Bangalore: SC Ruling - Now, A Hint of Tint on Your Car to Attract Fine

Bangalore, May 5: If your car windows have dark tints, you will not only be violating Central Motor Vehicles Act, but would also be in danger of facing charges of contempt of court, as per a Supreme Court directive put into effect in the city on Friday May 4.

The order states that tinted film of any density or darkness will be banned and only car windows tinted by the manufacturer will be permissible. Rule 100 of the Act states that there must be a minimum of 70 percent visibility in the front and rear windows and 50 percent on the sides.

Offenders will be fined upto Rs 300 and permit of the car may be seized.

"We have no hesitation in holding that use of black films or any other material upon safety glass, windscreen and side windows is impermissible," a bench of Chief Justice S H Kapadia, Justice A KPatnaik and Justice Swatanter Kumar said.

Pronouncing the judgment, Justice Swatanter Kumar said: "Use of films or any other material upon the windscreen or the side windows is impermissible in law. It is the visible light transmission (VLT) of the safety glass without any additional material being pasted upon the safety glasses which must conform with manufacture specifications."

However, the Supreme Court judgment is unclear on whether tints of any thickness will be allowed.

“As per the order, no tinted film or black film must be additionally placed on the windows and windshield. People were taking undue advantage and installing black films which could not give any view of the insides,” said MA Saleem, Additional Commissioner of Police (Traffic and Security).

He added that the Bangalore Traffic Police would initiate a campaign soon to encourage car owners with tints to remove the films voluntarily. “The aim of the SC order is to ensure that these films are taken off, however, it is unrealistic to expect car owners to take them off at the spot when fined. We shall spread awareness through campaigns,” he said.

Saleem added that the traffic police had called a meeting with cab drivers and taxi associations on Saturday May 5 to discuss the same. Traffic police also sent text messages on Friday and warned public on Facebook.

VVIPs are exempted from the rule as of now, but the final decision on allowing VVIPs to use tinted glass will be decided by a comittee appointed by the government.

    First of all i think this should be applicaple for the VIP's Only as they are the first culpritsin doing all sort of nonsense.And i hope the law/rules and regulation to be one and the same for each of us.
    Actually to be frank this doen't make any sense its a type of reducing population one way by exposing evrything naked inside the carz.

    With all due respect to the officers, you should not think so called V VIP's from others as they can afford for Z or Z class vehicles. If so, then let the govt. manufacture sun control film, with 3M garware or some others collaboration so that common man needs it.You people think of making money so that your payments are well secured aint ya? Think it over.

    Oh c'mon. Everybody knows that these rules are only for low-end vehicles. Luxury vehicles are never stopped.
    Has anybody ever seen a Audi, Jaguar ,BMW or Mercedes being stopped by the Police for "document checking"??

    I dont see any justification for SC ruling for removal of tint on glasses of cars for the reason attributed thereon.Criminal acts are the perpetrated by few only therefore all civilians can not taken for a ride and made to pay for that.Criminal acts to be curtailed by law enforcing authorities for which civilians are paying tax.Now a days chain snaching is taking place in an alarming rate by bikers and for that reason we can not ban use of two wheelers as a measure to contain such acts.Government appears not so serious about the repurcussions of the SC ruling and its after effects.Car owners will be robed by the automoble work shops and also by traffic police personnels.After all tinted glass is preferred by the car owners to have protection from sun rays and also to have privacy not detrimental to soceity and facilitate usage of AC.If the tinted glass is used for any anti social acts or acts detrimental to soceity then such car owners/drivers are to dealt with severaly under law with out any lenience. Proposed law will only an act as popular Kannada proverb "Hotte novige Juttu koidanthe".
    Alternatively,government can take afordable measure that puts minimum hardship to car owners such as opting for submission of affidavits to the respective police/Traffic police stations stating that cars will not be used for anti social/criminal acts of whatsoever.In any such event of finding the car used for such purposes the vehicle be confiscated and drivers/owners DL will be canceled.
    There is no doubt that present law is a retrogade step.Government needs to formulate people friendly alternatives rules in the wake of SC ruling.

    I Agree both of the above view.because In each and every restrictions n rules we can find that the vvip is exempted.why it is so? as the opinion of Mr. Kenneth,said the fact that we are the comman man of every indian citizens are the tax payer,but the vvip of especially, the politician are excluded from every rules...is it the republic country or the dictatorship.for what n which purpose they are exempted from many rules and free from many payments., what they are sacrified or contributed to the country? they the freedom fighter or what? in fact we can see thease politicians are the looter of our country by many ways., the vvip of businessmen and celeberities only keep the huge pending of tax amounts of our country. eventhough they are free from....shortly many of rule and some of constitutional laws are not applicable to them.wah Mera Bharath Mahaan.

    Nothing will happen in country like India. This is another bumper crop to Traffic Police to milk money from offenders. We need a Traffic Police Dept of Gulf Countries like Oman or UAE. In Oman, Police will stop those cars which exceeds 30% limit for tinted Glass and ask them to remove the film by parking aside off road and they will not move until job is done by concerned person else their vehicle will be confiscated and fined too

    Firstly let the Supreme Court wake up and see all the Police jeeps in Mangalore with full black tint. Whether they are drinking or doing other things inside is unknown. If WE the tax payers feeding all these so called Government Servants are not permitted and VVIP's are permitted, THEN WHY SHOULD WE PAY TAXES? Let them pay for us. Also Police vehicles these days seem to be like discos. Loads of lights under chassis, black tint, nice plush leather seat covers, the works. So who is the servant of the PEOPLE then? Its no wonder these days many vie for posts as Policemen. Better pay and under cuts. Dear Supreme court, its hay time you woke up, travelled the country and tried doing this. It will never work. Coz its OUR INDIA.

    These tinted glasses save on cooling of the car so we dont have to use airconditioning and there by save fuel. Especially in these days of rising fuel costs an alternative should be suggested or a way to tint glasses by other means should be suggested before enforcing the rules. And why are VVIPs expempted. All are equal if the common man cannot do it then the VVIPs too cannot, law should be equally applied to all

    Bounty for police department!How can we tolerate UV heat from Sun? Of course the issue is related to safety and security of passenger but Court should look in to other side the issue also.That also with in time limit SC asked to chase tinted glasses of the cars! I bet police can remove minster car's tinted Glass or minster's family car's ?No not @ all these laws for average/common man only.
