Mangaluru: Cheque bounce case – Court orders to pay Rs 88 lac fine or undergo six-month jail term

Mangaluru, May 27: Justice Chinmayi of fifth district and sessions court ordered Manjunatha Kharvi, whose three cheques given to Dakshina Kannada (DK) and Udupi district cooperative fish marketing Federation got bounced, to pay Rs 88 lac to the federation or undergo imprisonment of six months.

Manjunatha Kharvi had purchased fish from DK and Udupi fish marketing federation. He kept the commission due to the federation pending. He had given three cheques against the pending amount to the federation. However, the cheques got bounced when they were presented in the said bank.

Though the federation served notice to Manjunatha Kharvi to pay the pending amount, he did not pay. So the federation filed a private complaint in the court. Three cases were registered against Kharvi in the court.

In its verdict, the court said that the accused has to pay Rs five lac, Rs 53 lac and Rs 30 lac pertaining to three cases. A total amount of Rs 88 lac. Otherwise, he has to undergo six months of prison sentence.

Lawyers of Veritas Legis association Raghavendra Rao, Gauri Shenoy, Abhilash Shastri and Jayashree argued for the complainant.

    punishment for civil offene in india is very minimal...in the case in which a big man of kudla was duped to the tune of rs four crores by 11 real estate brokers...what he got back was only Rs 60 lac and the culprits were out from jail in three months...

    6 months is too less. What will happen after 6 months? Will the federation grt their money back? Punishment should be as long as he don't pay he will languish in jail. Let him sell his properties to clear dues. Some may ask why punishment to his family members for his misdeeds? Ofcourse with the said amount he had spent on himself and family, so now in difficult times it has to be sold out.

    Observer- it depends on your counsel, means lawyer. Lawyer need to do more work to recover dues. They need to list down their properties using intelligence sources and submit it to court to put on auction. But this generation Indian lawyers are not so competitive so no better solution. I say lawyers need more training.
