MCC officials led by health inspectors Sreeshanth, Ramu and assistant heath officer Raghunath sealed a garage near a residential area in Shivanagara at Pandeshwar here on Tuesday November 6 for causing disturbance to the people in the vicinity.

A car garage owned by Ravindra Marnamikatte and Mohammed Wajid Hasan was said to be causing noise pollution and creating disturbance to the public. Dinakar with the help of the public filed a complaint with the health officer stating the inconvenience caused to the residents.

A notice was served by the MCC commissioner to close the garage on June 24, 2011. However, Ravindra moved court seeking justice, but his plea was squashed.
 
The commissioner of Mangalore City Corporation then served a notice to the garage owners as per the clause 355 and 443 of Karnataka Municipal Corporation Act 1976.
 
Health officers on Tuesday November 6 at around 10 am, arrived at the venue and sealed the shutters of the garage.

Earlier, the commissioner had also sent a letter to the garage owners dated October 16, 2012 warning stringent action if the garage was not closed within three days of the order letter
There were a total of 15 employees working in the garage.

    MCC sent notice to garage owner to close the garage for noise pollution. I heard in Majila, residents issued notice to MCC to stop flow of sewage to their wells. MCC never visited. This can happen only in India. This is called sarvadhikara. Why people become naxalites, terrorists etc. It is because of this double standards of Governments officials. Elected representatives should read this page of Daijiworld and offer their comments. Why Yogish Bhat local MLA is silent. He should offer his comments. He should right or wrong. This time atleast people should ask him when he comes to beg votes. Ask him why u have not visited the spot when things were reported in newspapers and Daijiworld. Do not think people are bhakras. You have moral responsibility for all these attrocities. Atleast good God Rama will not tolerate your careless attitude to the burning problems of ciitizens of Mangalore. Concreting road without making provisions for underground water pipes drainage pipes is possible only in India. There is no one to question. Voters start asking questions as if Mangalore or India belong to you. Dereliction of this duty is answerable in the next Janma. Let wisdom prevail upon all human beings. Good job Daijiworld to highlight the cause of a poor garage owner. Keep it up. it requires guts these days to air such grievousness.

    Why MCC should seal only one garage? There are 100 hundreds of them in Mangalore most of them operating on the concretised road itself! But they render free services to Government vehicles. It is only poor chap like Mushtak suffer. People complain only when they have personal enemity with somebody. Atleast the MCC officials should have applied their mind why Dinker is complaining against a particular garage owner when there are hundreds of garages in Mangalore most of them illegally. Thus it is a case of misuse of law for the betterment of someone. This is not correct. There should be a clear yardstick with the MCC for dealing with such cases. If they have taken action against all the illegal garages their action could have been justified. But such unilateral action is not in the interest of natural justice. Perhaps this garage owner was not ready to fall in line with the illegal demands of MCC officials. When everyone obliges to repair Government vehicles freely why not this garage owner. This may be the reason, perhaps or as rightly pointed by someone that they have not paid the mamool. The manner in which the raid has been conducted on a single garage owner gives room for suspicion on the intention of the raiding party.

    Hi All,
    This is ridiculous. Have you have been to DC office. Have a check then. The most pollution is from that place with water clogging. I wish I could take few foto's and give it to Daijiworld. The first place to be seal would be the government offfices. People just close their eyes. Go to the Ration card office located in the DC office and you will find people happily working with the place I believe which is never been cleaned till now. Let MCC raid these places and certify that they are fit to use or need to be sealed. I pity the whole system and the main culprits are the workers there who needs to highlight. That place looks like a ghost house. Take some snaps and post. Let everyone see the truth.

    Do these guys require standing ovation for unemploying 16 persons and I am sure the garage owner is in debt too so please do not blame these guys start in path of crime when he garage owner has corporation license ,when proper relocation of the garage and to rehabilitate them! shutting down of this garage could be only due to the influence some highly connected " neighbor" who wielded his political "Power" to evict probably a honest and hard working persons , these what I have noticed in India it is really hard to make a honest decent living as people around you force you to become a bad person, once you turn bad then it is easy to live in this totally corrupt place!! just 10 days in India I already regret being a Indian!!

    We have to see whom these residents are in nearby this garage!!! Else we have never seen you made a complaint and MCC took action for closure of any commercial activities in residential area. Of course, day and night activities in any garage will make lots of disturbances in residential area but why did MCC waited for a complaint lodged by an Individual rather than closing this garage long ago!!!

    Finally MCC successful for seal the Garage. Did they think any alternate facility can they provide to poor garage owner. I totally agree there will no justice for ordinary, poor people in india. High profile people can live their life style as they want. One thing we cant understand people can hear loud voices, musics and devotional bells but they don't have patience to hear this.

    As far as law is concerned, it is applied to the poor owner. Now what is the next step. Did MCC took any pro-active action to relocate the employee and also any support is extended to the owner for his livelihood.

    Point to be noted, what action court has taken against the licence issuer who is a MCC employer / inspector for his wrong doing. Has he been reprimanded properly. When the question of tax collecting, everyone is equal for the government and to the law. But when it comes to point to provide employment, government and authorities are the first ones to escape from their role. And also applies reservation/cast policy.

    I think we should not judge this only based on neighbors complaints. Improper verifications and studies before issuing licenses made this mess. There is no point in blaming a poor garage owner. What can you expect from them? A garage to work like schools and colleges? So calmly and quietly? Naturally a garage is a place where we hear lot of noise, mess and all that.

    The municipality is the one who granted a garage license, it was their duty to verify each and every factor, merits and demerits of its operation, environment issues before granting the license. Now, after years of its operation, if you say you are not at a right place means we are wrong not him.

    The government or the municipality, they are the one who should separate commercial/industrial areas from residential areas. While granting permission, they should verify each and every factors cause during its operation.

    First of all the Honarable Court must dismiss our MCC because they have failed to provide the Footpath & Drain in Mangalore City,So this MCC is Nuisance to Citizen.The City Bus Horns So far the Bus owners not Changed,Why not they seize the Bus?

    Such cases may be plenty in Mangalore ....Can MCC apply same law?How could MCC health officials involved in this case?Better,they would have checked restaurants ,eateries, fish markets and other catering facilities.Should this garage belong to to TATAS/MARUTHI-SUZUKI/TOYOTA.....no body had dare to complain or even MCC dared to take action.

    Well done by MCC. MCC should not give licence to garages or any other industries in residential areas which creates pollution and sounds day/night leads to sickness/disease and it is extremly difficult to live during school exam times in that vicinity

    Indeed a correct measure by the MCC. But let MCC take the initiative on their own rather than waiting some one to complaint. there are ways and norms to set any business but unfortunately some people are making mess out of it and the concerned officails are not taking action on the first day itself. If these sort of strick actions are taken then Mangalore and even city will be clean and green unlike Bangalore which has become famous to a unwanted reasons.
