Udupi, Mar 26: In the last general session of the city municipality here, a resolution was passed to clear illegal buildings.

Following the same, in an early morning operation undertaken on Saturday March 26, the building which housed a hotel belonging to the Social Democratic Party of India (SDPI) district president here, was brought down.

The operation was led by municipal officers including municipal commissioner, Udupi tahsildar, town police station sub-inspector Pramod Kumar, and other senior police officials in large numbers. Many police personnel were deployed to look after the security aspect.

Vehicular movement to the area was restricted. Two backhoes, a crane and lorries were used for the demolition. As a precautionary measure, an ambulance was also stationed at the spot.

“This building is demolished just because I am the district president of SDPI. BJP members of city municipality discussed about demolishing this building 15 days ago in the meeting. There was no issue on this plot. I had applied for permission in city municipality. But did not receive the same. When the matter of demolishing the building was discussed, I went to the court. After that there was no development for seven to eight months. There are many buildings which have not left set back and are built violating the rules of city municipality. I had supported the stand of Muslim girl students over the Hijab controversy. I had said that wearing Hijab is constitutional right. On March 17 we closed the shops. This is the main reason. The legal battle will continue,” said Nazeer Ahmed owner of the demolished building.

Giving clarification over the demolition of the building, Dr Uday Shetty, commissioner of city municipality said, “This was an illegal structure. No licence was sought prior to building. In 2018, an order was passed to demolish the building. There was stay order in court. Now it is removed. No GST was being paid for this building. This was the only building which did not have any licence for trading. So we have taken action as per law.”

    For over 20 years this particular plot that housed this Restaurant was the biggest Gujjri or Recycle Dump Yard in Udupi city. Then came Reliance Supermarket, in another building that was also built in bits and pieces as many old dilapitated smaller shops used to occupy the City Center Mall plot and this Recycle dump shut all of a sudden and eventually came a building with a Garments shop and a Restaurant. The issue is not about legality here, it is all the local authorities such as the Udupi Municipality and the Police making the demolition look legal! Question is where were these people in authority all these years when this building was built and the Restaurant was running right in front of their eyes!

    I don't know whether it's a liagal or illegal construction but it is learnt that the hotel owner serving daily free food to many begeers and poors daily without looking cast or creed.

    Cost of mobilizing state resources for demolition should be recovered from the person who constructed this illegal l construction and deemed owner who has such a huge illegal construction in Udupi. His indulgence in illegal activities and trouble-making instinct is no surprise and it happened in Udupi and spread to entire state. No, we are not talking about corona virus spread.

    There may be 100s of structures in Mangalore and Udupi and several encroachments of government land, but the fact that this particular persons structures were targeted is very obvious! MCC should demolish all structures which do not have an occupation certificate or those who have encroached government land.

    Sad to see business people has to go this way. Hope govt start helping people than. Harassing. with dialogue and discussion could you resolved with proper paper work and missing documents to make this building legal without demolishing. Yes if it is wrong for sure okay to demolish provided that given enough time to owner manage his livelihood . This incident clearly shows the vengeance against the hijab ruckus. Many citizens forcibly fell into victims under Udupi Urban Development Authority that the legally registered land notified as Akrama which lingering the apex court since 2017 and our peoples representatives not showing any interest to raise the issue in the assembly for the court proceedings. We are in a situation where the purchased land cannot be sold, can't construct house, nor bank loan can be obtained. A law abiding citizens are deceived and deprived from the constitutional basic rights.
