Udupi: 390 Writ Petitions – NH 17 Additional Acquisition Stayed

Udupi, Apr 15: Convener of National Highway 17 Land-losers Action Committee, Ramadas Nayak, said that the state High Court has stayed additional acquisiton of land for highway 17 expansion between Suratkal and Kundapur, as a result of 390 writ petitions submitted by aggrieved individuals who are losing their lands for the project. He was speaking at a meeting of people affected by the highway expansion, organized on Thursday April 14 at Shyamili auditorium here.

“We are not opposing highway development. We are aggrieved by the decision of the department to acquire 60 metres of land instead of its actual requirement of 45 metres. In Kundapur and Kota, the National Highways Authority of India has acquired land up to a width of 45 metres only. In Nantoor, Talapady, Kottara etc, the extent of land acquired is 35 metres. Why then, is the department hell bent on acquiring 60 metres in other places and showing partisan attitude?” he questioned.

Nayak said that 355 out of 390 writ petitioners have received copies of their sty orders, and the others will be getting the same soon. “This is our initial victory. We will continue our legal struggle against partisan decision to acquire 60 metres of land for highway expansion,” he asserted.

He said that state public works department minister, C M Udasi, had met union minister for highways, Dr C P Joshi, on March 8 and apprised him of the problems. He added that discussions were not held. “A delegation of affected people led by Ratnakumar, an office bearer of the committee, will meet the minister in Delhi soon and hold discussions. Some MLAs from the coast will accompany the delegation. Date for the visit will be finalized within a week,” he added.

Office bearers of the committee, Ratnakumar, Anand Rao Uppur, and Venkat Kumar, were present. The affected people who attended the meeting, discussed the individual problems they are facing, with the committee office bearers.

    Mr. Sunil kumar, Karkala/Qatar - Everyone has the right to express their view. But no one gives the right to you to say "Dont write silly comments sitting in AUH". You too sitting in Qatar and doing the same thing. If possible write some valued comments. For betterment of Public for future development, we all should support,sacrifice to be given to Govt.     Owning the land is one of the Fundamental Rights of the citizens. It is the duty of the Govt. to protect the Funamental Rights of the Citizens. Hence Govt. can not take away the land of Citizen.

    For that the Govt. had passed an Act called "Land Acquisition" in the name of Public Benefit.

    Under this Act the Govt. earlier was acting always upper handed. Susequently the Supreme Court has put certain conditions for the acquition & compensation.

    What happened in this case is, the Govt. pays the price as per their Record which is far lower than what is Actually Prevailing in the Market ("Bazaru Dharane"). Hence the land owners lose their money.

    Yes, for Public Benefit the Govt. may aquire the private land. But how much? It should only be to the extent required. Not more than that. What is enough area/width is proved by earlier acquisitions of 35 ft and 45 ft in two different locations. Why then Govt. needs now 60 ft between Suratkal and Kundapur?.

    Is it not discremination?

    All people are equal before the law. So the law applies equally to all. Why not for the road side land onwers betwen Suratkal and Kundapur. It is agreed by Karnataka High Court.

    The Govt. can now offer better/higher price acceptable to petitioners and get the land. It is the Govt. that acts upper handed under the shelter of Acquisition Act/Law and the people suffered so far. Why the Govt. should do good for many at the cost of even a few without compensating as per market rate?

    Dear Vasant raj, Udupi/AUB, do you have land or house near NH17? Do u know their plight for another land or for compensation? Dont write silly comments sitting in AUH.

    This clearly showing how greedy our people for money. Bringing the stay petition is not new, public benefit is least bothered..
