Hijab row: HC refers matter to larger bench; Sec 144 in Bengaluru, Shivamogga

Daijiworld Media Network – Bengaluru (EP)

Bengaluru, Feb 9:
A single-judge bench of the Karnataka High Court, hearing petitions seeking relief regarding wearing of hijab in colleges, on Wednesday referred the case to a larger bench.

"This is a fit case for inquiry by the Chief Justice. The bench of the Chief Justice has the authority to form an extended bench to hear the case.

It is said that the next hearing is likely to be on Friday, February 11.

While the entire state is waiting for the court verdict, prohibitory orders have been clamped in Bengaluru city and Shivamogga as a precautionary measure.

The high court will hear the case questioning the government orders banning entry to those wearing Hijab and about school uniforms. Advocate Sajjan Poovayya and Sanjay Hegde argued for the student petitioner. Advocate A G Navadagi argued for the government.

The court had stated on Tuesday in its reaction to the violence in the state, that students and people should not get down to the streets and protest. “They should maintain peace and order,” it said.

“The court has complete faith in the patience of people. The court cannot be influenced by untoward incidents. The court and the justice will not be bogged down by them. But when we see the incidents on the TV, it hurts. Therefore, allow us to issue the verdict in peace,” said justice Krishna Dikshit had said on Tuesday.

Instead of referring this issue to larger bench it would much better to look at the constitution and give verdict accordingly and quickly Is it so difficult for HC judge?. Don’t look here and there just look at the constitution and give your verdict unbiased. Now the larger bench could comprise judges leaning both sides but mostly towards govt as has been the case in the past. It can not be unbiased fair trial. The HC judge is passing the buck now and washing his hands. Any child who can read the constitution and understand it would have given a fair justice.

These chief justice's cant give judgement in such a silly matter too? Cant they understand it is a mere political stunt? They should realize the amount of loss those students will have to bear as exams are nearing. They should simply pass the judgement that "since it was allowed so far, let it continue till this academic year end. Then from next year inwards let the courts decide in the beginning itself what is allowed and what is not". Pls don't spoil their studies as they have already suffered a lot due to lockdown.

nothing internal or external dimension..ME countries moving fast than Asian countries..check school uniforms of ME countries..if there is law of land, no other country can poke nose.. its not about fundamental or religious rights..if courts goes on that direct then schools may have to build Gudi, mandir, prayer hall ..one can say i have to pray 3 time, do Bhajan..even you cant ride vechicles on road, prayer is religious right..where you will put full stop!!..issue must stick to particular schools admission uniform rules (every school has different rules)..if student parents accepted it, then case infavor of school..if school now denies it, then its student favour..

Matter is not that simple but too sensitive ! Needs to looked into both through Internal and External dimensions . Also, Economic/Investments point of view. Aggravating the already critical situation may not be in countries favour. Modiji, please note that women empowerment is going in right direction.
