Mangalore: Child Marriage Averted - Bride’s Father Wants Gold Back

Mangalore, May 13: The wedding of a 17-year-old girl with a 37-year-old man scheduled at Veerabhadra Temple near Ullal on Sunday May 13 did not take place, said government officials.
 
Acting on a tip off, officials of the child welfare committee (CWC) were alerted to the marriage.























According to Asha Nayak, chairperson, child welfare committee, D K District, the girl Surekha (name changed), a resident of Kujambahithlu in Mastikatte, Ullal, was supposed to be married to Sureshlal, a native of Calicut, on Sunday morning. No case has been registered at the police station as the CWC officials finally made them understand the consequence of child marriage and called off the nuptials.
 
However, when officials reached the venue, the bride's family refused to cancel the marriage on the grounds that they had already spent about Rs 3 lac on marriage arrangements though the girl was not desirous of the wedding.
 
It has been found that the engagements took place over a year ago and ‘mehendi’ ceremony was held on Saturday May 12. Officials had a tough time convincing them starting from 9 am till 3 pm. It is also learnt that the girl’s father was furious about the cancellation of the marriage and mercilessly demanded that the last pinch of gold ornaments and sarees be returned to him.
 
Finally, the CWC took the girl into their custody and a medical examination to asses her age will be done.
 
According to law, a girl under the age of 18 getting married is a violation of the Child Marriage Restraint Act 1929. However, as the marriage did not take place, no police case was registered said sources at Ullal police station.

    Our law are utopian, Victorian most of the readers think in a conservative way but we do have two men here who think liberally - one who succeeded in marrying a teenager with the huge age gap and the other trying to prove that men have right to it. We are to agree that they are not saints but that they can desire to marry a girl in her early teens because law permits it. They don’t touch the topic physical relationship with the girl – consensual or forceful – because the law does not specify as to from what age the girl can be subjected to this.

    Are we readers fools to believe that you two will wait for the girl (hereafter of course your wife) to reach an age and tell you that she is ready to build the physical relationship with you ? Give us one reason to believe that you will not attack her monstrously on the very first convenience ? Why should other bother any way – she is your wife whom you have legally wedded !

    Nevertheless, I would draw your attention to two more men who thought in your line and married women much younger than them – Salman Rushdie and Imran Khan. These men perhaps did not have a piston ready to support their waist upon crossing 50 years, that is why their legally wedded, rightful women ran away. This should not necessarily repeat with you two because Mr. Braganza, you have well researched that your counterpart has a workshop. He may have got a tool fabricated and promised to make one more piece of it for a supporter as robust as you.

    Good luck gentlemen, for once I turn my blind eye when a woman is treated as a commodity instead of one to have made up of emotions and desires as you are. I once forego my plea to parents to equip their daughters to fight the unfortunate through education, talents and skills. Trade them like animals, get rid of your burden of bearing a girl child !

    @ srinivas , chennai : I was talking 'age of marriage' not 'age of consent for sex' , court has more lineancy when treating with marriage , even if one of the partner falls ender 18 (>15 ). There are numerous cases , of both apex and highcourt uphelding the validity of these kind of marriages . It also should be noted that girls consensus also critical. Coming back to yout 'age of consent' debate , i know our laws r victorian , out dated and regressive. If the law recenly drafted which criminalizes sex under 18 , passed in parliment and implimented seriously , half the indian youth should go to jail . Law is very funny at times , wot to say!

    Your interpretation of IPC Section 375 Part6 is wrong. It is legally a rape of a minor girl with or with her consent. The ages differ in different states but generally accepted age of minor girl is 15. In your language, you will be jailed even if your girlfriend agrees to have 'fun'. Be careful.

    If sources are right , that guy got married to another girl on the same day after this event. The girl is from tokkottu and she also of almost 18. It looks like he was very well settled (has a workshop) , so the girls parents was interested , not sure about the girls consensus. This same guy could have filed a petition in court making his marriage legal with her and parents consenus. Anger towards this man is meaningless and irrelevant , what he wanted is nice marriage and family to start up with .

    Every parents of a grown up girl want to see their daughter future bright , so they want her to b with a person emotionally and financially souund. This case looks the same .This guy was a true match and they agreed. Some peaple were furious about the age difference , damn , if girl , boy , family are ok with this , what the tom , dick and harry can do about this. Are v getting liberal or conservative day by day.

