Puttur, Sep 22: In a landmark judgement, the Motor Accident Claims Tribunal here has awarded a compensation of Rs 29 lac to the family of a person who lost his life in a road accident. Through an order passed on Wednesday September 21, the court ordered the insurance company and owner of the tanker that was involved in the accident, to pay the compensation to the claimants.

On June 14, 2007, K Ramachandra Bhat, principal of Vittal PU College, who was a resident of Bajattur, was killed after the Kinetic Honda two-wheeler he was riding, was hit by a tanker near Kootelu Bridge, Uppinangady.

Thereafter, Bhat’s mother, Sharadamma, and son, Krishna Prasad, had filed a claim in the said tribunal, seeking compensation and family maintenance, as the late Bhat was the breadwinner of the family. Velu Murugan, driver of the tanker, owner of the tanker, Doraiswamy, and the insurance company which covered the vehicle, were named as defendants.

The judge of the tribunal, P T Kattimani, while passing the above order, also asked the defendants to pay interest on the said sum at the rate of six percent per annum from the day of the claim application till payment. Advocates, Mahesh Kaje, Kishore Kolattaya, and Prasadkumar Rai, had appeared in the court on behalf of the claimants.

I lost my father 12years back for no fault of his,and till date we have recieved no compensation just because the accident was with a govt company i.e kSRTC. God knows when they will realise that my father too was a sole bread winner for the family and me and my sibling were still doing our studies. Hope some light is thrown soon and justice will be done.

I appreciate the judgement of the Tribunal Court. Every person who is killed for no fault of his should get same justice and compensation. Besides road accidents even murderors should be told to compensate the family members of victims or their property should be confiscated, but that again depend upon how these criminals are caught in the first place.

I hope more judgements like this would make people who own the vehicles and drivers to drive carefully combined with police enforcing strict driving rules.

More than 100,000 people die in India due to road accidents alone. More than a million people get injured every year which costs the nation more money than 'notional 2G loss'. The accidents are mainly due to bad driving habits and poor roads. This makes travelling by air and rail makes much more safer than the roads. Its a good move that the compensation for the road victims has been increased substantially and in good direction. The sad news is that only one third of the vehicles have the insurance and still they fly on the roads which is criminal offence.
