Moodbidri: Headscarf Denial - Student Ready to Approach President

Moodbidri, Aug 14: Mumtaz, a student of Jain College here, who had approached the district deputy commissioner a few days ago for not being permitted to wear headscarf (Hijab) inside the classroom has challenged the college authorities that she would take her complaint even to the governor and if required to the President as well.

Speaking to media persons Mumtaz boldly said that she was not going to accept defeat. "Though I have complained to the DC expecting him to take some measures I did not get any positive response and hence I have decided to meet the governor with my plea. If he too fails to solve the problem I am firm on taking the issue to the President of India," she said.

She further said that she had been fighting for the right of wearing headscarf in classes for a year. Now she also has supporters which included over 50 Muslims and 15 other students. "But the College principal called those 15 students separately and made them give a written statement that they have been forcefully made to support me," she alleged.

"The principal has accused me of creating problems in the College with regard to the issue of headscarf. But I’m only fighting for my rights which are provided by the Indian Constitution. I intend to continue my education. That is why I have been borrowing notes from my classmates and hence I am up-to-date with the lessons," Mumtaz added.

It is gathered that the college authority has formed a separate committee to come up with a solution to the problem.

    As said before the whole world knows and accepts that a proper dress code is very important for a lady, which gives them added dignity and beauty and yes, in India every citizen has the right to wear what he/she decides to wear which our constitution supports.
    Rules, laws, constitutional rights are all made by men for men for discipline and regulate common ground for all to enjoy and not to do things your way and then hide behind it’s cover. This reliance on constitutional rights looks more like a story of doing the rights at wrong places. You can live in peace and let others also live in peace only if you try not to mix up personal likes and dislikes, religion, customs, traditions etc., into an area which is earmarked exclusively for studies and nothing else. Don’t the college authorities also have the same right to decide on what rules their students must follow ?

    I personally appriceate your fight for d fundamental right enshrined in the constitution Article 25 of the constitution of india gives her every right to practice her religion without obstruction.. Ofcourse an institution has got every right to make its own rule but when its violates any fundamental rights of constituion tat rule becomes voilative of constitution which s liable to b quashed. Supreme court of india time and again upheld the right to an individual to practice his religion even in recent case wher muslim boy expelled fro school for sportin beard supreme court has observed it as ridiculous rule n given a exparte ad interim direction to take him back to school whil discussin the issue supreme court has observed n said we have give leniency to sikh why not muslim for sportin beard as of right to practice their religion. Every religion has its own dress code especially women every religion says women to be as modest as she can even at christianity we can see nuns with their highly modested dress code n if u look at vedas it always said a women to cover her head if u look at the antique pictures of hindu women u can find her coverin head which s d sign of modesty the same islam made it strict to its followers to cover her body except face n hands this should b followed by every women but in modern era with an influence of westernisation some may not follow it its their right no one can insist them but those who are willing to practice their religious duties as of right no one can infringes it..     I fully agree with you A. D’Souza, Kodialbail and I’m deeply surprised at the near arrogant attitude of some of her supporters. Isn’t there even ONE brother who could give her good advice? Many as even calling for fight (not sure what kind of fighting they are talking about)? But the main point of argument is, “It is their democratic right to wear an headscarf and all institutions must accommodate that right”

    Wearing a Hijab or a Niqab is Sharia Law, which is prescribed as a dress code for female Muslims. The Indian constitution is drafted from democratic laws and NOT Sharia Law. Sharia Laws are taken mainly from the Koran and the Sunna, whereas democratic laws come primarily from the laws of the Privy Councils, which were inspired by the Bible and the Torah.

    Now figure this part Indians accept the Indian Constitution by enjoying all their rights and privileges in democracy. But Muslims living in the Indian Union would like to wear a Hijab as per Sharia Law, and they don’t stop there they would force non-Muslim organizations having their laws to change their rules and by-laws, by accepting Sharia Law and arguing it is their democratic right.

    Hence, I’m asking the intelligentsia in the Muslim community and those who really know what is Islam and Sharia Law if it makes sense? It is as silly as an Indian in Saudi Arabia asking for a Church, a Temple or a Synagogue to be built in Mecca and arguing it is their democratic right. This is a classic example of eating the cake, but insisting on keeping it.

