungalows. There was no land, but only big buildings have come up in their land.. The matter was brought to govt and govt promised them land elsewhere, but as usual, it has remained a promise only. The value of land now is in crores. Matter is in court. The court hearing may start during these Mangalorean's grand son's time. Tariq pe tariq, they will have to go through, but, no justice.

    Builder mafia along with corrupt officials might have usurped the property by making fake documents, in the absence of owners for long, and built buildings; it has happened in many places in and around Mumbai too!

    All immovable property should be vetted by the Municipal Corporation/ Urban local body before transfer occurs, so that all the rules and clearances are accounted for, the such a situation will never occour.
