Hijab crisis: Allow Muslim students to wear hijab on Fridays, Karnataka HC urged


Bengaluru, Feb 17 (IANS): Counsel appearing for students seeking to attend schools with hijab, on Thursday urged the Karnataka High Court that these students be allowed to wear hijab and attend classes on Fridays at least.

Senior advocate Vinod Kulakarni, appearing for the students, submitted that the hijab issue has created mass hysteria and mental disturbances throughout the country, and that sending poor Muslim girls out of class is against the preamble of the Constitution.

At least on Fridays, and ensuing holy month of Ramzan, beginning in Marc), let the students be allowed to come wearing hijab, he said, quoting a Lata Mangeshkar song, ".. Kuch paake khona hai, kuch khoke paana hai' (to get something you lose, you lose something to get something) and sought court directions in this regard.

"I beg with my folded hands to allow hijab on Fridays and it will avoid unnecessary controversy," he said, adding that the Quran can't be ignored and hijab is not against public order. Outside authorities have no standing and have no authority to pass orders in religious matters and beliefs, he said.

Advocate General Prabhuling Navadagi, appearing for the state government, opposed the demand, saying that if the request is considered, it is as good as considering the petitioner's application.

Senior advocates Devdatt Kamat, Ravivarma Kumar and Yusuf Muchchala, appearing for the petitioners, have completed their arguments on Wednesday.

The three judge bench, which heard the matter for the fifth consecutive day, subsequently adjourned the matter to Friday, when Navadagi will present his arguments.

Counsel for petitioner have so far vehemently argued for lifting of interim order prohibiting wearing of hijab and saffron shawls to classes, contending that the government is misusing the interim order issued by the court to target Muslim students.

However, the bench headed by Chief Justice Ritu Raj Awasthi and comprising Justice Krishna S. Dixit and Justice Khaji Jaibunnesa Mohiyuddin has not acceded to this.

Meanwhile, the six girls from Udupi who started the hijab protest have chosen to remain absent from the college until the final order.

Meanwhile, police had a tough time as about 340 students resorted to block the road holding placards in support of wearing hijab in Hassan. A police officer warned them of action and dispersed them.

A tense situation is prevailing at Saraladevi College in Bellary as hijab wearing students joined by parents refusing to go back even after several requests from college and police authorities.

    Karnataka should learn from UAE. In UAE, 2022 Fridays are working days. In UAE rules are strict and people are living in harmony, as the leaders of UAE , have kept religion within 4 walls. But they do listen to the opinion and constructive suggestions.

    I think those lawyers should plead to make hijab mandatory for all muslim ladies, then without wearing hijab and roaming in public place will be an offense. This will solve entire episode and there will be communal harmony.

    As per my belief no religion restricts its 'general' followers to wear a particular dress. Only those who dedicated themselves in spreading their religion (like religious priests) stick on a specific attire. Such people usually prefer to go to such schools where they can get religious education with modern education. Now, as per news I read, the Advocates representing petitioners are 'requesting and pleading' the court instead of arguing... Don't know whether it is a normal procedure in court.

    Mr Bhat: It is not a normal procedure. It is not pleading, in the legal sense, bu sounds pitiful and desperate. Begging the Court to allow at least on Fridays would mean nonsense for other days of the week, unless Fridays are recognized are Holy Days of Obligation in the Quaran as in Talmud, and Sundays are in Christianity. The Ten Commandments clearly tell the people to Keep the Lord's Day Holy. Jews and Christians obey that, though Christians have chosen Sunday and Jews have chosen Fridays as their Sabbath. Perhaps the Quaran has a similar Commandment. That I can understand and support. On the other hand, if Muslim girls are allowed to keep the hijab in a locker to be provided by the school at government expense, you get best of both worlds; respect your religious obligations and at the same time respect the school uniform policy. Why didn't the advocates for the petitioners come up with this idea and plead. May be reserving this compromise in the rebuttal to defence arguments, or may be they have been instructed by the petitioners not to do so at this stage. Would be eager to read the concluding arguments. May be leaving it to the Court to come up with this compromise. All will then agree. End of the story.

    All religious symbols should be allowed in schools. If only uniform is allowed then students will forget that they are different. Parliament should pass a bill making hijab compulsory from kindergarten for Muslims.

    In that case, also open temple, mosque, church in every schools for students in every school. For Hindu student, give holiday on Thursday. For Muslim student, give holiday on Friday. For Christian student, give holiday on Sunday.
