SC Rejects Petition for Mercy Killing of Aruna Shanbaug

New Delhi, March 7 (PTI) : In a path-breaking judgement, the Supreme Court today allowed ''passive euthanasia'' of withdrawing life support to patients in permanently vegetative state(PVS) but rejected outright active euthanasia of ending life through administration of lethal substances. 

Refusing mercy killing of Aruna Shanbaug, lying in a vegetative state for 37 years in a Mumbai hospital, a two- judge bench of justices Markandeya Katju and Gyan Sudha Mishra, laid a set of tough guidelines under which passive euthanasia can be legalised through high court monitored mechanism.

The apex court while framing the guidelines for passive euthanasia asserted that it would now become the law of the land until Parliament enacts a suitable legislation to deal with the issue.

The bench also asked Parliament to delete Section 309 IPC (attempt to suicide) as it has become "anachronistic though it has become Constitutionally valid."

"A person attempts suicide in a depression, and hence he needs help, rather than punishment," Justice Katju writing the judgement said.

The apex court said though there is no statutory provision for withdrawing life support system from a person in permanently vegetative state, it was of the view that "passive euthanasia" could be permissible in certain cases for which it laid down guidelines and cast the responsibility on high courts to take decisions on pleas for mercy killings.

"We agree with senior counsel T R Andhyarujina (who assisted the court in the matter) that passive euthanasia should be permitted in our country in certain situations, and we disagree with  Attorney General (G E Vahanvati) that it should never be permitted," said the bench.

While dismissing writer Pinky Virani's plea for subjecting to mercy killing of the KEM Hospital nurse who was sexually assaulted by a ward boy, the apex court cast the responsibility of taking a call on passive euthanasia on high courts, if the plea is made by close relatives or friends who have strongly opposed such a step.

The bench, in its 141-page ruling, said in the case of Aruna, the plea for her mercy killing could be permitted if the Mumbai King Edward Hospital makes it to the Bombay High Court on her behalf and the high court accepts it.

"A decision has to be taken to discontinue life support either by the parents or the spouse or other close relatives, or in the absence of any of them, such a decision can be taken even by a person or a body of persons acting as a next friend," it added.

"It can also be taken by the doctors attending the patient. However, the decision should be taken bona fide in the best interest of the patient," and should be approved by the high court, it said.

In the case of nurse Aruna "it is for the KEM hospital staff to take that decision," and not writer Pinky Virani, the bench said , adding that "the hospital staff have been amazingly caring for her day and night for so many long years, who really are her next friends, and not Ms. Pinky Virani."

"Hence it is for the KEM hospital staff to take that decision. And the KEM hospital staff have clearly expressed their wish that Aruna Shanbaug should be allowed to live," the bench said, rejecting the plea for Aruna's mercy killing at present. .

    I do respect what all have to say. But have we asked ourselves we were to be in that state- What would we choose ??? Life, yes is god's gift but the truth is we are living it. So when one is going thru the pain and if the person is willing why not give the person what they are asking for.

    Life is Gods gift and whatever comes and goes in Life and all incidents are results of our choices!I guess we do not have license to take someone life because they are suffering!Instead pray that Lord God will have mercy and take that person home as soon as this life is done. God allows few things in life to humble us and few other things to humble others !We do not have to know Gods plan for our Life, But trust in him like a little child, Take his hand and walk through he Journey called Life.....We are just passing through.we are not going to be here permanently..Life and death are for certain ! Both are in Gods hand..Let God decide the place and time...People please do not support mercy killing !

    By writing Aruna's life story Pinky Virani made money,now she wants to kill her to become popular, her plea to court is mercy killing by stopping food and water for Aruna, how can one human can think to do such things to other human why because she is dependent on others, today Aruna tomorrow may be many others would have get rid of their dependent disable relatives, the court should order Pinky virani to give away all the money she earned through Aruna's story to disable people, All these long years only people took care of Aruna is K.E.M hospital Nurses, and as far I know her basic needs provided by a Doctor who was engaged to get marry to her at that time,this is real love from one human to other human, and these are the people happily take care of her and willing to continue to do so,

    Who is this Pinky Virani who is not spend a day to take of her.Why mother Teresa is living saint today because she loved and cared abandoned sick poorest of poorest people,the world recognized her for her work to humanity and she received Nobel peace prize for her great work to humanity, her work is spread in the world and people continued her missionary work to take care of such people.

    Through media reports we can make a case look good for Aruna to die in dignity. But the court has taken a mature decision by allowing the near and dear to her , the staff of KEM to decide on the petition to the high court for passive euthanasia.Over the years of caring for her they will be in best position to judge what Aruna wishes.
    This is also a landmark decision and hope for all those in extreme pain to approach high court for passive euthanasia.I heartily welcome the judgement.

    What kind of law is existing in India? A person is as good as dead and the rapist enjoying? If the court can reject the plea of mercy killing why the rapist did not get life sentense? Is there any reason for her to live? The rapist should be punished in the same way how he raped this poor lady. He should also lie in the same state as Aruna lies for as many years as he will live. I don't understand what the hospital staff & security were doing until she is half dead

    Why nobody is appreciating the people including Pinki Viirmani who have taken care of the victim from so many years. There are people who do not take care of their own bed ridden parents! In front of those people, I think they are really great. Also watch the hindi moview 'Guzarish', and then see the real agony of the bed ridden disabled people.

    The rapist ward boy Sohanlal Bhartha Walmiki, should have been hanged for this rarest of rare heinous crime. Rest everything comes next. Its a shame that he is scot free and is leading a normal life. It is clearly a case of justice denied to the victim.