From your intention it is clear that you are interested in only headscarf and not your studies. Think about development, which brings everything to you, if anyone instigating you to make a issue, please ignore him/them, see your onw future. I would like to tell you how terriorisum existed in this world, because those who started terrorism they did not do progress or any development and those countries did the development like USA, Europe, Japan they become jealous of those countries and they realise that they could not reach to that level and started destroying the development of those country and later on they attached to the religion, those who follow sincerely honestly. Please see your own future and none will be there with you tomorrow, that you feel today everybody is. You have to show yourself what you are and not going behind silly thing.

    I truly wish there was one genuine brother who was wise enough to say to his dear sister “Please do NOT fight but follow the rules”. On the contrary what a great encouragement and words of wisdom I find coming from a brother to his sister saying “Don’t give up the fight we all with u go ahead do let us know what we can do for u”. I can not believe that it is happening in a place like Mangalore where I thought mostly broad minded and matured people lived. Is it not the primary reason why India and Pakistan separated ?. They both fought and are fighting still.

    Are they not ? Is it not something that draws a line between two sides of people who believe in their own formula of believers and non-believers (they call them Khafirs) ? When people from all over the world from all other religious background follow strictly the rules mandated by the Saudi Government with regard to their dress code why do our few brothers and sisters in Mangalore find it so difficult to abide by some simple rules formulated by some ordinary college I do not understand.

    Does it make any sense in threatening to go a President with a complaint who herself covers her head with her saree ? While every one is free to practice what they believe in why don’t we stop dictating terms to others ? Concentrate on your studies your future plans and be happy with what God has blessed with. If you are not so happy please read the article which came on Daijidubai on August 13th under the heading “Dogged by Werewolf Syndrome”. Kneel down and pray to God the Father who said his name was Yahweh and NO OTHER.

    I'm the old student of Jain High school, Jain Junior college , Sri Dhavala college which runs by jains. Reputed institution, no religious descrimination. There are thousands of muslims girls graduated from that institution without head scarf, So far there was no communal problem in moodbidri. Why she is creating bitterness in the public?

    I see a few flaws in your argument of wearing a headscarf when attending Jain College:

    1. If you are wearing a headscarf because of religious rules (Sharia Law) and I respect that, don’t you think it is a right for any institutions (which is non-Muslim) having the right to have their rules followed if you want to join them?

    2. Do you see it right that you want to follow your rules, and in doing so break the rules of that institution? If you do not want to follow the rules of that institution then just don’t go there, take your business elsewhere and to a place that will allow you to have your dress code?

    3. You want to follow your religious rules and in doing so you would ask the institutions you wish to go to change their rule to suit you?

    If you still feel so strongly on wearing a headscarf and going to a School, College or place or work then why don’t the Muslims set up their own institution have their own rules and insist on a dress code for Females and Males that would make sense, rather than you and your supporters dictate terms to every one around and force them to change their rules to suit you?

    Every institution has the right to have its own rules and regulations. .. i guess if we decide to opt an institution, we must abide by their rules and regulations.
    Mumtaz,if you are having problems regarding not being permitted to wear hijab in jain college, y dont you attend a college which will permit u to wear your head scarf??? well most of the educational institutions have such rules, just because, differences between students of different religions should not arise.

    I like the comments of Antony D'souza, Karkala/Qatar, Jain college is private owned institution. Management decision is the final and binding, if anybody going against the management decision, will have to leave the institution. I am sure this act of Mumtaz will lead management of jain college to go against taking anymore muslims students into their institution in the coming years.

    Further to my below comment a Christian women is not required to wear head covering if she is anywhere out side of the prayer house or out side of the worship place.
    Letter of St Paul's in 1 Corinthians 11:5 very clearly specifies to every women when she is prophesizing and while praying should cover the head and not required to cover the head all the time or always whenever she is out of the prayer house/out of the worship house.