    Like this many more young girls suffering the only one solution before the marriage (court,temple,masjid,church) all will register and take consent of girl & boy before the wedding church we do that but others i am not sure better to have this rule so no girl or boy will be forced to spoil thier life for any reasons....plese karnataka grow up and make some sensible security god knows how many girls are suffering and spoiling thier life for nothing...............

This looks like a drama, seems to be no girls in Calicut, coming all the way from Calicut to Mangalore to spoil some innocent girl's life...     @ krishnaraj , i quote some of the phrases and clauses , u can google it later. Hindu marriage act 1955 and 1961 , a 16 plus girl can get marry with parents consent . Section 375 of indian penal code ' sexual intercourse of a man with his wife not under 15 is not rape' , it clearly states 15 yr old wife . There r also the clauses about 12 yr old brides , u can search . Actually its a rape code , but court upholds this in certain marriages . And also one has to understand age of consumation is 15 as against age of marriage. In total there r lot of confusion and law clash each other , one has to put right petition with girls consent to legalise wedding of 16 old girl as in above cases. This applies to only hindus , muslims have their own personal shariat law , where 14 or 15 old girls marriage is legal. This laws clashes with child marriage act 2006 , but some courts uphold the marriage.

    In nice and neat sentence , if a man marries 15 old girl , marriage is legal but he vl b punished , he can go to court and cum out on bail later and set for honey moon. As for christians , their law upgraded in late nintys and early twentys century which is more like hindu marriage act , but catholic church sets minimum age as fourteen as in spain and vatican . M not einstain but feel this is enough.

    @ mrs lydia lobo kadri , you pointed out some irrational ideologies. Common , now a days teenage pregnacies r common , even in india . A 15 yr old girls knows lot of things and is not child by any standards. Even if i have daughter , i vl encourage her to get marry whatever age she wants , if she wants at 18?.. so be it , with 20 yr old guy ? . . so be it. Why r u propagating marriage as a bane or a curse , its such a wonderfull thing that can happen in girls life. Even the skilled profn like IT is also one kind labour and neatly described as work , so more population , more work , more labour. Even the tenth pass girl can earn her livelyhood if she has skills and also she has the option of continuing her education after marriage.

    And lastly men r always wired to b getting attracted to young girls , its happening since ages. The man in picture like young girls to wed , thats his right. Why say itz late , u can find lot of men single upto forty and getting married later . Its their personal choice. And make no mistake , if i was in his position i could hav done the same. I prefer a teenage bride rather than the aged woman. M not a saint and its a fact!

    Some parents start worrying about their doughter's wedding from the day of her birth becouse of many reasons including dowry & they will be more then happy to get her married if some praposal knoks their door without respecting the opinion of their doughter. This incident is an eyes opener for all such parents. Now this parents have to worry about socity, police case, court & usual expenses involved like fee, bribe...etc

    Even if I buy your argument on law and clauses (which I actually don't), would we give our own daughters or sisters in marriage at an age as this girl ? Have you no concern about their physical ability/inability ? Your grandmothers may have delivered at 15, may have born a dozen of children, that was an agricultural era. Every child was considered as a bonus, an additional labour in the fields - is the situation similar today ? Today's children are extremely malnutrition-ed, especially anemic. They are not living in the era of your grandmother when milk/butter were a free flow.

    Would a child (irrespective of gender) be able to survive today without basic education ? At the most she may have passed SSLC, is it sufficient to earn her bread (and that of resultant children) in case of any unfortunate consequence ?

    Have you any idea about her ability to tolerate sexual advances ? The man will be a hungry animal and she will be brutally raped, with no means to protest just because she is his legal wife ?

    Perhaps you should discuss this with a female member of your family I cannot defend the girl much on an open forum.

    I agree that there is no territorial barrier to find a match. You did not answer if there are no girls in Kerala ? He must have been chased away from there to have desired to marry this late ! What was he doing till now ? Though late, why isn't he looking for an older woman remained single due to inability to marry or, a widow ? Can you reply ?

