Bangalore: SC Ruling - Now, A Hint of Tint on Your Car to Attract Fine

Bangalore, May 5: If your car windows have dark tints, you will not only be violating Central Motor Vehicles Act, but would also be in danger of facing charges of contempt of court, as per a Supreme Court directive put into effect in the city on Friday May 4.
The order states that tinted film of any density or darkness will be banned and only car windows tinted by the manufacturer will be permissible. Rule 100 of the Act states that there must be a minimum of 70 percent visibility in the front and rear windows and 50 percent on the sides.
Offenders will be fined upto Rs 300 and permit of the car may be seized.
"We have no hesitation in holding that use of black films or any other material upon safety glass, windscreen and side windows is impermissible," a bench of Chief Justice S H Kapadia, Justice A KPatnaik and Justice Swatanter Kumar said.
Pronouncing the judgment, Justice Swatanter Kumar said: "Use of films or any other material upon the windscreen or the side windows is impermissible in law. It is the visible light transmission (VLT) of the safety glass without any additional material being pasted upon the safety glasses which must conform with manufacture specifications."
However, the Supreme Court judgment is unclear on whether tints of any thickness will be allowed.
“As per the order, no tinted film or black film must be additionally placed on the windows and windshield. People were taking undue advantage and installing black films which could not give any view of the insides,” said MA Saleem, Additional Commissioner of Police (Traffic and Security).
He added that the Bangalore Traffic Police would initiate a campaign soon to encourage car owners with tints to remove the films voluntarily. “The aim of the SC order is to ensure that these films are taken off, however, it is unrealistic to expect car owners to take them off at the spot when fined. We shall spread awareness through campaigns,” he said.
Saleem added that the traffic police had called a meeting with cab drivers and taxi associations on Saturday May 5 to discuss the same. Traffic police also sent text messages on Friday and warned public on Facebook.
VVIPs are exempted from the rule as of now, but the final decision on allowing VVIPs to use tinted glass will be decided by a comittee appointed by the government.