    CLARIFICATION TO YOUR BIBLE QUOTES:

    There is nothing in the Holy Bible that a woman should wear head to toe covering.
    Nuns have chosen a secluded life, entirely dedicated to God & they cover their head. They don't cover their face & hands with gloves. Now a day many nuns R only wearing sari which covers their full body (Note mere wearing a sari and salwaar will not cover everything). Hence it is chosen to remain so & not a compulsion.
    Isaac's proposed wife Rebecca came all the way to Isaacs dwelling place without wearing veil & she did not cover her head. Only after inquiring with Isaac's servant she covered her face with a veil. I quote from Bible
    Genesis 24: 65. For she had said unto the servant, What man is this that walketh in the field to meet us? And the servant had said, It is my master: therefore she took a vail, and covered herself. Unquote.

    Secondly a woman should cover her head while she is in a worship place or while praying. St Paul writes quote 1 Corinthians Chapter 11:5 But every woman that prayeth or prophesieth with her head uncovered dishonoureth her head: for that is even all one as if she were shaven. Unquote.
    This verse clearly says while a woman is under prayer. Christian scriptures never say a woman should wear head to toe always when she is outside of the prayer or a prayer house.
    Genesis 24:65 clearly says as obedience &1 Corinthians Chapter 11:5 says only on while she is in a prayer house or a worship house.

    Mumtaz, you cannot dictate your terms and conditions to the college. It is true you like to wear head scarf but it is a personal choice. If each student decides to wear what they like there will be no discipline left. If your intention is to study, you study. If it is a medical condition that head scarf tightens the brains or gives shade to it, then sure you should be allowed. Why are you so bothered about a piece of cloth covering the head. There are millions of women who don't wear headscarf. It is just a issue highlighted every now and then to whip religious passions. Even in the Western countries it is banned. Be logical and you will see the Truth. Even Christians claim that St. Paul mentions of women wearing head scarf when praying but how many women wear head scrafs, hardly 0.001% What is more important is your relationship with God and not to show us that you are a very pious woman by wearing a headscarf. By insisting to go to the Governor and President you show ulterior motives. All those who support you have no logic and will make you more stupid if you listen to them. Be realistic as we indians have many issues rather then your headscarf. God bless you.

    At a time when parents from the minority community take pride about putting in advertisements in newspapers celebrating the academic achievements of meritorious girl students as if telling the whole world how grateful they are for having been gifted with a girl child, there are also few who take pride and appear for the wrong reasons.
    On reading your article and trying to find reason and comparison, fortunately, I could not find any comparison with a few of my friends who also hail from the minority community but have never once made us deliberately feel so and have reached the pinnacle of academic excellence with active support from their parents and family and who now are counted amongst the elite in our circle due to sheer hardwork and goals augmented by the fact that they are gifted with parents who are progressive and elite as well as religious but have modified their orthodoxy in tune with the needs of our diverse Indian society. My heart weeps out time and again when I come accross such instances as reported by you. May we all be gifted with common sense of duty towards our nation first than our religion.

    It is understood Uniform is required to be worn in precollege schools for many. This is not a school or highschool. It is a college. Nowhere it is has been observed colleges can ask students come in Uniform. Jain college in Moodbidri has no school Uniform. They are not school kids there.
    If she need to remove her headscarf, it is similar to removing turban or peti from a sikh student.
    Can the college do that.

    Dear Vinod, wearing a head scarf is not a problem however you should follow the institutions guidelines. The student could have been given up once there is a objection. Opposing schools descipline itself proclaims the truth. The comparison to Nuns is not correct. Nuns are permitted to wear the religious dress as the institution is aware of it and Nuns are bound to religious vows. And if they not permitted to wear such head cover defenitely they will opt for some other educational institution where they permitted to wear the same

    It is important that whatever rules and regulations the educational institutions want to impose on students should be printed in the prospectus itself. This becomes easier before the student takes admission in that institution instead of creating this kind of commotion. Besides the management should also specify the dress code for the students. What if a Sikh student joins the school, Will the management ask the student not to wear his turban inside the classroom should he leave his hair free or have an hair cut to join the school/college?

