Sharjah : 17 Indians on Death Row to Walk Free

CHANDIGARH/SHARJAH, Jul 27 (IANS): Seventeen Indian youth on a death row in the United Arab Emirates for the death of a Pakistani national could walk free October after members of the Indian community in Dubai deposited "blood money" in a court in Sharjah Wednesday to secure a pardon for them.

Community representatives, led byDubai hotelier S.P. Singh Oberoi, deposited 3.4 million dirhams (Rs.40.8 million/Rs.4 crore) with the Sharjah court in the presence of Mohammed Ramzan, a representative of victim Misri Khan's family.

The 17 men, 16 from Punjab and one from Haryana, had been sentenced to death by a Shariat court in Sharjah March 2010. They were convicted of murdering Misri Khan, and injuring three others January 2009, following a fight over illegal liquor business.

The murder took place in Al Sajaa area of Sharjah. The victim, who died of stab wounds, had also suffered brain damage, police had said.

Ramzan signed documents waiving the family's right to demand the death penalty for Khan's murder. The court has fixed the next hearing Sep 12 when it is likely to pardon all Indian youth and set the process to free them by October.

The news has brought hope and cheer to families of the youth in India.

"I am happy to announce that 17 of our youth who were convicted and sentenced to death have finally been granted pardon by a court today only," said former Punjab chief minister Amarinder Singh, who had met the youth in prison last year and assured help, said here Wednesday.

Oberoi, who ensured that money was collected by the Punjabi community in UAE to save the youth from gallows, had earlier said that Mishri Khan's father, mother, widow, daughter and all four brothers, had agreed to a monetary compensation of (Pakistani) Rs.8 crore (Rs.4 crore approx). This amount included 442,000 dirhams (Rs.5 million/Rs.50 lakh) as "blood money" and the balance as "compensation" for the family.

The Indian men had all along maintained that they were not involved in the murder of the Pakistani national and that they had been framed in this case.

Certain NGOs and the jailed youth had even opposed earlier attempts to payblood money to the victim's family saying that this would mean admission to the guilt of murder which they had not committed.

All the convicted men in UAE are between 17 and 30 years of age and all of them belong to lower middle-class families in India. The Indian consulate had hired a law firm in UAE to defend the case.

    Good News. Oh what a relief.
    Atleast the blood money could save the lives of 17 people. What a torment it must have been to their loved ones when the court prounced the death penalty.
    Truely grateful to Mr. Oberoi and all those involved in reaching out to those who lamented for so long with uncertainities of their lives.
    It involves lot of hard work and time apart from money alone.

    can anyone imagine this ???  this judgement itself is not beleivable in any international, human court...
    only it will happen in islam..

    i mean law and judgement made based on relegioun ..  here victim was from islam..thats how 17 people of other relegion got punsihed..

    learn before commenting anything..  Islam is a only religion were nothing is illogical there is a logic behind everything...  one who kills his punishment is death in islam shariah but if the family of the deceased wants to forgive with an compensation thats blood money they can do that its not court decision its family decision..

    let me explain with you an example..  suppose your the only one support of the family you have many childrens small kids and a wife and old mother and father...and your the lonely earning for the family...in this case some one kills you and your family has a option to hang your killer or forgive and take the blood money..

    i will be sure they will take blood money coz of the small childrens you have and old father and mother your wife will agree not hapily but for the survival... 

    so my dear freind Allah (Means in english God) has better laws then ur human mind can think...
    but after paying blood money also he cant escape punishment after his death from Allah unless he has done sincere repentnce..

    Reply to Mr A D D'soza,It is very sad.Islamic sharia says that if anybody killed other with no reason he should be hanged till death. Supppose the family member of deceased person has apologised him then he can be left alone with certain condition.

    The family member of deceased should be his wife or mother. And he should pay certain amount as compensation as per the order of court.  If such rule is applied in india india may see lot of death sentences in a day!!!!

    Wonder, what sort of police investigations took place in this murder case, especially when the defendants all along stated that they did not commit the crime and they were framed. Some of the jailed youths in this case were even opposed to pay the blood money that was demanded as they strongly felt that they were not guilty at all!

    I also fail to understand what sort of justice/court system exists in Sharjah/UAE, and especially, it is beyond my imagination how all the 17 people can be convicted of murdering a single person!. Also, whether the court conducted a proper trial and considered questions like, if the victim was also involved in the illegal liquor trading, and that he would have been the provoker of the fight, and also that the death would have been an accidental one, etc.

    In my opinion, the Indian Government/High Commission in UAE has a strong role to play in cases like this in order to ensure that it`s citizens who are working in the Gulf and elsewhere do always get proper hearing and due justice.

    You want to say that the culprits must be hanged? The person will think twice before killing some one that the islamic punishment will be death penalty for the murder or give blood money demanded by the deseased family.

    Of course it will be some great news for the families involved, but I am a bit confused.
    Are you telling me that if you are prepared to spend 40 crores of rupees you can get away with a murder ?? Is this Sharia law ??