    @ mrs lLydia lobo kadri , it was just my opinion and i feel most of them agree with me . Please have look at the clauses of IPC section in india for age of marriage. True ,Child marriage act is upgraded in 2006 but 16 years clause is also true. Do u know 15 yr age clause , pls google it . Recently one of highcourt ordered ' if girl above 16 and have marriage consensus then the marriage legal. It came in all the papers. Bottom line is that laws are subjected to perview of judges and also depends on states , lucus standi etc. In the above case boy can go court asking validity of marriage. But he got married to same girl another day and girl not had the consensus , as they say. Please be liberal with age difference , you cannot say person 20 yrs older will die early , thats a joke .

    Death depends upon ur life style habits and fitness. People can come anywhere from india and get married, its their fundamental right . Our grannys used to deliver healthy babies at 15 , so whats the problem now. Dowry is custom , in sum places men also give dowry. Leave it to people choice if its their culture . Hope I answered all your questions.

    Beautiful scenario about the Marriage, whenever there is happiness people are rushing to spoil it. But when people are in need and in difficulties, people will help through DaijiWorld. At last our society open their Eyes, while wrong doings happenings. The marriage looks like Father n Daughter, there is no sense in marriage Age of 16 to 37. Parents should have thought before spending the amount which is in claim, they are not marring the Girl, they are spoiling her life. Thank God, you came to rescue the innocent Girl. From Kerala To Mangalore, to find the Girl ? At-least Kannur would have been considered if his age was 27years.     Which country's law are you referring to ? The CWC officials (Indians) say that marriage below 18 years is illegal ? You also say that the age difference is not a problem the girl is 20 years younger than the groom. Are you joking ? She has herself has not crossed the growing years (20) within which if she gets pregnant, do you know it is harmful for her as well as the baby as well ? What the man would do then ? Look for another girl of 17 ? Or, what if the man dies within say.. 20 years ? You have a 37 years old widow with a couple children to feed ?

    Why did the man from Calicut come to Mangalore looking for a girl ? Is there a dearth for girl in Kerala ? The girl's family does not look poor considering the ornaments on the bride ! Why did they not find a match for her withing Karnataka ?

    Moreover, our society must come out of the custom of getting the girl's side pay for all the expenses of marriage - share it 50-50. I know there would be a lot of opposition to this - people want to kill their unborn girl child at the same time want to live on those manage to survive ! Cruel world!

    There is no need to make much hue & cry about this marriage since Bride is 17 years old and just short of one year for legal age of marriage. But little concern is Groom’s age i.e. 37 years means two generations gap is worry some too. Second most worrying part is Bride doesn’t want to get marry this Groom as mentioned in the report. And thirst aspect is who informed CWC and what his /her intention was by doing so!!!!! People do not realize the pain and financial trouble caused to parents of Bride or Groom to arrange this marriage. They must have already spent lot of money for arrangements or they might have taken loan from somewhere else too. Moreover 17 years girl is no more child and she can understand very well whats' happening around her. If she doesn’t willing to marry this boy, should have told her parents. But any how people like Asha Naik gets free publicity by stopping this marriage and same time they forget to understand the child marriage definition too. 18 and 21 years of age restriction for girls and boys respectively set by Indian Government nothing but to control the population growth only. If a marriage takes place before the maturity of a girl or medically unfit, then it should be treated as child marriage. Then marriage takes place on 17 years and 364 days of a Girl should also termed as Child Marriage and by the time you register a case for this child marriage becomes legal since it takes at least few days to prove it

Age difference relationship exist and it depends on mutual love and understanding . I feel sorry for this man . I feel he is uneducated and not rich , thus unaware of his rights.     In this case first of all bride's parents should be booked and severe punishment should be handed over to them for presurising the young girl to get married.     according to indian penal code girl above 16 years can get married with parents consent . As both mom and dad of the girl were ok with the marriage , what was the problems i cannot understand. As the girl and boy both are hindus they fall under hindu marriage act , which has certain clauses. Even if a 15 year old girl gets married marriage is legal , but husband and family can b arrested for that . I think husband can go to court seeking permissability for marriage or wait for one year.

    There is a big discrepancy in the age between couples which is a factor and bride's under age marriage is also illegal.Apart from that all preparations and expenses went astray.I think some body from Bride's side tipped to officials and Bride may also not willing to marry him.Anyhow, it's good,marriage stopped but I wish and pray, may god bless her with young bridegroom,her choice next time.