    If that is the case where do these students go for education. Some readers have commented that if she wants to follow her religion, she should join an Islamic institution. What kind of a statement is this. I certainly do not agree on this debate. Now it's a prestige issue to the management to take back its decisiion.     The use of Uniform in the school is uniform for all irrespective of caste, creed or religion. The main purpose of the uniform in an institute is mainly to inculcate a sense of unity amongst the students, besides other reasons such as to obscure cultural and financial discrepancies. By enforcing ones right to wear the dress of one’s right, the very purpose of using uniform is defeated. In Lucknow even the members of the enlightened erstwhile Navabi families have absolutely no hesitation in complying with the code of conduct related to uniforms in the premier convent schools. Why, then, a particular student should stand aside from the mainstream and not comply with the system?

    I think wearing the headscarf or the so called Hijab should be fine as long as they don`t cover the full face (wearing of the burqa). Inasmuch as the Sikh boys/men wear the headscarf (pagdi) and the Christian Nuns from some congregation cover their heads, which is generally allowed everywhere, why not the Hijab? I suppose Mumtaz can still wear the College Uniform, if there is one, and cover her head with a matching scarf.

    You are fighting for your right as per the constitution. But you have to remember that, every school or college has a dress code and conduct. College is not a place to fight against the rules which they have laid upon, rather you better fight academically and bring glory to you family, college and get a bright future. In Saudi Arabia, even a Hindu or Christian lady has to wear burka because it is the rule of that country and all Indians follow that. Here in Malaysia, basically an islamic country, wherein I teach in a government Medical college and all islamic girls/ladies need to wear headscarf but at the same time the chinese and Indian student need not wear the same. What a beautiful and harmonious secular feeling these people practice, we Indian should feel ashamed. We Indian, politicise every opportunity and try to bring a communal rift. We are the educated so called knowledgeable people of DK better stick to the rules of the college and excell in studies and challenge the college that, other community student too get ranks(after all we all are Indians). Your challenge is good but different political parties will take advantage and mileage because of your case and that may spoil the peace of our Mother India. Let us remember, Hindu, Muslim, Sikh or Christian we all are Indians and moreover brothers and sisters. God bless you.

In general, it is the first predicament or a measuring rod to gauge the things that majority have dictated in the past and so will become adamant in the future. However, if your intention for a public or publicity fight assuming that you could be role model or spokeswomen for your community in future, well, your adversary will also draw a more solid contingent plan against your custom not to be adopted in their controlled educational institutions.
    Most importantly, have you ever fought for your equal rights to worship or to pray along with the men in the mosques ? Have your men ever complied by it ? Which is more important ? Whether your equal rights to worship in the mosque or to fight for your right wear headscarf (Hijab) in the majority controlled educational institute ? Have you taken this case ‘right to worship’ till Delhi so that your Iman could give you the justice to you and other women worshipers too ? . If you can do it, definitely you will become a trend setter among your male dominating society. Let us keep our house in order before questioning the neighbor’s house. I am not mixing the things nor I am against your religious values or Hijab. But only I hope that this comparison of mine will surely open your eyes, will make you to realize and will definitely help you to go for a peaceful solution among your own people.

    Wearing of Headscarf is a religious rights as per the constitution. But if the school does not permit wearing scraf inside the class room means it is against your religious rights. We have to follow the rules and regulations of the school or college. Why there is uniforms in the school ? Students study in the school are of different religions. School can not permit to all students to follow their religions inside the school premises. We should accept that we all are one and Indians. If any thing taught and said against the religion of any student then the student has the right to fight against it. First of all We are human beings and the religion is scondary. The child does not know about the religion when born. There is only one God and one destination, but the ways to reach the destination is different...

    since India is a secular state, let us respect every religion. Hijab can be a symbol of piety and it can be a sign of great inner strength and fortitude. A woman wearing hijab becomes a very visible sign of Islam. While Muslim men can blend easily into any society, Muslim women are often put on the line and forced to defend not only their decision to cover, but also their religion. Nevertheless, women who wear hijab insist that the advantages far outweigh any disadvantage conjured up by media bias or general ignorance. I feel the college management is unnecessarily making an issue out of this and harming the students career. She has already lost couple of month's study though she takes notes from her classmates and copy to herself. Let us follow our religion and allow others to follow theirs.
