Bengaluru: Jarkiholi case - HC refuses to stay arrest of CD lady

Bengaluru, Jun 24: The state high court (HC) refused to issue a stay order against the arrest of the lady depicted in the intimate CD involving former minister Ramesh Jarkiholi.

The petition filed by the lady seeking to quash the complaint filed against her by Ramesh Jarkiholi in Sadashivanagar police station came up for consideration before a single judge bench of the high court headed by Justice Sunil Dutt Yadav. Advocate Sankesh Enagi, appearing for the lady, drew the attention of the bench to the fact that the investigating officers had not arrested accused Jarkiholi relating to the rape complaint made by the lady in question. But he said, there are chances of the aggrieved lady being arrested. He requested the court to issue an order to the investigating officers against arresting her.

The bench observed that the petition in question was filed under section 482 of the Indian Procedure Code seeking to quash the complaint filed by Jarkiholi. It therefore said that it cannot issue order against the lady's arrest. It asked the concerned to file separate anticipatory petition depending upon the need.

Special public prosecutor, P Prasannakumar, said that the public interest litigations filed in this connection are being heard by a division bench of the high court. Therefore he requested to adjourn the hearing of this application. The bench thereafter adjourned the hearing to July 6.
